AGENDA ITEM WORDING: Authorization to initiate litigation against SGC Land Trust 2/12/2020
and affiliated officers, fiduciaries, agents, and other responsible parties, regarding violations of the
Monroe County Code of Ordinances and Land Development Code that have occurred and continue to
occur at the property located at 93990 Overseas Highway in Tavernier.
ITEM BACKGROUND:
The property has been the site of illegal land clearing and illegal construction, as well as violations of
Chapter 4 of the Monroe County Code, regarding animals. The property is owned by SGC Land Trust
2/12/2020, is located at 93990 Overseas Highway, Tavernier and currently has property identification
number 00480880-000000. The Monroe County Property Appraiser classifies the property as "Vacant
- Residential".
The Monroe County Planning and Environmental Resources Department("Planning Department") on
December 4, 2023, hand-delivered to the property owner the attached memorandized determinations of
the Planning Department asserting in writing that the property owner was in violation of Monroe
County Code Section 6-100(a), Monroe County Code Section 118-11, Monroe County Code Sections 6-
110(a)(4)(a)-(b), Monroe County Code Section 6-110(c)(1), and Monroe County Code Section 6-
110(d). These administrative determinations were never appealed and are therefore final pursuant to
Monroe County Land Development Code Section 102-185(c).
In addition, on December 4, 2023, the Monroe County Code Compliance Department posted at the
property the attached stop work order and red tag mandating the cessation of the Code violations the
Planning Department's memorandized determinations asserted the owner had violated.
The property owner failed to cease and abate the violations determined to have occurred in writing
pursuant to the Planning Department's memorandized determinations, has effectively ignored the Code
Compliance Department's stop work order and red tag, remains in violation of the Monroe County Code
provisions the Planning Department determined the owner had violated, and is now violating additional
laws governing development and the keeping of wild animals and livestock afoul of Monroe County

Code Chapter 4.
The County has the option of:
1. issuing a notice of violation and seeking relief before the Code Compliance Special Magistrate;
and/or
2. filing a civil enforcement action seeking injunctive relief, costs, fees, and/or monetary penalties
in Circuit Court to ensure compliance with the Comprehensive Plan, Code(s), and/or
requirements of state law as applicable.
County staff recommends that the BOCC authorize the initiation of civil litigation (Option 2) against the
above-referenced property owner and other responsible parties for injunctive relief and damages
(including but limited to the costs of prosecution).

INTRODUCTION: A complaint was received today asserting that illegal development' (including but
not limited to illegal landclearing3 and/or construction`) is occurring on the subject property and was
occurring today(December ls`)the above-referenced property(the"subject property"or the"property"),
and Code Compliance Department Case No. CE23120001 was created. The Environmental Resources
Office was requested to perform site inspection(s) to determine if the subject property was in violation
of the Monroe County Code ("MCC").
Per the official record(s)of the Monroe County Property Appraiser's Office.
- "`Development' means the making of any material change in the appearance of any land including but not limited to
landclearing and/or the clearing of land as an adjunct of construction, the making of any material change in the use of any
land,construction. . . . [T]he following shall be taken to involve `development': (a.) Landclearing. (b.)The clearing of land
as an adjunct of construction. (c.)Construction. . . . (e.) A change in the intensity of use of land, such as an increase in the
number of dwelling units in a structure or on land or a material increase in the number of businesses, manufacturing
establishments, offices or dwelling units in a structure or on land. . . . (g.) Commencement of drilling(except to obtain soil
samples),mining or excavation on a parcel of land. ...(i.)Deposit of refuse,solid or liquid waste,or fill on a parcel of land."
j"`Landclearing'means the clearing or removal of vegetation and including significant disturbance of vegetation or substrate
(soil)manipulation. Landclearing is not a land use and constitutes development as the making of any material change in the

DETERMINATIONS: I, Monroe County Senior Biologist Eva Korous, personally completed a site
inspection of the property today, December 1 st, 2023, and personally reviewed the attached thirty-six
(36)photographs and one(1)video taken,which I confirm plainly shows illegal development occurring
on the subject property. I,Monroe County Principal Biologist Tim Douma,personally reviewed the thirty
(36) photos and one (1) video taken by Monroe County Senior Biologist Korous, and concur in the
detennination that illegal development, including but not limited to illegal landclearing of native
vegetation / native vegetation removal and illegal construction (construction of fencing) was occurring
without the benefit of permitting approval(s) / an approved issued permit. At this stage, this illegal
development constitutes a violation of, including but not limited to, the following non-exhaustive list of
materially relevant laws:

( X ) Fees and Permitting Requirements for Work Done Without a Permit, Monroe County Code
§§ 6-110(a)(4)(a)-(b). After-the fact permits and fees. Any person who commences to clear lands that
require a permit under this chapter or under part II of this Code before obtaining the Building Official's
approval or necessary permits shall: (a.) Pay $500.00 for clearing of 100 square feet or less of land, or
pay $1,000 for clearing of more than 100 square feet of land; and (b.) Comply with the requirements of
Section 118-11.
(X ) Fees and Permitting Requirements for Work Done Without a Permit, Monroe County Code §
6-110(c)(1). Unpermitted placement of fill and land clearing; after-the-fact permit. If land has been
cleared in excess of what may be permitted, no building permit shall be issued for after-the-fact
construction work under this section until the requirements of Section 118-11 and subsection (a)(4) of
this section have been met.

6-110(d). Work that is unpermittable. In the event the construction work, land clearing, or placement of
fill is unpermittable under the Florida Building Code or part II of this Code, the site shall be restored to

FOLLOW-ON A(7110N: A Stop-Work Order shall be issued. This property's violations will at
minimum require restoration and/or additional remediation in compliance and conformity with the
Monroe County Code(s) and/or Monroe County Comprehensive Plan and/or Florida Building Code(s)
