41 WHEREAS, Section 125.38, Florida Statutes, provides that if the United States, or any
42 department or agency thereof, should desire any real property that may be owned by any County
43 of this state or by its board of county commissioners, for public or community interest and
44 welfare ("use"), then the United States, or any department or agency thereof, may apply to the
45 board of county commissioners ("board") for a conveyance of such property; and
46

I WHEREAS, Section 125.38, Florida Statutes, provides that such board, if satisfied that
2 such property is required for such use and is not needed for county purposes, may thereupon
3 convey the same to said applicant comprising the United States or any department or agency
4 thereof for such price, whether nominal or otherwise, as such board may fix; and
5
6 WHEREAS, Section 125.38, Florida Statutes, provides that the fact of such application
7 being made, the purpose for which such property is to be used, and the price or rent therefor shall
8 be set out in a resolution duly adopted by such board; and
9
10 WHEREAS, to that end, an application and follow-up request thereto considered a
11 constituent part of the composite whole of said application (hereinafter the "application")
12 was/were made by U.S. Government Naval Facilities Engineering Systems Command Southeast
13 ("U.S. Navy") requesting for the Monroe County Board of County Commissioners ("Monroe
14 County BOCC", "Monroe County", or the "County") to vacate and abandon and/or if appropriate
15 transfer by deed portions of Monroe County's interest in what may be described as an area of
16 right-of-way of Boca Chica Road lying within Section 32 and Section 33, Township 67 South,
17 Range 26 East and Section 5 and Section 6, Township 68 south, Rage 26 East (hereinafter
18 referred to as the "subject property" or the "property") further described in attached Exhibit 1.,
19 which is hereby incorporated by reference as if fully stated herein; and
20
21 WHEREAS, the Monroe County Property Appraiser's Office ("MCPA")property record
22 card for the subject property, currently bearing MCPA property identification number 00122791-
23 000000, is attached as Exhibit 2., which is hereby incorporated by reference as if fully stated
24 herein; and
25
26 WHEREAS, by virtue of the foregoing the U.S. Navy has requested and applied for a
27 conveyance of the subject described above from the Monroe County BOCC over to the United
28 States of America, by and through the United States Navy and Naval Air Station — Key West;
29 and
30
31 WHEREAS, the stated public or community interest and welfare basis for this
32 conveyance, as described by the instant application of the U.S. Navy, is, in pertinent part, as
33 follows:

35 "Description of right-of-way to be abandoned:
36
37 `Attached Exhibit A. delineates reasoning for SR 941 (4-A) Boca Chica Road right
38 of way abandonment to allow shoreline stabilization (attached Exhibit B). . . .
39 The Government intends to repair and stabilize the shoreline and is the adjacent land
40 owner on this road.'

42 Applicant Seeks the Abandonment for the following reasons:

44 `The public right of way described below is no longer required for public use and
45 convenience. The road is currently blocked for public motorized accessibility; the road
46 was heavily damaged during Hurricane Ian and previous storm events and cannot be

I safely used for vehicle traffic. The Navy intends to construct an Anti-Terrorism Force
2 Protection fence at the junction of Federal property for public safety purposes. See
3 attached exhibits A through D.'

17 WHEREAS, in view of the foregoing, and as required by Florida Statutes Section
18 125.38, the BOCC is satisfied that such property is required for such use and/or purpose and is
19 not needed for county purposes and that it desires to thereupon convey the same to the U.S. Navy
20 for the price of ten dollars ($10.00) subject to the (L) easement by grant, reservation by
21 easement, and/or encumbrance, and fq.) condition, covenant, limitation, restriction, and/or
22 encumbrance more particularly described in the quitclaim deed attached as Exhibit 3., which is
23 hereby adopted and incorporated by reference, approved by the Monroe County BOCC, and
24 approved for attested execution by the Mayor on behalf of the Board; and
25
26 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
27 COMMISSIONERS OF MONROE COUNTY, FLORIDA:

29 1. The foregoing recitals are true and correct and are hereby incorporated as if fully
30 stated herein.

32 2. The attached quitclaim deed, inclusive of all of its attached exhibits, is adopted and
33 approved by the Board and is hereby incorporated as if fully stated herein.

35 3. The "easement by grant, reservation in easement, and/or encumbrance" set forth on
36 Page 2 of the attached quitclaim deed is hereby incorporated as if fully stated herein
37 and constitutes a condition of this Resolution.

39 4. The "condition, covenant, limitation, restriction, and/or encumbrance" set forth on
40 Page 2 of the attached quitclaim deed is hereby incorporated as if fully stated herein
41 and constitutes a condition of this Resolution.

43 5. Monroe County, Florida, pursuant to Florida Statutes § 125.38, hereby approves
44 conveyance of the subject property by quitclaim deed over to the U.S. Navy for the
45 price of ten dollars ($10.00) subject to the LU easement by grant, reservation by

1 easement, and/or encumbrance, and (2) condition, covenant, limitation, restriction,
2 and/or encumbrance more particularly described in the attached quitclaim deed.

4 6. This conveyance shall become legally effective upon the attested execution of the
5 attached quitclaim deed by the Mayor and its subsequent recordation in the Official
6 Records of Monroe County, Florida.

9 Florida, at a regular meeting of the Board held on the 17th day of April, 2024.

County Commissioners, whose address is 1100 Simonton Street, Key West, Florida 33040, the first
party and grantor("Monroe County, Florida", "Monroe County",the "County", "Monroe County
BOCC", "BOCC", "Board", or"the first party"), and the United States of America, acting by and
through the United States Navy, whose address is U.S. Government Naval Facilities Engineering
Systems Command Southeast, Real Estate RE32, Box 30, Building(Bldg.) 903, Jacksonville, FL
32212, the second party and grantee("U.S.Navy" or the "second party"):
(Whenever used herein the term "grantor"and"grantee"include all of the parties to this instrument and the heirs,legal
representatives,and assigns of individuals,and the successors and assigns of corporations, trusts and trustees)
WITNESSETH:
WHEREAS,this conveyance is made pursuant to Florida Statutes § 125.38; and
WHEREAS, grantee U.S. Navy desires the following described land("subject property" or the
"property"), situate, lying and being in Monroe County,Florida, for public or community interest and
welfare ("use"); and
WHEREAS, the Monroe County Property Appraiser's Office property record card for the
subject property is attached as Exhibit"A.", which is hereby incorporated as if fully stated herein; and
WHEREAS,the Monroe County Geographic Information Systems("GIS")aerial approximately
delineating the subject property is attached as composite Exhibit"B.", which is hereby incorporated as
if fully stated herein; and
WHEREAS, grantor Monroe County BOCC is satisfied that the subject property is required for
such use and is not needed for county purposes; and
WHEREAS, the Resolution approving this conveyance pursuant to Florida Statutes § 125.38
was considered and approved by the Monroe County BOCC at the Board's regularly scheduled public
meeting held on April 17th, 2024;
NOW, THEREFORE, the foregoing recitals are hereby incorporated as if fully stated herein,
and for and in consideration of the sum of$10.00 and other valuable consideration receipt whereof is
hereby acknowledged, grantor Monroe County Board of County Commissioners:
1. Approves granting, selling, and conveying, by quitclaim deed, the property hereinafter described
over to the U.S. Navy subject to the following easement by grant, reservation in easement, and/or
encumbrance:
A. A portion of the conveyed property, right-of-way, and roadway thereon, is reserved and
dedicated to the Monroe County BOCC for the perpetual use and access of the public to the
beach, water, and land leading to water. This constitutes an easement in favor of the Monroe
County BOCC which permits public use and access to the beach, water, and land leading to
water for leisurely activities and may be open to the public to the extent that the Monroe County
BOCC authorizes, conditions, limits, regulates, prohibits, and/or restricts such use and access
of the public, from time to time.
The foregoing easement by grant, reservation in easement, and/or encumbrance shall be and does
in fact and law constitute a covenant running with the land in perpetuity.
The area of the foregoing easement by grant, reservation in easement, and/or encumbrance is as
delineated in attached Exhibit"C.", which is hereby incorporated as if fully stated herein.
2. Approves granting, selling, and conveying, by quitclaim deed, the property hereinafter described
over to the U.S. Navy subject to the following condition, covenant, limitation, restriction, and/or
encumbrance in favor of the Monroe County BOCC:
A. At the existing turnaround on the north side of the existing Jersey barriers on Boca Chica Road,
fire lanes shall be marked by the U.S. Navy with signs that are readily visible to the roadway
with the wording "NO PARKING FIRE LANE BY ORDER OF THE FIRE DEPARTMENT"
or similar wording. Such signs shall be 12 inches by 18 inches with a white background and red
letters and shall be a maximum of seven (7) feet in height from the roadway to the bottom part
of the sign. The signs shall be within sight of the traffic flow and be a maximum of sixty (60)
feet apart.
The U.S. Navy shall install, maintain in good condition, and keep installed and maintained in good
condition such signage approved by the Monroe County Fire Marshal or his or her authorized
designee, and shall replace such signage or provide for additional such signage whenever directed
to do so by the Monroe County Fire Marshal or his or her authorized designee.
The foregoing condition, covenant, limitation, restriction, and/or encumbrance shall be and does in
fact and law constitute a covenant running with the land in perpetuity.

County, Florida, which is being conveyed over to the U.S. Navy pursuant to Florida Statutes §

transferred to Monroe County, Florida by Quit Claim-Road Transfer Deed recorded in Official Records Book 1042, Page 55, Public Records of
Monroe County, Florida,said lands lie within Section 32 and Section 33,Township 67 South, Range 26 East and Section 5 and Section 6
Township 68 South, Range 26 East being located on Boca Chica Key and lying within the United States Naval Air Station at Key West, Florida.
The following description describes the centerline of a 66 foot wide Right of Way, being 33 feet on each side and extended or shortened along
