10 A RESOLUTION OF THE MONROE COUNTY BOARD OF COUNTY
11 COMMISSIONERS WAIVING APPROXIMATELY$90,446 IN BUILDING
12 PERMIT FEES FOR A TOTAL OF EIGHT (8) LOW INCOME (80% OF
13 MEDIAN) AFFORDABLE HOUSING UNITS, OR BELOW, TO BE
14 CONSTRUCTED ON PARCELS LOCATED AT 31372 AVENUE G, 31371
15 AVENUE F, 31142 AVENUE F, 31530 AVENUE D, 31250 AVENUE I, AND
16 30936 NATHALIE STREET, ALL ON BIG PINE KEY, AND 28269 JITLIA
17 AVENUE AND 28249 JITLIA AVENUE ON LITTLE TORCH KEY

19 WHEREAS,on November 18,2009,the Monroe County Board of County Commissioners
20 ("Board") passed and adopted Ordinance 036-2009, allowing building permit fee waivers for
21 entities building low-income housing leveraging state or federal funds, or affordable housing as
22 defined by state statutes; and
23 WHEREAS, on February 10, 2010, the Board passed and adopted Ordinance 004-2010,
24 allowing waivers for housing for households up to 120% of median income in Monroe County.
25 Housing exceeding 120% may also apply for a waiver if the specific project for development is
26 being subsidized with or is leveraging state or federal funding; and
27 WHEREAS, on April 25, 2024, Habitat for Humanity of Key West and Lower Florida
28 Keys, Inc., Agent/Lessee for the Owner/Lessor Monroe County Board of County Commissioners,
29 submitted the Application for Building Permit Fee Waiver. The legislative intent of this Resolution
30 is that the instant waiver shall apply to the building permit applicant of record; and
31 WHEREAS, Monroe County Code Section 6-108(e) allows the Board approval for
32 waivers of building permit fees for affordable housing which have a Development Order in effect.
33 The Applicant of Record is requesting building permit fee waivers totaling approximately $90,446
34 to construct eight (8) affordable low income (80% of median) three bedroom, two bathroom
35 housing units at 31372 Avenue G, 31371 Avenue F, 31142 Avenue F, 31530 Avenue D, 31250
36 Avenue I, and 30936 Nathalie Street, all on Big Pine Key, and 28269 Julia Avenue and 28249
37 Julia Avenue on Little Torch Key.

40 COMMISSIONERS OF MONROE COUNTY,FLORIDA, THAT: : '
41 The foregoing recitals are true and correct and are hereby incorporated as i:f:fully stated

: 43 : Building permit fees are waived pursuant to Monroe :County Code Section 6-.108(e) fora

44 each of.the eight (8) affordable housing units described herein with the condition that the units '
. 45 • meet the definition of affordable housing in the low income (80% of median) category, pursuant :
46. to Section 101-1 of the Monroe County Land Development Code.
