attorneys fees incurred by Planning Commissioner Joseph Scarpelli for his successful defense against an
unfounded ethics complaint arising from actions he took in furtherance of his official duties.
ITEM BACKGROUND:
The proposed resolution authorizes the Clerk to reimburse Monroe County Planning Commissioner
Joseph Scarpelli $1,800 that he spent to defend himself from an unfounded ethics commission
complaint.
The requested payment is consistent with the common law doctrine affording public officials the right
"to legal representation at public expense to defend themselves against litigation arising from the
performance of their public duties while serving a public purpose,"that was enunciated by the Florida
Supreme Court in Thornber v. City of Ft. Walton Beach, 568 So.2d 914, 916-7 (Fla. 1990); see, also,
Maloy v. B.O.C.C. of Leon County, 946 So.2d 1260, 1263 (Fla. 1 st DCA 2007).
The Courts have held that this common law right applies to county officials and to ethics proceedings
provided that the matter: (1) arises out of or in connection with the performance of their official duties;
and (2) the public official's conduct serves a public purpose. The Courts have observed that purpose of
this common law rule is to avoid the chilling effect that a denial of representation might have on public
officials in performing their duties property and diligently.
On or about November 30, 2023, Julee Marzella filed an ethics complaint against Planning
Commissioner Scarpelli alleging that Mr. Scarpelli had "violated [a provisions of the Florida code of
ethics set forth at F.S. 112.313(4)] because his wife, Renee Scarpelli and/or her business, Island Grove
Dance Studios LLC accepted gifts of donations from an Applicant seeking approval of a Major
Conditional Use Permit Application to build a resort hotel development on Little Torch Key, FL." On
September 18, 2024, the Commission on Ethics found that"there is no probable cause to believe the

Respondent [Scarpelli], who serves on the Monroe County Planning Commission violated Section
112.313(4), Florida Statutes, by his spouse accepting gifts to benefit her business for which he should
have known, with the exercise of reasonable care, were given to influence an action in which he was
expected to participate in an official capacity."
Mr. Scarpelli engaged the services of private counsel to defend himself against Ms. Marzella's ethics
complaint and has provided documentation that he paid $1800 to counsel out of his own pocket.

MONROE COUNTY, FLORIDA A U T H O R I Z I N G T H E
REIMBURSEMENT OF PLANNING COMMISSIONER
JOSEPH SCARPELLI FOR ATTORNEYS FEES HE
INCURRED IN HIS SUCCESSFUL DEFENSE OF AN
ETHICS COMPLAINT AGAINST HIM .
WHEREAS, the Florida Supreme Court enunciated a common law doctrine
affording public officials the right "to legal representation at public expense to
defend themselves against litigation arising from the performance of their public
duties while serving a public purpose," Thornber v. City of Ft. Walton Beach,
568 So.2d 914, 916-7 (Fla. 1990); see, also, Maloy v. B.O.C.C. of Leon County,
946 So.2d 1260, 1263 (Fla. 1st DCA 2007); and
WHEREAS, the Supreme Court has held that this "entitlement to
attorney's fees arises independent of statute, ordinance, or charter." Thornber,
568 So.2d at 917; and
WHEREAS, the Courts have held that this "common law right applies to
county officials and to ethics proceedings"; see, Maloy, 946 So.2d at 1263 citing
Ellison v. Reid, 397 So.2d 352, 354 (Fla. 1st DCA 1981 ) and Thornber, 568
So.2d at 918-19 n. 7; and
WHEREAS, in order for a public official "to be entitled to representation
at public expense, the litigation must: (1 ) arise out of or in connection with the
performance of their official duties; and (2) serve a public purpose"; Thornber,
568 So.2d at 917; and
WHEREAS, the Supreme Court observed that the "purpose of this
common law rule is to avoid the chilling effect that a denial of representation
might have on public officials in performing their duties property and diligently",
Thornber,ld.
WHEREAS, on or about November 30, 2023, Julee Marzella filed an
ethics complaint (#23-274) against Planning Commissioner Joseph Scarpelli
alleging that Mr. Scarpelli had "violated [F.S. 112.313(4)] because his wife,
Renee Scarpelli and/or her business, Island Grove Dance Studios LLC accepted

herein as Exhibit A; and
WHEREAS on September 18, 2024, the Commission on Ethics found that
"there is no probable cause to believe the Respondent [Scarpelli], who serves
on the Monroe County Planning Commission violated Section 112.313(4),
Florida Statutes, by his spouse accepting gifts to benefit her business for which
he should have known, with the exercise of reasonable care, were given to
influence an action in which he was expected to participate in an official
capacity." See, Public Report filed In re: Joseph Scarpelli, #23-274, which is
attached hereto and incorporated herein as Exhibit B.
WHEREAS Mr. Scarpelli engaged the services of attorney Mark Heron to
defend himself against Ms. Marzella's ethics complaint for which Mr. Scarpelli
paid Mr. Heron one thousand, eight hundred dollars ($1800) out of his own
pocket; see Composite Exhibit C consisting of five invoices from the law firm of
Messer Caparello P.A. and documentation showing payments totaling an equal
amount; and
WHEREAS, the Board finds that Mr. Scarpelli's vote on the major
condition use permit application, the subject of the actions complained of by
Ms. Marzella in Ethics Complaint #23-274, arose out of Mr. Scarpelli's service
on the Monroe County Planning Commission and that vote served a public
purpose in the form of the orderly administration of the business of the County's
local planning agency; and
WHEREAS, it is the intention of the County Commission to direct the Clerk to
reimburse Mr. Scarpelli in the amount of $1,800 for the attorneys' fees he incurred in
defending himself against the unfounded ethics complaint (#23-274) filed by Ms. Marzella.
NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OFMONROE COUNTY, FLORIDA-
1. That the above-stated recitations are incorporated as factual findings
of the Board.
2. That the Clerk is authorized and directed to reimburse Monroe County
Planning Commissioner Joseph Scarpelli the sum of one thousand,
eight hundred dollars ($1800) for the attorneys' fees he incurred in
mounting a successful defense against the unfounded ethics
complaint (#23-274) filed by Ms. Julee Marzella.

STATEMENT OF FACTS
I. Alleged Ethics Violation:
I believe Monroe County Planning Commission Chair, Joe Scarpelli (Chair Scarpelli), vio,latedi Section
112.313(4) Florida Statutes Standards of conduct for public officers, employees of agencies, and local
government attorneys because his wife, Renee Scarpelli and/or her business, Island Groove Dance
Studios LLC,' accepted gifts or donations from an Applicant seeking approval of a Major Conditional
Use Permit Application, (Application) to build a resort hotel, development on Little Torch Key, FL.
Chair Scarpelli did not disclose his potential conflict of interest nor did he recuse himself from
discussion or voting during the October 25, 2023 Monroe County Planning Commission (PC) public
hearing where he voted in favor of approving the Application. Chair Scarpelli's potential conflict
disclosure and recusal are required by Section 3143 Florida Statutes Voting conflicts.
The Applicant / Owner named on the Application is Little Palm Dolphin Resort Development LLC
(Applicant). When the Application was submitted, the Applicant owned both the property that was the
subject of the PC public hearing and the Little Palm Island Resort & Spa. Little Palm Island Resort &
Spa is an exclusive, private island resort in the Florida Keys accessed by motor yacht from the resort's
property on Little Torch Key, FL.
11. Gifts Accepted:
During the design process of the proposed resort hotel development and in the same year as the
submission of their Application, the Applicant gifted an overnight stay plus breakfast at their Little Palm
Island Resort & Spa valued at over $3,000 to Chair Scarpelli's wife, Renee Scarpelli, and/or her
business, Island Groove Dance Studios LLC. This gift and its value are shown on Renee Scarpelli's
February 18, 2021 Facebook post.' The overnight stay was sold by Renee Scarpelli and/or her
business via auction on biddingowl.com.3
Also in 2021, Renee Scarpelli and/or her business accepted gifts from the Applicant of their"Get Lost"
logo merchandise including a "Tote Bag, 2 Yetis & (2) Towels." These gifts are shown on Chair
Scarpelli's May 7, 2021 Facebook post,' on Renee Scarpelli's May 11, 2021 Facebook poSt,5 and were
valued at $180.1i These items were also sold by Renee Scarpelli and/or her business via auction on
biddingowl.com.
In 2023, shortly before the originally scheduled May 24, 2023 PC Public Hearing for this Application,'
Renee Scarpelli and/or her business accepted gifts from the Applicant of "Lunch for 2 at Little Palm

Renee Scarpelli' and Chair Joe Scarpelli,9 these items were valued at $�325 and were raffled off by
Renee Scarpelli and/or her business with the winner chosen during a live drawing on April 16, 2023.
Also in 2023, Renee Scarpelli and/or her business accepted a gift from the Applicant of a second
"Lunch for Two at Little Palm Island Resort & Spa" that, according to Renee Scarpelli's May 19, 2023
Facebook post was sold via silent auction on May 21, 2023."
In all, during the Application process between 2021 and 2023, Chair Joe Scarpelli's wife and/or her
business accepted gifts from the Applicant valued at approximately $3,830. These gifts were sold via
auction, raffle, and/or drawing with the proceeds presumably benefiting Renee Scarpelli and/or her
business. Given the timing of these gifts to his wife, Chair Scarpelli knew, or with the exercise of
reasonable care should have known, that they were given, or at least have the appearance of being
given, to influence his vote on the Application.
Ill. Chair Scarpelli's Comments on this Potential Ethics Law Violation:
At the subsequent PC Hearing on November 15, 2023, Chair Scarpelli addressed his potential conflict
of interest during the October 2,5, 2023 PC Hearing as follows-
• CHAIR S,CARPELLI: "One other thing, Commissioners. I wanted to let everyone know that due
to our last, our last Planning Commission meeting, there have been some things being said as
far as questioning my personal ethics doing our duty here on this Commission, and I just want
you all to know that that is --you know, I take this position very seriously and I'm sure all of you.
And just, you know, make sure we always keep things above par because people are always
watching. And, you know, you've got to -- this is not an easy job. We don't take it lightly at all
,and we look at everything with scrutiny for just one particular project but all, all the County as a
whole, and that's not easy. So, I just wanted to let you know that, that there is stuff been going
on but w?0I be fine and gygrything is ggin ,"

details or -- "
• CHAIR SCARPELLI: "No, I don't think so. It's -- it's already on Facebook, I guess, so wh
cares. But, yeah. I just wanted to let you all know that."
I have no knowledge of any Facebook discussion about this matter.
Chair Scarpell's "who cares" response with regard to his possible violation of the ethics law is very
disturbing. A public official should care whether they violated the standards of conduct or disclosure
laws or breached the publ,ic's trust. As one of many who's quality of life will be negatively impacted by
the resort hotel development that Chair Scarpelli voted in favor of, I certainly care.

Based on the preliminary investigation of this complaint and the recommendation of the
Commission's Advocate, the Commission on Ethics finds there is no probable cause to believe the
Respondent, who serves on the Monroe County Planning Commission, violated Section
112.313(4), Florida Statutes, by his spouse accepting gifts to benefit her business for which he
should have known, with the exercise of reasonable care, were given to influence an action in
which he was expected to participate in an official capacity.
Accordingly, this complaint is dismissed with the issuance of this public report.
