ITEM BACKGROUND: Section 102.141(1), Florida Statutes designate the chair(i.e., Mayor) of the county commission as that BOCC's member on that county's canvassing boards unless the chair "is a candidate who has opposition in the election being canvassed, or is an active participant in the campaign or candidacy of any candidate who has opposition in the election being canvassed." The statute further provides that: "If the chair of the board of county commissioners is unable to serve or is disqualified, the board of county commissioners must appoint as a substitute member one of its members who is not a candidate with opposition in the election being canvassed and who is not an active participant in the campaign or candidacy of any candidate with opposition in the election being canvassed." (Emphasis added). Note, a substitute is a permanent replacement for the Mayor during the specific election being canvassed due to the Mayor's name appearing on the ballot or being an active participant in another candidate's campaign whereas an alternate member is a county commissioner who is appointed by the Mayor to fill in for the Mayor when the Mayor or another canvassing board member has a scheduling conflict for any of the canvassing board meetings for that particular election. Under F.S. 102.141, the BOCC appoints a substitute whereas the Mayor appoints an alternate. After the qualifying period ended on June 14, 2024, Mayor Merrill Raschein is a "candidate who has opposition in the [August primary] election being canvassed" so the Board needs to appoint one of its members as a substitute for that election. Whichever commissioner is selected as the substitute cannot be a candidate or an active participant in an election to be canvassed. If no commissioner is able to serve as a substitute member of the canvassing board, the Chief Judge is authorized to appoint a qualified elector as a substitute to fill the BOCC's seat on the Canvassing Board. Mayor Merrill Raschein appointed Commissioner Scholl to serve as her alternate for the March 2024 Presidential Preference Primary. If the Board designates Commissioner Scholl as the substitute for Mayor Merrill Raschein, then the Mayor must designate another alternate or ask the Chief Judge to designate an 4674 alternate. PREVIOUS RELEVANT BOCC ACTION: In November of 2023, the Board elected Commissioner Merrill Raschein which, by law, designated her as a member of the Canvassing Board.
