ITEM BACKGROUND: Hurricane Irma did significant damage to the Pigeon Key Commissary and Honeymoon Cottage. The County received a DHR Special Category Grant for the repairs. Upon completion, the grant required that a covenant be filed on the property. This item is to ratify the covenant executed by the County Administrator and to record it. PREVIOUS RELEVANT BOCC ACTION: 2/20/19—BOCC approved a Task Order with Bender& Associates Architects to prepare architectural repair drawings for the damaged buildings and also to update the Historic Structures Report for the island. 4/17/19 - BOCC gave approval by Resolution to submit a grant application to DHR for the Special Category Grant for the Pigeon Key Commissary & Honeymoon Cottage Buildings. (Res. Box 1026 Key West, Florida 33040.1026 RESOLUTION NO. -2024 A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA, RATIFYING THE EXECUTION OF A PRESERVATION COVENANT BY THE COUNTY ADMINISTRATOR RELATIVE TO THE REPAIR AND RENOVATION OF THE PIGEON KEY COMMISSARY AND HONEYMOON COTTAGE THROUGH FUNDING PROVIDED BY THE FEDERAL EMERGENCY SUPPLEMENTAL HISTORIC PRESERVATION FUND,HURRICANES HARVEY,IRMA& MARIA RECOVERY (ESHPF-HIM) AND AUTHORIZING THE RECORDING OF THE PRESERVATION COVENANT IN THE PROPERTY RECORDS OF THE PIGEON KEY HISTORIC DISTRICT WHEREAS,the United States Congress enacted the Bipartisan Budget Act of 2018, Division B, Subdivision 1 (Further Additional Supplemental Appropriations for Disaster Relief Requirements Act, 2018), Tide VII, Department of Interior, National Park Service, Historic Preservation Fund (Public Law 115-123) on February 9, 2018; and WHEREAS, pursuant to Public Law 115-123, Congress provided additional funding to the Historic Preservation Fund, administered by the National Park Service, for necessary expenses related to the consequences of Hurricanes Harvey, Irma and Nlaria; and WHEREAS, pursuant to Public Law 115--123, a total of$50,000,000 was made available in the Historic Preservation Fund for award to individual states for historic preservation projects- providing relief for damage sustained by historic properties in areas that have received a major disaster declaration pursuant to the Robert T. Stafford Disaster Relief and Emergency Assistance Act(42 USC 5121 et seq.) as a result of Hurricanes Harvey, Irma and Nlaria; and WHEREAS, pursuant to Grant No. P19AP00012, the National Park Service awarded the State of Florida $4,959,699 to fund subgrants for recover', repair, and disaster mitigation activities directed at historic properties damaged during the Hurricane Irma incident period of September 4, 2017, to October 18, 2017; and 1224 WHEREAS, on June 21, 2019, pursuant to Chapter 2019.115, Laws of Florida (Line 3174), the Florida Legislature appropriated $4,959,699 to fund subgrants administered by the Florida Department of State, Division of Historical Resources for recovery, repair, and disaster mitigation activities directed at historic properties damaged during the Hurricane Irma incident period of September 4, 2017, to October 18, 2017; and WHEREAS, on April 15, 2020, the hfonroe County Board of County Commissioners approved a grant agreement (Grant No. 20.h.fh.100,006) with the State of Florida, Department of State, Division of Historical Resources in the amount of$482,550.00; and WHEREAS, on April 30, 2020, pursuant to Grant No. 20.h.fh.100.006, the Florida Department of State, Division of Historical Resources awarded Monroe County $482,550.00 for the repair of the Pigeon Key Commissary and Honeymoon Cottage damaged in Hurricane Irma, the construction of new foundations for those buildings, siting of those buildings back to their original locations, squaring of the buildings' walls, reconstruction of porches, stairs and floor framing with original and/or in---kind materials,restoration of exterior siding,interior historic wood sliding windows, metal shingle roofing and porch overhangs and the updating of the Pigeon Key Historic District National Register of Historic Places listing; and WHEREAS, in accordance with Subsection 11(d) of Grant No. 20.h.fh.100.000 and the requirements of Section 54 f.'.S.C. 302902 of the National Historic Preservation Act, Monroe County, as a subgrantee of funds awarded pursuant to Public Law 115-123, is required to execute a Preservation Covenant wherein Monroe County agrees to assume,after the completion of the project, the total cost of continued maintenance, repair and administration of the grant-assisted property in a manner satisfactory to the Secretary of the Interior by registering it with the deed of the property;and WHEREAS,pursuant to Subsection 11(d) of Grant No. 20.h.fh.100.006, a photocopy of the executed covenant/easement, stamped registered with the deed, must be submitted to the National Park Service; and WHEREAS, on July 28, 1922, the Preservation Covenant relative to the repair, relocation and renovation of the Pigeon Key Commissary and Honeymoon Cottage was executed by the Counts- Administrator as the Authorizing Official for Grantee pursuant to Resolution No. 267 2007 of the Monroe County Board of County Commissioners; and WHEREAS, said executed Preservation Covenant is attached to this Resolution as Attachment A. NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY AS FOLLOWS: Section 1: Recitals.
