Approving a Time Extension of the Waiver of Approximately $157,704 in Building Permit Fees for a
Total of 20 Moderate Income Affordable Employee Housing Dwelling Units, or Below, to be
Constructed on a Parcel Located at 104-504 Polish Thunder Lane, on Big Coppitt Key.
ITEM BACKGROUND:
Monroe County Code Section 6-108(e) allows BOCC approval of waivers of building permit fees for
affordable housing which has/have a Development Order in effect. This request is for a time extension
of Resolution No. 490-2023 for building permit fee waivers to construct 20 affordable housing units,
each proposed with two bedrooms and two bathrooms, at 101-504 Polish Thunder Lane on Big Coppitt
Key. Fees previously waived are approximately $157,704. This amount is only for the housing units.
Each of the 20 units has a pro rata construction value, based on the multi-unit buildings and associated
site work, of approximately $305,000. The Agent for the Applicant has cited an additional twelve (12)
months is required in order to comply with all Federal and State environmental regulations, complete
and record the required deed restrictions, and comply with Monroe County building permit
requirements.
PREVIOUS RELEVANT BOCC ACTION:
On June 21, 2023, the Board approved Resolution 223-2023, extending the reservation of 20 affordable
employee housing dwelling units until July 24, 2024, for building permit issuance on the subject
property on Big Coppitt Key.
On October 18, 2023, the Board approved Resolution 490-2023, waiving approximately $157,704 in
building permit fees for the subject 20-unit affordable employee housing development.

17 WHEREAS,on November 18, 2009 the Monroe County Board of County Commissioners
18 ("Board") passed and adopted Ordinance 036-2009, allowing building permit fee waivers for
19 entities building low income housing leveraging state or federal funds, or affordable housing as
20 defined by state statutes; and
21 WHEREAS, on February 10, 2010, the Board passed and adopted Ordinance 004-2010,
22 allowing waivers for housing for households up to 120% of median income in Monroe County.
23 Housing exceeding 120% may also apply for a waiver if the specific project for development is
24 being subsidized with or is leveraging state or federal funding; and
25 WHEREAS, on June 21, 2023, the Board approved Resolution 223-2023, extending the
26 reservation of 20 affordable employee housing dwelling units until July 24, 2024, for building
27 permit issuance on the subject property on Big Coppitt Key; and
28 WHEREAS, on August 31, 2023, Smith Hawks, PL, Agent for the Applicant Dickerson
29 Coppitt Housing, LLC submitted the Application for Building Permit Fee Waiver. The legislative
30 intent of this Resolution is that the instant waiver shall apply to the building permit applicant of
31 record; and
32 WHEREAS, Monroe County Code Section 6-108(e) allows the Board approval for
33 waivers of building permit fees for affordable housing which have a Development Order in effect.
34 The Applicant of Record is requesting building permit fee waivers totaling approximately
35 $157,704 to construct 20 affordable two-bedroom, two-bathroom housing units at 101-504 Polish
36 Thunder Road on Big Coppitt Key through five, four-unit multi-family buildings comprised of 20
37 moderate income units.

39 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
40 COMMISSIONERS OF MONROE COUNTY,FLORIDA,THAT:
41 The foregoing recitals are true and correct and are hereby incorporated as if fully stated
42 herein; and
43 Building permit fees are waived pursuant to Monroe County Code Section 6-108(e) for
44 each of the 20 affordable housing units described herein with the condition that evidence of an
45 Affordable Housing Deed Restriction accepted and/or approved by both the Senior Director of
46 Planning & Environmental Services and the Office of the County Attorney and recorded in the
47 Public Records of Monroe County,Florida shall be provided to the Building Department and said
48 building permits are issued no later than July 24, 2024.

Dear Ed,
Please accept this correspondence, on behalf of Dickerson Group Inc ("Applicant"), as a
request for a twelve (12) month time extension for the building fee waiver for a total of twenty
(20) moderate income affordable employee housing dwelling units, to be constructed on a parcel
located at 101-504 Polish Thunder Road, on Big Coppitt Key, approved by Board of County
Commissioners Resolution #490-2023, attached hereto as Exhibit A.
The Applicant applied for the building permit fee waiver pursuant to Monroe County Code
Section 6-108(e),which section allows the Board of County Commissioners("BOCC")to approve
building permit fee waivers for affordable housing which have a development order in effect.
On October 18,2023,the BOCC approved the requested building fee waiver for each of the twenty
(20) affordable housing units, with said waiver expiring on July 24, 2024.
The Applicant is requesting a twelve (12) month time extension of Resolution #490-2023
in order to comply with all required Federal and State environmental requirements, and in order to
work with the County to complete and record the required affordable/employee housing deed
restriction for the twenty (20) affordable housing units, and Monroe County building permit
requirements. The Applicant has submitted its application package for the required Monroe County
building permit for the twenty (20) affordable housing dwelling units and is working with the
County on required revisions and completion of the required deed restriction.

In order to comply with all Federal and State environmental regulations, complete and
record the required deed restriction, and comply with Monroe County building permit
requirements,to develop the twenty(20) desperately needed employee housing dwelling units,the
applicant is requesting that the BOCC grant an additional twelve (12) month time extension to
BOCC Resolution #490-2023, thereby granting sufficient time for the Applicant and the County
to finalize the required deed restriction and record the same in the Monroe County Public Records,
and for the County to issue the required Monroe County Building Permits.
