ITEM BACKGROUND:
CE20110034: This property has been the subject of a code compliance case for 1)building permits
required—permits, approvals and all final inspections are required for the installation of large concrete
slabs covering throughout property (compliant) and 2)rights of way permits/county—permit(s),
approval(s) and final inspection(s) are required from Monroe County Engineering Dept. for the paving
of county right of way(compliant). The fines total $63,500.00 as of August 7, 2024, and will not
continue as compliance has been achieved.
A hearing was scheduled for April 29, 2021, and the property owners signed a Stipulation to code
violations and for time to comply for first time offenses on April 26, 2021. On April 29, 2021, the
Special Magistrate approved the stipulated agreement with a compliance date of July 30, 2021. The
County's lien was recorded on August 17, 2021. A subsequent hearing was held on March 31, 2022,
and the property owner was present. The Special Magistrate found the property remained in violation
and granted the County's motion to proceed with collections. On August 8, 2022, the property owner
requested a fine reduction and after review, the county relayed an offer of$61,928.37 (fines and costs).
The property owner refused the offer and scheduled a mitigation hearing, which took place on October
27, 2022. The Special Magistrate issued an Order Imposing Fine, agreeing with the County's
assessment of the reduced fine amount, on November 8th, 2022. The property owner then filed an
appeal of the Order Imposing Fine and on April 29, 2024, the Circuit Judge handling the appeal entered
an Appeal Mandate affirming the Special Magistrate's Order. The code case remains open for failure to
pay outstanding fines and costs.
The Monroe County Property Appraiser lists the Just Market Value of the property as $2,547,906. The
property is homesteaded and there are no pending foreclosure actions at this time. There is a mortgage
recorded on the property in the amount of$1.5 million, which predates the County's lien.
Under the policy adopted in Resolution 057-2014 the available legal options in regard to the County's
lien on this property are:
1. Initiate litigation against the property owner for money judgment;
2. Allow the liens to remain against the property owner, the subject property and any other property
owned by the property owner; and/or,
3. Release the lien.
County staff recommends (option 1) initiating litigation against the property owner for money
judgment.
PREVIOUS RELEVANT BOCC ACTION:

to be used after a Final Order has been rendered by the Code Compliance Special Magistrate to initiate

WHEREAS, Section 162.09(1), Florida Statutes and Monroe County Code Section 8-31(a)
give the Special. Magistrate appointed to hear Code Compliance cases the authority to impose i
fines and costs including the cost of repairs if the County is forced to make repairs, after a
finding that the property owner has violated the Monroe County Code(s); and
WHEREAS pursuant 20(3), Florida. Statutes and Monroe County Code 8- t
( ) feed of an Order imposing py a tine or a tine plus repair costs may be recorded
in the public records and thereafter constitute a lien against the land on which the violation
exists and upon any other real or personal property owned by the violator; and

WHEREAS, a certified copy of the Order imposing the fines and costs becomes a lien on all
real and personal property owned by the violator once recorded with the County Clerk; and
WHEREAS, the County has the authority to initiate litigation to enforce its codes and recorded
liens;
and
WHEREAS, the initiation of litigation may be the only incentive for some property owners to
gain compliance; and
WHEREAS, the Board of County Commissioners finds it in the public's interest to have a
formalized written procedure to be used after a Final Order has been rendered by the Code
Compliance Special Magistrate to initiate injunctive relief on non-compliant properties, j
foreclosure and/or money ,judgment actions for collection of unpaid fines and/or costs from a
property owner;

CODE COMPLIANCE SPECIAL MAGISTRATE TO INITIATE INJUNCTIVE RELIEF FOR
NON-COMPLIANT PROPERTIES, FORECLOSURE AND/OR MONEY JUDGMENT l
ACTIONS FOR COLLECTION OF UNPAID FINES AND/OR COSTS FROM A PROPERTY
OWNER

1. Special Magistrate (SM) enters a Final. Order imposing a compliance date, fines and/or casts
after a finding of violation of Monroe County Code(s) by property owner(violator) or
r
approving a Stipulated Agreement with an agreed upon compliance date and fine amounts. The
Final Order of SM providing the compliance date, and imposing fines and/or costs is provided
to the property owner as soon as practicable. Referrals, if not made previously, are made to
other agencies in appropriate circumstances. 1
2. The final Order of the SM is recorded by Code Compliance (CC) as a lien by Code
Compliance within 14 days after the compliance date for those cases that have not achieved ,
compliance.
3. The Final Order of the SM is recorded as a lien by CC within 45 days after the compliance date
for those cases that have achieved compliance by the compliance date but have outstanding t
costs in excess of$200. 1

4. If compliance is not achieved within 75 days of the recording of the lien, then a re-inspection of
the property is completed by the Code Inspector assigned to the case. If the property is still not
in compliance then a demand letter including the current amount of fines and/or costs is sent to
the property owner,
5. If compliance is not achieved within 90 days of'the recording of the lien and/or the lien is not
satisfied, then. CC will research the subject property to determine:
i. if the subject property is homesteaded;
ii. if the subject property is the only property owned by property owner/violator;
iii. what efforts, if"any, the property owner has made to achieve compliance;
iv. the amount of the lien accrued to date; and
v. any other relevant factors, including but not limited to researching the status of the
property owner, i.e. any Lis Pendens filed against the property or property owner, any
pending or closed foreclosure actions, any open, pending or discharged Bankruptcy
petitions.
6. CC staff shall provide a written memo or email to the County Attorney's Office (CAY)with

the results of the research outlined and requested further action,
7. The CAY will review the information provided by CC staff.
8. The CAY will move the SM per F.S. 162.09 for an Order authorizing foreclosure or a money
judgment action; and,

i. The Code Compliance Liaison (Liaison) will schedule the motion for the next
available SM hearing for a Motion for approval to proceed with a foreclosure and/or
money judgment action;
ii. The Liaison will mail a Notice of Hearing and Notice of Motion prepared by the
Liaison and signed by the CAY to the property owner by certified mail noticing the
owner of the date, time, place and the substance (collection action, foreclosure
and/or money judgment and/or writ of attachment) of the motion;
iii. The Liaison will email/calendar a re-inspection request to the assigned Inspector to
conduct inspection prior to the next available SM hearing;
iv. The Motion hearing is heard by SM on the specified date;
v. If SM finds foreclosure or money judgment is appropriate, the Liaison will notice
the property owner of the SM's ruling and email/calendar a re-inspection request to
the assigned Inspector to conduct an inspection within 30 days of the SM ruling;
vi. CAY will seek permission from the Board of County Commissioners to file for
foreclosure or money judgment in court;
vii. The assigned Code Inspector will continue to monitor the property for compliance
through re-inspections every 90 days and attempts to notify the owner by a quick
email letter, telephone call or demand letter every 90 days to inform them that the
property is not in compliance and fines are running. The assigned Code Inspector
will. provide written updates to the CAY every 90 days.
9. Subsequent to the SM's ruling on the Motion, the CAY will place an item on the Commission's
agenda seeking the Board's direction and authorization on further enforcement and collection
efforts. Potential options for litigation include seeking injunctive relief, a money judgment for
the unpaid fines, foreclosure, or other relief. Potential non-litigation options include referral to
another agency, allowing liens to accrue, or other relief.
10. If the recommended legal action is referral to another agency, release of lien, or allowing liens
to accrue, CAY will send a written memo or email to the Director of Code Compliance
outlining recommendation.
11. Once authority is granted by SM and/or Board of County Commissioners, CC will order a title
search on non-homesteaded properties, and the assigned Code Inspector will conduct a re-
inspection after receipt of the title search. Litigation will commence after the title search is
completed and a current re-inspection is completed. The assigned Code Inspector will continue
to monitor the property for compliance through re-inspections every 90 days and attempts to
contact the property owner by a quick email letter, telephone call or demand letter every 90
days that the property is not in compliance and fines are running. The assigned Inspector will
provide written updates to the CAY every 90 days.
12. If the Board decides not to authorize injunction or enforcement litigation, a decision from the
Board could include direction to:
i. Allow lien to remain filed and accrue interest until sale or refinancing; or
ii. Release the lien; or
iii. Request CC staff to provide a progress report on compliance efforts annually at
the March BOCC meeting.
Exception—If a violation poses a serious threat to the public health, safety & welfare then immediate
permission to file an action for an inspection warrant, injunction and/or demolition may be sought with
BOCC direction.

ORDER IMPOSING FINE
This case came before the Special Magistrate on October 27, 2022, upon the written
request of Respondents for a hearing on the fine to be imposed for Code violations previously
found to exist on Respondents' property,which is located at 373 Bahia Avenue,Key Largo,
Florida 33037 (the "Property"). Respondents have had notice of all proceedings relating to,and
been afforded an opportunity to be heard concerning, all factual determinations necessary to
impose a fine or create a lien.
Respondents' request for a reduction of the fine arises from a Final Order entered on
April 30, 2021,which found violations of sections 110-140.(a) and 19-33 of the Monroe County
Code("MCC")based upon a Stipulation to Code Violation and for Time to Comply for First
Time Offenses ("Stipulation"),wherein Respondents admitted that certain improvements had
been made to the Property without a permit,namely the installation of concrete slabs; and that
they had paved within the right-of-way. Pursuant to the Stipulation,whose terms were adopted
in the Final Order, Respondents were required to obtain an after-the-fact building permit for the
concrete slabs and a demolition permit to clear the right-of-way, and to have these permits
successfully closed by July 30, 2021. If compliance were not timely achieved, a daily fine of
$100.00 per count would start running, and would accrue until the date of compliance.
Thereafter,the two required permits were closed, respectively, on May 27, 2022 (demo
permit),and July 1,2022 (ATF permit). The Property was deemed in compliance as to section

19-33 on the earlier date, 300 days after the deadline; and, as to section 110-140.(a), on the later
date, or 335 days late. The cumulative daily fines for the two counts totaled$63,500.00. With
the addition of taxable costs totaling$1,029.17,the current amount of the County's lien is
$64,529.17. The County offered a modest reduction of the fine,to $61,000.00
In support of their request,Respondents argue that the violations were caused by the prior
owner;that the County took"months"to issue the permits; and that this all took place during the
COVID-19 pandemic,which disrupted ordinary business operations. They also assert that their
business has suffered due to increased fuel costs.
Regarding Respondents' first argument,the evidence suggests that Respondents were
responsible for at least some of the violations, for photographs show work being done after
Respondents had purchased the Property.
Nor do the permit records support the contention that the County caused delays.
Respondents did not apply for the demo permit until November 24, 2021, which was nearly four
months after the fines had started to run. Respondents did not apply for the ATF permit until
May 6,2022, by which time fines had been running for more than nine months. On the demo
permit, it took Respondents 78 days to submit corrections after the first failed review. The
County had that permit ready for issuance less than one week after receipt of the corrections, but
Respondents did not pick up the permit immediately; instead,they let another 37 days pass
before doing so. The County is not at fault for these delays.
As for the pandemic, Florida was open for business by the fall of 2020, before the
relevant events at issue. COVID-19 should not have been a material barrier to compliance,and
there is no evidence that it was.
Finally,the undersigned does not doubt that the high price of fuel from which all
Americans have suffered since roughly January 20, 2021,has hurt Respondents' business.
Respondents, however,report a relatively substantial household income, and the Property is a
valuable piece of real estate. The undersigned cannot find that payment of the fine would
impose an undue financial hardship on Respondents.
In determining the appropriate fine to impose at this juncture,the undersigned has
carefully considered the factors set forth in section 162.09(2)(b),Florida Statutes, and MCC
section 8-31(b). In addition,MCC section 8-31(d)provides six enumerated factors for the
undersigned to consider in determining whether a fine should be mitigated:
(1) Whether the entity requesting the release owns other properties
in the County, and how many have active code cases or code liens;
(2) Whether the entity requesting the release owned the property
for which the lien was placed at the time the lien was placed;
(3) Whether the entity requesting the release took proactive action
to correct the violations for which the lien was placed;
(4) Whether the violations have been corrected;

(5) Any other specific information which is available about the
property or the entity requesting the reduction or release;
(6) Any other factor which may show a hardship on the entity
requesting the release or which may provide a reasonable basis for
the relief.
After hearing from Respondents and the County, and based upon a consideration of the
forgoing factors, it is concluded that Respondents should be granted the relief previously offered
by the County.
Upon consideration, therefore,
IT IS ORDERED that Respondents are fined a total of$61,000.00 for the violations
found to exist on their Property. No later than 30 days after the date of this Order, Respondents
shall pay to the County the sum of$62,029.17 ($61,000.00 in fines and$1,029.17 in costs).
Failure to pay this sum within the time allowed shall result in the restoration of the full,
unmitigated total fine of$63,500.00 plus costs.
This Order may be appealed by any aggrieved party to the Circuit Court of Monroe
County no later than 30 days from the date of the Order. Failure to timely file a written Notice
of Appeal will waive the right to appeal.
DONE AND ORDERED this 8th day of November, 2022, at the Division of
Administrative Hearings, Tallahassee, Florida.

Good morning Christopher
I hope all is well !!
I would like to start by apologizing for our actions in pouring concrete without permits on our property,
unfortunately people learn from their mistakes. I am hereby requesting a substantial reduction in our
penalty.
We received the violation and was completely unaware of what needed to be done in order to comply
and be in compliance. I started to gather information and ask around to educate myself on the process,
this was when covit was into its 6th month or so and it was extremely difficult to find people to assist.
In the beginning of 2021 we were able to gather information in order to come to compliance, we had
plans drawn up and submitted we went back and forth for months I believe every plan that was
submitted was denied . So we were told nothing would get approved by then we were sent a notice of
for a hearing for them violations and foreclosure.
There were many obstacles involved we had existing concrete when we purchased the property in front
of the garage (pictures all over the internet) when the house was for sale . Again after a few months it
was determined that there was no permit for that concrete.They then wanted us to demolish
everything including the existing concrete, so we applied for an after the fact permit as well as the
demolition.This process again took months .
I was in contact with a Lisette Cutie throughout the entire process keeping her up to date with the
progress. I personally attended the zoom hearing and spoke with the judge as well.
Once demolition was approved I believe within a few weeks we're had completed the demolition. Now
the after the fact permit we needed to add another small slab and have new plans drawn up by hand in
order to speed up the process.
So finally demolition was done and approved the after the fact permit was finally approved and we have
been in compliance.
My intentions were to come in compliance ASAP but unfortunately these things have a lot of issues and
problems and that is why it took so long .
I have an extremely high penalty which I would like for you to take into consideration all the problems
that we incurred and reduce as much as possible.
My business has suffered tremendously in the past first due to covit and now with the high pricing in
fuel and would appreciate your consideration.
Your assistance in this matter will be greatly appreciated!!

SUMMARY:
As a result of work without a permit which also extended into the right of way, a NOTICE OF
VIOLATION/NOTICE OF HEARING was prepared by staff for the April 29, 2021 hearing. The certified mail
receipt was not received resulting in the property and courthouse being posted for service. A STIPULATED
AGREEMENT was signed by the owners prior to the hearing at which they were not present.
The FINAL ORDER/LIEN was recorded on behalf of the Board of County Commissioners on August 17,2021, at
Doc#2335616,OR Bk#3120 Pg.#294.
Compliance was achieved on July 1,2022,when the paving permit was closed.
Additionally,per F.S. §162.07(2), if the local governing body prevails in prosecuting a case before the enforcement
board, it shall be entitled to recover all costs incurred in prosecuting the case and such costs may be included in the
lien authorized under F.S. §162.09(3). To date,these costs are $1,029.17.
Therefore,the current amount of the Monroe County lien is $64,529.17($63,500.00 fines and $1,029.17 costs).
RELEVANT INFORMATION:
On July 15, 2015, the Monroe County Board of County Commissioners passed and adopted Ordinance 016-2015
providing for the Special Magistrate to have discretionary authority in Code Compliance matters to hear and rule
upon fine and lien reduction requests after considering six enumerated factors.
STAFF RECOMMENDATIONS:
A modest reduction was offered on this newly constructed property.

The purpose of this letter is to inform you that a lien against your property was recorded in the Official Records of
Monroe County on August 17,2021 at Document 2335616,Boob 3120, Page 294 as a result of(lie above referenced
code compliance action. This lien is a lien on the property that was the subject of the code compliance action and
upon any and all other real and/or personal property you own.
This case was deemed compliant and fines accrued as follows:
o MCC Sec. 110-140(a) was deemed compliant on July 1, 2022. Therefore, the daily fine of$100.00 per
day accrued 335 days(July 31, 2021 —June 30,2022)for a fine total of$33,500.00.
• MCC Sec. 19-33 was deemed compliant on May 27. 2022. Therefore, the daily fine of$100.00 per day

My name is Elizabeth Veiiz, property owner, I am writing to you in regards to our
hearing next week for our fines. I take full responsibility for our actions and
apologize for any inconvenience this may have caused the county.
I will try to make this as short as possible as I know your time is extremely
valuable.
When the house was purchased and put for sale there was an existing driveway in
our survey as well as in all the pictures of the sale of the house. The sellers
obtained the certificate of occupancy with the concrete already there as indicated
on the survey dated 9/30/2020.
We received the violation during the pandemic and it was very difficult to find
people to assist me with this situation. After I really had no choice but to do it as
an owner builder I have had to learn how the county works by myself. Everything
was taking longer than usual in reviewing the plans in the city as well as with the
architects.
I am hereby humbly asking for consideration in this case due to the circumstances
that surrounded this chain of events that took way longer than expected.

I would like to start by apologizing for our actions in pouring concrete without permits on our property, unfortunately
people learn from their mistakes.
We received the violation and was completely unaware of what needed to be done in order to comply and be in
compliance. I started to gather information and ask around to educate myself on the process,this was when covit was
into its 6th month or so and it was extremely difficult to find people to assist.
In the beginning of 2021 we were able to gather information in order to come to compliance,we had plans drawn up
and submitted we went back and forth for months I believe every plan that was submitted was denied .So we were told
nothing would get approved by then we were sent a notice of for a hearing for them violations and foreclosure.
There were many obstacles involved we had existing concrete when we purchased the property in front of the garage
(pictures all over the internet)when the house was for sale .Again after a few months it was determined that there was
no permit for that concrete.They then wanted us to demolish everything including the existing concrete,so we applied
for an anger the fact permit as well as the demolition.This process again took a months .
I was in contact with a Lisette Cutie throughout the entire process keeping her up to date with the progress. I personally
attended the zoom hearing and spoke with the judge .

Once demolition was approved I believe within a few weeks we're had completed the demolition.Now the after the fact
permit we needed to add another small slab and have new plans drawn up by hand in order to speed up the process.
So finally demolition was done and approved the after the fact permit was finally approved and we have been in
compliance.
My intentions were to come in compliance ASAP but unfortunately these things have a lot of issues and problems and
that is why it took so long.
I have an extremely high penalty which I would like for you to take into consideration all the problems that we incurred
and reduce as much as possible. My business has suffered tremendously in the past first due to covit and now with the
high pricing in fuel and would appreciate your consideration.

| would like to start bv apologizing for our actions in pouring concrete without permits on our property,
unfortunately people learn from their mistakes. | am hereby requesting substantial reduction in our
penalty.
We received the violation and was completely unaware of what needed to be done in order to comply
and be in compliance. I started to gather information and ask around to educate myself on the process,
this was when covit was into its 6th month or so and it was extremely difficult to find people to assist.
In the beginning of 2021 we were able to gather information in order to come to compliance,we had
plans drawn up and submitted we went back and forth for months I believe every plan that was
submitted was denied . So we were told nothing would get approved by then we were sent a notice of
for a hearing for them violations and foreclosure.
There were many obstacles involved we had existing concrete when we purchased the property in front
of the garage (pictures all over the internet)when the house was for sale . Again after a few months it
was determined that there was no permit for that concrete.They then wanted us to demolish
ev�rything including the existing concrete, so we applied for an after the fact permit as well as the
demolition.This process again took mnnths .
| was in contact with o Lisette Cutie throughout the entire process keeping her up to date with the
progress. I personally attended the zoom hearing and spoke with the judge as well.
Once demolition was approved I believe within a few weeks we're had completed the demolition. Now
the after the fact permit we needed to add another small slab and have new plans drawn up by hand in
order tm speed up the process.

So finally demolition was done and approved the after the fact permit was finally approved and we have
been in compliance.
My intentions were to come in compliance ASAP but unfortunately these things have a lot of issues and
problems and that is why it took so long .
I have an extremely high penalty which I would like for you to take into consideration all the problems
that we incurred and reduce as much as possible.
My business has suffered tremendously in the past first due to covit and now with the high pricing in
fuel and would appreciate your consideration.
Your assistance in this matter will be greatly appreciated!!

The purpose of this letter is to inform you that Monroe County, Florida has imposed a lien against your property
as a result of the above referenced code compliance action. This lien is a lien on the property that was the subject
of the code compliance action and upon any and all other real and/or personal property you own.
Our records indicate that the violation(s) remains on your property. Because your property is not in compliance
the fines continue to accrue in the amount of$ 200.00 per day until the property comes into compliance. A daily
fine of$ 200.00 per day has currently accrued for 97 days for a current total of$19,400.00.
Additionally, pursuant to F.S. §162.07(2), since the County prevailed in prosecuting the case before the Special
