ITEM BACKGROUND:
At the February 15, 2012, meeting of the Monroe County Board of County Commissioners' (`BOCC",
"Board", "Monroe County", or the "County") meeting, the BOCC approved Resolution No. 080-2012
(attached) establishing policies and procedures for the award of Boating Improvement ("BIF")
reimbursement funding to the municipalities situated within Monroe County. The procedures provide
for submittal of annual funding requests, a project scoring and selection process, and award of funding
through Inter-Local Agreements ("ILAs")based upon funding availability.
The professional staff of the Monroe County Planning and Environmental Resources Department's
Marine Resources Office has received two (2) funding request applications (attached) for FY'25,
including: The Village of Islamorada in the amount of$14,000 for regulatory buoy maintenance and the
City of Key Colony Beach in the amount of$2,993 for regulatory buoy replacement. The professional
staff of the Marine Resources Office has scored the funding requests, shown below. A detailed Score-
Sheet is also attached for reference.

The total funding requests for FY'25 of$16,993 is less than the FY'25 budget of$40,000 for municipal
grant funding. Therefore, the professional staff of the Marine Resources Office recommends 100%
funding of the Village of Islamorada request and 100% funding of the City of Key Colony Beach's
request as follows:

City of Key Colony Beach: $2,993.00
Total Recommended Funding: $16,993.00
Upon BOCC approval, the professional staff will prepare an ILA with each of the above-referenced
municipalities for the work to be performed in FY'25, and anticipates bringing said ILAs back to the
Board for BOCC approval at the Board's July 2024 public meeting.

RESOLUTION NO. 080 -2012
A RESOLUTION OF THE MONROE COUNTY BOARD OF
COUNTY COMMISSIONERS RESCINDING RESOLUTION NO.
371-2011 AND ESTABLISHING POLICY FOR THE
EXPENDITURE OF BOATING IMPROVEMENT FUNDS AND
PROCEDURES FOR THE AWARD OF BOATING
IMPROVEMENT FUNDS TO THE MUNICPALITIES WITHIN
MONROE COUNTY.
WHEREAS, moneys from vessel registration fees designated for the use of the
counties is distributed by the tax collector to the Board of County Commissioners,
pursuant to F.S. 328.72, hereafter referred to as State Boating Improvement Funds; and
WHEREAS, State Boating Improvement Funds are for the sole purposes of
providing recreational channel marking and other uniform waterway markers, public boat
ramps, lifts, and hoists, marine railways, and other public launching facilities, derelict
vessel removal, and removal of vessels and floating structures deemed a hazard to public
safety and health for failure to comply with F.S.327.53; and
WHEREAS, State Boating Improvement Fund revenues provide approximately
$250,000 annually; and
WHEREAS, the County approved Ordinance No.034-2002 to impose an annual
registration fee on vessels registered, operated, or stored in the water within its
jurisdiction pursuant to F.S.328.66, hereafter referred to as County Boating Improvement
Funds; and
WHEREAS, County Boating Improvement Funds shall be expended for the
patrol, regulation, and maintenance of the lakes, rivers, and waters and for other boating-
related activities of municipalities or counties; and
WHEREAS, County Boating Improvement Fund revenues provide
approximately$400,000 annually; and
WHEREAS, State and County Boating Improvement Funds are utilized by the
County for County channel marker and boat ramp maintenance, derelict vessel removals,
pumpout program costs, and other boating and waterway related projects Keys-wide; and
WHEREAS, the County may provide Boating Improvement Fund dollars to the
various municipalities for boating and waterway projects in accordance with the allowed
uses described in F.S.327.53 and F.S.328.66; and
WHEREAS, the County approved Resolution No.371-2011 which established
criteria for the general use of Boating Improvement Funds and procedures for the
reimbursement of Boating Improvement Funds to the municipalities; and

WHEREAS, the County desires to revise the policy established by Resolution
No.371-2011, refining the purpose of reimbursement funding to the municipalities from
Boating Improvement Funds, establishing funding request submission procedures, and
providing for a selection process for the award of reimbursement funding;
NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF MONROE COUNTY, FLORIDA THAT:
Section 1. Resolution No.371-2011 is hereby rescinded.
Section 2. The Monroe County Board of County Commissioners shall expend
State and County Boating Improvement Funds only for County boating and waterway
related projects, and municipal boating and waterway related projects in the form of
reimbursement funding, in accordance with the allowed uses of Boating Improvement
Funds as described in F.S. 328.72 and F.S. 328.66.
Section 3. The Monroe County Board of County Commissioners and
municipalities within Monroe County shall only perform boating and waterway related
projects that serve the general boating public.
Section 4. The Monroe County Board of County Commissioners may provide
reimbursement funding from Boating Improvement Funds to the various municipalities
for the purpose of providing for repair and maintenance of existing infrastructure, as well
as for capital improvement projects. The following procedures are established:
Funding Requests. Reimbursement funding requests shall be received by the
County no later than April 1 of the fiscal year for funding from the upcoming
fiscal year. Funding request forms will be available accompanied by
guidelines including the following criteria:
1- Projects for consideration must occur over public upland or public bay
bottom.
2- Funding shall not be provided for projects previously completed.
3- Requests for repair and maintenance funding for projects involving
revenue producing infrastructure (such as, but not limited to, mooring
fields or marinas or fee generating boat ramps) which should be
completely self-funding are discouraged. Requests for project funding for
revenue producing infrastructure shall include evidence and written
analysis by the applicant of unmet costs, such as a current annual financial
report, indicating total revenue, total expenses, and unmet availability of
funds for repairs and maintenance. Boater Improvement Funds should not
be used to simply supplant repair and maintenance funding.
4- Requests for new improvement funding for projects that may involve
future revenue producing infrastructure should include a fiscal analysis
and assurance from the municipality that the improvement will be self-
supportive and include operating and maintenance funding for future
needs.

5- Project Selection. Municipality funding request forms received shall be
reviewed by County Growth Management staff(Staff) after April 1 of the
fiscal year. Staff shall score each funding request and make selection
recommendations based on community need, project merit, and funding
availability. Staff recommendations may include awarding all of, or a
portion of the amount requested. Staff shall provide funding requests and
selection recommendations to the BOCC by June of each fiscal year. The
BOCC shall evaluate the staff s recommendations and provide Board
approval in ranking order, based on funding availability.
6- Funding Awards. After the Board approved projects are known, each
applicant shall enter into an Inter-local Agreement (ILA) with the County
indicating the municipality shall expend the funds and show evidence of
expenditures, prior to reimbursement.

II- PROJECT SUMMARY
Project Title:
Project description and purpose (explain the community need and project merit):
Village boundaries extend from mile marker 90.9 to mile marker 72.6 and include Plantation Key, Windley
Key, Upper Matecumbe Key and Lower Matecumbe Key. Known as the "Sportsfishing Capital of the World,"
the waters off Islamorada are heavily traveled boaters, personal watercraft, kayakers and paddle boarders.
In 2003, the Village Near Shore Water Regulation Citizens' Advisory Committee and the Monroe County
Department of Marine Resources partnered to protect residents, visitors and natural resources by instituting
300 foot no wake zones along the shoreline within the Village's offshore jurisdiction in the Atlantic Ocean and
the Gulf of Mexico. After much effort, assistance from the National Marine Sanctuary, and a lengthy permitting
process, the Florida Uniform Waterway Marker compliant system of 120 "No Wake Zone" buoys and a series
of fixed informational markers were installed in 2004 to mark the areas of shoreline where the idle speed
zones are in effect. The buoys aid in boater safety and facilitate preservation of the shoreline, nearshore
waters, flats and reefs.
In accordance with Florida law, the Village established a Buoy Maintenance Program (the "Program")to
maintain the system of buoys. Due to heavy boat traffic, environmental wear and tear, and occasional theft,
the Village experiences losses and damages to its buoy system. The Village contracts marine professionals to
regularly inspect and maintain the buoys.
The Village requests assistance funding the Program from the Monroe County Boating Improvement Funds
Grant Program for FY 24-25 in the amount of$14,000.00 (approximately 25% of the estimated Program
costs). Based on prior years' costs and projected cost increases based on the increase in the Consumer Price
Index, Islamorada's total Buoy Maintenance Program costs for FY 23-24 are estimated at$55,292.50. If
awarded, the Village's contribution is projected to be $41,292.50 (approximately 75%)of the Program costs to
be paid from its Marina Enterprise Fund. Program work includes 1) labor of certified divers to inspect buoys
and anchors, assembly and installation of new buoys and anchoring materials; 2) replacement buoys, anchor
assembly lines, property identification and numbering decals; and 3) printing educational materials.
This project remains both valuable and necessary. The buoy system continues to benefit residents, visitors,
and the coastal and marine environment. Without the properly maintained buoy system, boating on the waters
off the Village would be more dangerous and create conditions harmful to boaters, swimmers, the shoreline,
the coral reef and wildlife.

Description of how project may promote public water access:
The Buoy Maintenance Program promotes public water access by providing 120 highly visible buoys marked
with GPS identifiers that may assist boaters to determine their position, warn of dangers and obstruction in
navigation and alert boaters and operators of the Federal, State and Local Regulations. Buoys are safer than
fixed signs, reduce the severity of boater/sign collisions, and are less expensive to erect and maintain. The
buoy system may especially promote public water access for boaters planning to snorkel from their vessels as
well as kayakers, canoers, paddle boarders and open-water swimmers by improving the safety in the 300-foot
from shoreline area.
The project also promotes safe boating practices and protection of Islamorada's fragile sea life by exhibiting
on every buoy: "IDLE SPEED NO WAKE 300' FROM SHORE".
Status of project (is the project designed/permitted if applicable?)
The applicant will provide any pertinent documentation to assist with the review and evaluation of the funding request
such as site plans (verifying property ownership), design plans, permits, etc.
In 2008, pursuant to the Florida Administrative Code and Islamorada's Ordinance 03-10, the Village's
waterway marker plan was approved by the Florida Fish &Wildlife Conservation Commission's Office of
Boating Safety&Waterway Management. FWC Permit No. 04-018 (attached). The permit lists the marker
identification numbers, latitude/longitude and sign text for each of the 120 approved buoys in the system.
In November 2021, the Tri-Annual Inspection was completed and submitted to the FWC Division of Law
Enforcement Boating and Waterways Section to maintain the buoy permits. An update inspection report will
be completed prior to November 2024.The Village continues to distribute educational brochures and rack
cards to increase public safety awareness of local boating issues and regulations.

Replacement of seven damaged and/or faded "no wake idle speed" buoys. The city of Key Colony Beach
maintains a "no wake idle speed" perimeter which protects turtle nesting beaches from erosion and provides a
haven for paddle sports along a very busy channel.

Description of how project may promote public water access:
This project promotes public water access by providing ease of navigation while protecting resources that are
enjoyed by the boating public. A no wake, idle speed zone provides a safe use area for paddleboards and
kayaks along a very busy channel while protecting the shoreline from erosion.
