23 WHEREAS, the Monroe County Board of County Commissioners ("BOCC", "Board",
24 "Monroe County", or the "County") recognizes that light pollution of beaches is a serious threat to
25 sea turtles and other species inhabiting its beaches; and
26
27 WHEREAS,the Monroe County BOCC recognizes that nesting adult and hatchling sea turtles
28 are negatively affected by light pollution created by artificial light visible from any portion of the
29 beach; and
30
31 WHEREAS, the Monroe County BOCC recognizes that sea turtles are protected by federal,
32 state, and local law; and
33
34 WHEREAS, the Monroe County BOCC recognizes that the overall economy of the
35 unincorporated Florida Keys and the quality of life enjoyed by Florida Keys residents depends on the
36 protection of the natural and environmental resources of the Florida Keys; and
37
38 WHEREAS, the quality of life and economy of Florida Keys residents are enriched by a
39 healthy sea turtle population; and
40
41 WHEREAS,the Monroe County BOCC desires to minimize the detrimental effect on nesting
42 sea turtle populations, and other listed sensitive wildlife, by amending the standards in Article V.,
43 Chapter 12, Monroe County Code of Ordinances, to reduce the amount of artificial light intentionally
44 or unintentionally visible from beaches; and
45
46 WHEREAS, at a regularly scheduled meeting on the 17th day of July, 2024, the BOCC held
47 a duly noticed public hearing, considered the Department's accompanying professional staff report

23 Sec. 12-114. Definitions.
24 The following words, terms and phrases, when used in this article, shall have the meanings
25 ascribed to them in this section, except where the subject matter or context of such word, term, or
26 phrase is plainly repugnant thereto. Where any provision, definition, word, term, or phrase in this
27 article imposes a differing restriction(s) or a greater restriction(s)upon a subject or subject matter
28 than another provision, definition, word, term, or phrase, the provision, definition, word, term, or
29 phrase imposing the greater restriction(s) shall be deemed to be control lin .eee*t�
31 Adjacent waters means waters abutting a nesting area and extending 300 feet to either side of
32 it, and out to either 300 yards offshore or the limits of the property line, whichever is further.
33 Artificial light or artificial lighting means the light emanating from any manmade or man-
34 controlled device.
35 Beach means the zone of unconsolidated material that extends landward from the mean
36 low-water line to the place where there is a marked change in material or physiographic form,
37 or to the line of permanent vegetation, usually the effective limit of storm waves.
38 Beach berm means a bare, sandy shoreline with a mound or ridge of unconsolidated sand that
39 is immediately landward of, and usually parallel to, the shoreline and beach. The sand is calcareous
40 material that is the remains of marine organisms such as corals, algae and molluscs. The berm may

2 Nesting season means the period from April 15 through October 31 of each year.
3 Permitted agent of the state means any qualified individual, group or organization possessing
4 a permit from the Department of Environmental Protection or by the Florida Fish and Wildlife
5 Conservation Commission to conduct activities related to sea turtle protection and conservation.
6 Sea turtle means any specimen belonging to the species Caretta caretta (loggerhead turtle),
7 Chelonia mydas (green turtle), Dermochelys coriacea (leatherback turtle), Eretmochelys
8 imbricata (hawksbill turtle) or any other marine turtle using the county beaches as a nesting
9 habitat.

13 Tinted glass means any glass that:
14 (1) Has been treated to achieve an industry-approved, inside-to-outside light
15 transmittance value of 45 percent or less (such transmittance is measured as the
16 percentage of visible light that is transmitted through the glass);
17 (2) Has a minimum five-year warranty for the level of light transmittance specified in
18 subsection (1) of this definition; and
19 (3) Has performance claims that are supported by approved testing procedures and
20 documentation.
21 Wildlife lighting means artificial lighting fixtures and bulbs that minimizes the potential for
22 negative effects to the nocturnal behaviors of nesting and hatchling sea turtles and other wildlife.
23 The following criteria apply,;
24 U The light source is mounted as low to the gjqqRd or floor as plqgticable through the use
25 of fixtures such as, low-mounted wall fixtures, low bollards, and ground-level fixtures;

36 Sec. 12-115. Prohibition of activities disruptive to sea turtles.
37 (a) Prohibition of horseback riding, campfires, and vehicular traffic. Horseback riding and
38 campfires shall be prohibited on nesting areas during the nesting season. Vehicular traffic
39 shall also be prohibited on nesting areas during the nesting season except for emergency and
40 law enforcement vehicles, vehicles permitted on the beach for marine turtle conservation or
41 research, or vehicles used for beach cleaning in compliance with section 12-118.
42 (b) Prohibiting storage or placement of any material in the nesting area. The storage or

I placement of any material such as, but not limited to, construction material, rip-rap, trash
2 and debris, mulch or other organic material, landscaping material, fill, vehicles, or boats,
3 that has potential to impede movement of hatchlings or adults between ocean and nesting
4 areas, or that may cover existing nests or nesting sites is strictly prohibited.
5 (c) Development. All development shall be set back a minimum of 50 feet from any area that
6 serves as an active or potential nesting area for marine turtles. The 50-foot setback will be
7 measured from the landward toe of the most landward beach berm or from 50 feet landward
8 of mean high water (MHW), whichever results in the smaller total setback. The maximum
9 total setback shall be 100 feet from MHW.

19 (3) Upon written notification by the code compliance director, the mayor may impose an
20 annual "lights out" order to residents and property owners for lights in areas of
21 unincorporated Monroe County during the Sea Turtle nesting season from April 15th
22 through October 31 st. The "lights out" order shall indicate the importance of sea turtle
23 nesting and shall direct residents and property owners to tum their lights out between
24 the hours of dusk until dawn. Further,the mayor may request utility companies to shield
25 or tum off lights in designated areas for the same purpose.
26 Sec. 12-117. Standards for interior artificial lighting.
27 To prevent interior artificial lighting from illuminating the jurisdictional boundaries or adjacent
28 waters during the nesting season, measures such as, but not limited to, the following shall be taken
29 to reduce or eliminate the negative effects of new or existing interior light emanating from doors and
30 windows:
31 (1) Interior artificial lighting within direct line-of-sight of the befteh nesting area

33 source of light or any reflective surface of the light fixture is not directly,
34 indirectiv. or cumulatively visible from the nesting areas;
35
36 ;
38 (2) Measures such as,but not limited to,the following shall be taken to reduce or eliminate
39 the negative effects of new or existing interior beachfront lighting through appropriate
40 design:
41 a. Use of window treatments such as blackout draperies, shade-screens or blinds to
42 shield interior lights from theme nesting area;

I b. Installation of new windows that meet the standards for tinted glass or, for existing
2 windows, an application of window tint or film that meets the standards for tinted
3 glass;
4 c. Turning off all unnecessary interior lights;
5 d. Arrangement of lamps and other moveable light fixtures away from windows;
6 e. Appropriate interior design to eliminate overhead lighting that could be directly,.
7 m Irectiv, or cumulatively visible from the nesting area 8 beach; and
9 f. For new construction within line of sight of the beiw4nestmg area, tinted glass
10 shall be installed on all windows and glass doors of single or multistory structures.
11 Sec. 12-118. Standards for mechanical beach cleaning.
12 All mechanical beach cleaning activities designed to remove debris from the beach or
13 redistribute debris on the beach through the use of motorized vehicles or other mechanical means
14 shall comply with the following standards:
15 (1) Timing. Beach cleaning shall be confined to daylight hours during the nesting season.
16 (2) Mode ofoperations. During the nesting season (April 15 through October 31):
17 a. Beach cleaning operations shall be limited to the area seaward of the strand line
18 (previous high tide mark).
19 b. Light-weight motorized vehicles having wide, low-profile, low-pressure tires, or
20 hand raking shall be used to conduct beach cleaning operations.
21 c. Devices used for removing debris from the beach shall be designed and/or
22 operated such that they do not penetrate beach substrate by more than two inches.
23
24 d. Operators shall be educated to identify a sea turtle crawl(turtle tracks),recognize
25 and avoid a sea turtle nest, report nests and/or crawls to a permitted agent of the
26 state.
27 e. All excess raked material must be removed from the beach and disposed of properly
28 or stored in an upland area as approved by the director of environmental resources.
29 With special approval from the director of environmental resources and the state
30 department of environmental protection, limited quantities of organic material may
31 be incorporated into the substrate in order to enhance the beach/berm system.
32 (3) Coordination of beach cleaning operations with state-sanctioned scientific studies. All
33 beach cleaning operations shall be coordinated through the state to ensure that these
34 operations do not interfere with state-sanctioned scientific studies or surveys of sea turtle
35 nesting activities.
36 (4) Authorization. Any person performing mechanical beach cleaning must have a current
37 permit from the Florida Department of Environmental Protection for the area being
38 cleaned.
39 Sec. 12-119. Protection from predation.
40 (a) No predatory pets or pets likely to have a potential for being disruptive or damaging to
41 nesting turtles,hatchlings,or nests shall be allowed to roam loose and unsupervised within

I the jurisdictional boundaries during the nesting season. Such pets include, but are not
2 limited to, dogs, cats, snakes, lizards or iguanas, ferrets and pigs.
3 (b) Feeding of raccoons, opossums and other wild animals within the jurisdictional
4 boundaries is prohibited.

6 Sec. 12-120. Penalty.
7 (a) Violations of this article may be prosecuted in the same manner as misdemeanors are
8 prosecuted. In such cases,the violations shall be prosecuted in the name of the state in a court
9 having jurisdiction over misdemeanors by the prosecuting attorney thereof and upon
10 conviction shall be punished by a fine not to exceed$500.00 or by imprisonment in the county
11 jail not to exceed 60 days, or both such fine and imprisonment. Violations may also be
12 prosecuted through proceedings before the county code enforcement special magistrate or
13 through any other lawfully available means including civil and injunctive relief.
14 (b) The property owner and,where applicable,his designee, agent,tenant, lessee, or assignee,
15 shall each be held responsible for adherence to the provisions of this article.

20 Section 4. Interpretation. The interpretation of this Ordinance and all provisions of the Monroe
21 County Comprehensive Plan, Florida Building Code, Florida Statutes, floodplain
22 management requirements, and Monroe County Codes whose interpretation arises out
23 of, relates to, or is interpreted in connection with this Ordinance shall be liberally
24 construed and enforced in favor of the Monroe County BOCC, and shall be deferred
25 in favor of the Monroe County BOCC, and such interpretation shall be entitled to great
26 weight in adversarial administrative proceedings, at trial, bankruptcy, and on appeal.
27
28 Section 5. No Liability. Monroe County expressly reserves and in no way shall be deemed to
29 have waived, for itself or for its officer(s), employee(s), or agent(s), any sovereign,
30 governmental, and any other similar defense, immunity, exemption, or protection
31 against any suit, cause-of-action, demand, or liability.
32
33 Section 6. Severability. If any provision of this Ordinance, or any part or portion thereof is held
34 to be invalid or unenforceable by any administrative hearing officer or court of
35 competent jurisdiction,the invalidity or unenforceability of such provision, or any part
36 or portion thereof, shall neither limit nor impair the operation, enforceability, or
37 validity of any other provision of this Ordinance, or any remaining part(s)or portion(s)
38 thereof. All other provisions of this Ordinance, and remaining part(s) or portion(s)
39 thereof, shall continue unimpaired in full force and effect.
40
41 Section 7. Repeal of Inconsistent Provisions. All ordinances in conflict with this Ordinance are
42 hereby repealed to the extent of said conflict. The repeal of an ordinance herein shall
43 not repeal the repealing clause of such ordinance or revive any ordinance which has
44 been repealed thereby.
45
46 Section 8. Inclusion in the Code of Ordinances. The provisions of this ordinance shall be
47 included and incorporated in the Code of Ordinances of the County of Monroe,Florida,

to provide Lighting Standards consistent and in alignment with guidelines outlined in Chapter
6213-55, Florida Administrative Code, to enhance marine turtle protection;providing for
severability; providing for the repeal of all Ordinances inconsistent herewith; providing for
incorporation into the Monroe County Code of Ordinances; and providing an effective date.
