Waiving Approximately $90,446 in Building Permit Fees for a Total of Eight(8) Low Income(80% of
Median)Affordable Housing Units, or Below, to be Constructed on Parcels located at 31372 Avenue G,
31371 Avenue F, 31142 Avenue F, 31530 Avenue D, 31250 Avenue I, and 30936 Nathalie Street, all on
Big Pine Key, and 28269 Julia Avenue and 28249 Julia Avenue on Little Torch Key.
ITEM BACKGROUND:
Monroe County Code Section 6-108(e) allows BOCC approval of waivers of building permit fees for
affordable housing which has/have a Development Order in effect. The Applicant is requesting building
permit fee waivers totaling approximately $90,446 to construct eight(8) low income (80% of median),
or below, affordable three bedroom, two bathroom housing units at 31372 Avenue G, 31371 Avenue F,
31142 Avenue F, 31530 Avenue D, 31250 Avenue I, and 30936 Nathalie Street, all on Big Pine Key,
and 28269 Julia Avenue and 28249 Julia Avenue on Little Torch Key. Each of the eight (8) units has a
construction value of approximately $335,000.
PREVIOUS RELEVANT BOCC ACTION:
On November 18, 2009,the Monroe County Board of County Commissioners ("Board")passed and
adopted Ordinance 036-2009, allowing building permit fee waivers for entities building low-income
housing leveraging state or federal funds, or affordable housing as defined by state statutes; and
On February 10, 2010, the Board passed and adopted Ordinance 004-2010, allowing waivers for
housing for households up to 120% of median income in Monroe County. Housing exceeding 120%
may also apply for a waiver if the specific project for development is being subsidized with or is
leveraging state or federal funding.

27 WHEREAS, on April 25, 2024, Habitat for Humanity of Key West and Lower Florida
28 Keys, Inc., Agent/Lessee for the Owner/Lessor Monroe County Board of County Commissioners,
29 submitted the Application for Building Permit Fee Waiver. The legislative intent of this Resolution
30 is that the instant waiver shall apply to the building permit applicant of record; and
31 WHEREAS, Monroe County Code Section 6-108(e) allows the Board approval for
32 waivers of building permit fees for affordable housing which have a Development Order in effect.
33 The Applicant of Record is requesting building permit fee waivers totaling approximately$90,446
34 to construct eight (8) affordable low income (80% of median) three bedroom, two bathroom
35 housing units at 31372 Avenue G, 31371 Avenue F, 31142 Avenue F, 31530 Avenue D, 31250
36 Avenue 1, and 30936 Nathalie Street, all on Big Pine Key, and 28269 Julia Avenue and 28249
37 Julia Avenue on Little Torch Key.

39 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
40 COMMISSIONERS OF MONROE COUNTY, FLORIDA, THAT:
41 The foregoing recitals are true and correct and are hereby incorporated as if fully stated
42 herein; and
43 Building permit fees are waived pursuant to Monroe County Code Section 6-108(e) for
44 each of the eight (8) affordable housing units described herein with the condition that the units
45 meet the definition of affordable housing in the low income (80% of median) category, pursuant
46 to Section 101-1 of the Monroe County Land Development Code.
47 PASSED AND ADOPTED by the Board of County Commissioners of Monroe County,
48 Florida, at a regular meeting held on the 15th day of May, 2024.
