AGENDA ITEM WORDING: A Public Hearing to consider an amendment to Ordinance No. 007-
2023 Monroe County Parks and Beaches School Break Camp Program, to include all children and
youth between the ages of six (6) and seventeen(17)who reside in Monroe County; removing
conflicting provisions with respect to fees; and removing the medical form requirement, retroactive to
July 1, 2023.
ITEM BACKGROUND:
The current ordinance limits the County to offering the School Break Camps to children and youth who
are residents of unincorporated Monroe County between the ages of six (6) and seventeen(17). Staff
proposes an ordinance change amending the requirements to include all children and youth who are
residents of Monroe County between the ages six (6) and seventeen (17)who reside in Monroe County
and removing the medical form requirement, all changes retroactive from July 1, 2023.
The Clerk has opined that certain language in the current ordinance could prove problematic in the
funding of these camp programs. Therefore, staff is requesting to amend and clarify the ordinance to
state that fees will be used to help offset the costs associated with the program.
PREVIOUS RELEVANT BOCC ACTION:
11/08/23: MC BOCC approved Ordinance amending Summer Camp Ordinance to allow camps during all
Monroe County School District designated holidays and allow a daily fee option.
6/21/23: MC BOCC held a public hearing and approved the ordinance amending Chapter 18,Parks and Recreation,
of the Monroe County Code, to allow a broader age group to attend the camp programs.
5/17/23: MC BOCC held a public hearing and approved the ordinance amending Chapter 18,Parks and Recreation.
of the Monroe County Code, to create a Monroe County Summer Camp program; and allow fees to be charged for
summer camp recreational services.
4/19/23: MC BOCC granted approval to advertise a Public Hearing to consider adoption of an Ordinance regarding
Monroe County Parks and Beaches Summer Camp Program.

AN ORDINANCE OF THE BOARD OF COUNTY
COMMISSIONERS OF MONROE COUNTY, FLORIDA,
AMENDING SECTION 18-7 OF THE MONROE COUNTY
CODE TO AMEND THE PARTICIPANT REQUIREMENTS FOR
SCHOOL BREAK CAMP TO INCLUDE ALL CHILDREN AND
YOUTH BETWEEN THE AGES OF SIX (6) AND SEVENTEEN
(17) WHO RESIDE IN MONROE COUNTY; REMOVING
CONFLICTING PROVISIONS WITH RESPECT TO FEES;AND
REMOVING THE MEDICAL FORM REQUIREMENT
RETROACTIVE TO JULY 1, 2023; AND PROVIDING FOR
SEVERABILITY; PROVIDING FOR REPEAL OF ALL
ORDINANCES INCONSISTENT HEREWITH; PROVIDING
FOR INCORPORATION INTO THE MONROE COUNTY
CODE OF ORDINANCES; AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, under F.S. 125.01(1)(f), the Board of County Commissioners (BOCC) for
Monroe County is granted the authority, among others, to provide parks, playgrounds, and
recreation areas; and
WHEREAS, the BOCC finds that public parks and recreation areas provide sites where
the families and citizens of Monroe County can benefit from and engage in healthy recreational
activities; and
WHEREAS, BOCC finds that the creation of programming at the County's parks and
recreation are in the best interests of the citizens of Monroe County; and
WHEREAS, under F.S. 125.74(1)(g), the County Administrator has the authority to
supervise the care and custody of all County property; and
WHEREAS,the County recognizes the importance of providing safe and fun school break
activities for children and youth; and
WHEREAS,the County has identified a need for school break camp programing that offers
a variety of educational and recreational activities for children and youth in the community; and
WHEREAS,the County is committed to promoting healthy lifestyles and fostering positive
relationships among all children and youth in the community; and
WHEREAS, the County desires to expand its camp programming to include all children
and youth between the ages of six (6) and seventeen (17) who reside in Monroe County at a
reasonable cost; and

WHEREAS, the BOCC specifically intends for this ordinance to have retroactive
application to July 1, 2023, to the maximum extent permitted under law and in support of that
intent the Board specifically finds that this ordinance does not create new obligations, impose new
penalties, or impair vested rights; and
WHEREAS,the BOCC ratifies all acts taken by the County consistent with this ordinance
from July 1, 2023, until the date of enactment of this ordinance.
NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY
COMMISSIONERS OF MONROE COUNTY, FLORIDA, THAT THE MONROE
COUNTY CODE OF ORDINANCES IS HEREBY AMENDED AS FOLLOWS:

SECTION 1: The above recitals are true and correct and are incorporated herein as
findings of fact of the Board of County Commissioners of Monroe County.
SECTION 2: Section 18-7 of the Code of Ordinances is hereby amended as follows:
Sec. 18-7. —Monroe County Camp Program

(b)Establishment of School Break Camp. The County Administrator or his Designee shall
establish and operate a School Break Camp program for children and youth in the
community.
(1) The School Break Camp shall be open to children and youth between the ages
of six (6) and seventeen (17)who reside in within, the -to a-Feas of
Monroe County.
(d)Fees and expenses.
(1) The county shall establish fees for participation in the school break camp
program, which shall be reasonable and shall be used to help offset suer the
cost of materials, supplies, and staffing.
(2)Weekly camp fee will be $100.00 per child.
i. Each additional sibling shall be $50.00 per child per week.
ii. Daily camp fees will be $20.00 per child.

iii. Each additional sibling shall be $10.00 per day.
(3) School break camp weekly fees are offered at a 50 percent reduced rate for children
who qualify for reduced school meals within the Monroe County School District.
(4) School break camp weekly fees are offered at a 50 percent reduced rate for children of
Monroe County BOCC employees.
(5) The county shall establish a budget for the school break camp program, which shall
include the cost of materials, supplies, staffing and any other expenses necessary for
the operation of the program.
(f) Health and Safety.
(1) The County shall establish policies and procedures to ensure the health and
safety of participants in the Stimme School Break Camp program.
(2) (�)The County shall establish protocols for emergency situations, including but
not limited to first aid, severe weather, and evacuation.
SECTION 3: SEVERABILITY. If any portion of this ordinance is for any reason held
invalid or declared to be unconstitutional, inoperative or void, such holding shall not affect the
remaining portions of this ordinance. If this ordinance or any provision thereof shall be held to be
inapplicable to any person,property or circumstances, such holding shall not affect its applicability
to any other person, property or circumstances.
SECTION 4: CONFLICT WITH OTHER ORDINANCES.All ordinances or parts of
ordinances in conflict with this ordinance are hereby repealed to the extent of said conflict.
SECTION 5: INCLUSION IN CODE OF ORDINANCES. The provisions of this
ordinance shall be included and incorporated in the Code of Ordinances of the County of Monroe,
Florida, as an addition or amendment thereto, and shall be appropriately renumbered to conform
to the uniform numbering system of the Code.
SECTION 6: TRANSMITTALAND EFFECTIVE DATE.This Ordinance shall be filed
with the Department of State and shall be effective as provided in F.S. 125.66 but be effective
retroactively to July 1, 2023.
SECTION 7. PRIOR ACTS RATIFIED. The Board ratifies all acts taken by the County
consistent with this ordinance from the period July 1, 2023, until the date of enactment.
