Closed Sessions at the January meeting:
1. Roy's Trailer Park v. Noel & Monroe County, 19-CA-175-K. Declaratory Judgment suit
filed by Roy's against County as part of its eviction suit against its tenants. County
counterclaim against the trailer park and the park residents, seeking an injunction
prohibiting occupancy at the park until serious fire and life safety issues have been
addressed, appointment of a receiver, and declaratory relief to determine whether the
owner or tenants are responsible for the code violations. The Court denied Roy's
Motion for Summary Judgment on statute of limitations grounds on 12/30/24.
Mediation is currently set for 01/08/25. The trial date is currently set 01//27/25.
2. In re: Michael Joseph McMahon and Sergei Nikoshchenkov, U.S. Bankruptcy Ct. S. Dist.
Fla. Case No. 23-1154-RAM. Monroe County is a secured creditor in this Chapter 13
bankruptcy case, with a claim for over$260,000 in unpaid tourist development and tourist
impact taxes.
Cases of Interest at Trial Court Level
3. F.E.B. Corp. v. Monroe County & FDEP, DEP OGC Case No.: 24-1615 (DEP Permit No.
44-0137939-029-EG). Petitioner F.E.B. Corp., which lost its disputed claim of ownership
of Wisteria Island in Federal Court, challenges FDEP's permit to the County that
establishes a public mooring field at Man of War Harbor in Key West. FDEP has yet to
refer the matter to the Division of Administrative Hearings (DOAH).
4. Massacci, et al. v. Monroe County, et al., Case No. 24-CA-566-K(filed 6/16/24). Personal
injury lawsuit by the personal representative of the estate of Kirk Weidericht against the
County, FDOT, Big Pine Academy and Rubi Metass for the injuries and subsequent death
of Mr. Weidericht who was riding his motorcycle on or near Dear Run Trail when he was
struck by the driver (Metass). The County has answered. Plaintiff filed a Reply and
General Denial of Affirmative Defenses on 11/20/24. Discovery is ongoing.

5. Rafael A. Bezanilla v. Monroe County, Florida, 24-CA-26-P. Property owners seek
declaratory judgment regarding a request to amend the Tier Maps of a property in Key
Largo. The BOCC reconsidered and approved the Tier map amendment application at
the 10/16/24 BOCC meeting. A notice of voluntary dismissal was filed on 12/26/24;
Case can now be closed.
6. Cavo Hueso Investments, Inc. v. Monroe County, DOAH Case 24-2250-GM. Cayo
Hueso, an adjacent property owner, filed a petition challenging the County's amendments
of the Land Development Code (zoning) and Comprehensive Plan (Future Land Use
Map/FLUM) in order to allow a shoreside facility for the proposed mooring field in Boca
Chica Harbor. On 12/13/24, the ALJ entered a Recommended Order affirming the
correctness of the County's actions. The adverse property owner has until
12/30/24 to file exceptions to the DOAH judge's Recommended Order. Afterward,
the Recommended Order and any filed exceptions will be reviewed by the Florida
Department of Commerce, which will then issue a Final Order.
7. John Kuluz, Fred Laemmerhirt, and Alberto Lazaro v. Monroe County and 17RM
Investments, LLC, 21-CA-357-P. Plaintiffs Kuluz and Laemmerhirt and Intervenor Lazaro
(Neighbors) are the owners of property near 17RM's Key Largo property. The Neighbors
are seeking a declaratory judgment against the County's determination that a 20-foot
front-yard setback does not apply, under the Land Development Code, to 17RM's
property on the basis that it is fronted by a private access easement. The Court granted
the County's and 17RM's motion for summary judgment and denied the Neighbors'
motion for summary judgment on 11/25/24. The Court entered final judgment in favor
of the County and 17RM on 11/27/24. On 12/11/24 the neighbors filed a Motion for
Rehearing, which remains pending.
8. Mitchell Kukulski v. Biltmore Construction and Monroe County, 24-CA-302-P. Plaintiffs
alleges that he was injured when he tripped and fell in one of the medians in the parking
lot outside the Plantation Key courthouse. The courthouse was under construction at the
time. The County filed an answer and a cross-complaint for indemnification against the
contractor Biltmore Construction. Discovery is ongoing. Mediation is scheduled for
2/10/25.
9. John Behmke et al. v. Monroe County, 24-CA-94-K. Plaintiffs are/were property owners
in the Coral Hammock and allege inverse condemnation based on their inability to
conduct vacation rentals beginning in in 2016, when code compliance cited them for
renting in a land use district that prohibited vacation rentals (the Third DCA affirmed a
decision of the Circuit Court finding the Mixed-Use District does not prohibit vacation
rentals of attached units and reversing orders of the code compliance special magistrate
finding the properties in violation). Plaintiffs seek takings compensation as well as lost
rental income and other financial damages. In December 2024, the County filed its
motion to dismiss the second amended complaint that remains pending.

10.Stacey Mitchell v. Monroe County, 24-CA-890-K. Plaintiff sued the county alleging
Whistleblower violations. Plaintiff also sued the Board of County Commissioners, 3406
NORTH ROOSEVELT BOULEVARD CORPORATION, and the Tourist Development
Council. The County has filed a partial motion to dismiss and an Answer to the complaint.
Counsel for 3406 North Roosevelt filed a motion to dismiss. 3406 North Roosevelt's
Motion to Dismiss is scheduled to be heard on 1/23/25.
11.2014 Janet Vincent Family Trust, et al., v. Monroe County Case No. 24-CA-000332-K.
Plaintiffs are seeking declaratory judgment regarding a parcel of land abutting their
properties. The County's motion to dismiss that was granted in part. Plaintiff filed an
amended complaint, the County filed a second motion to dismiss. A hearing on the
County's second motion to dismiss is pending. The parties have discussed early
mediation.
12. Peter & Olivia Poto v. Monroe County/Monroe County v. Jane Gilbert Trust, 22-CA-709-
K, quiet title and specific performance action by buyers of a property where seller had
sold development rights to one lot and entered into a unity of title as part of the County's
Less than Fee program. Settlement Agreement was approved at the December
BOCC Meeting. Awaiting finalization of sale.
13. Jay Archbell PA v. Buirley, Monroe County, et al., 23-CA-108-K. The County previously
settled its claim against Jay Archbell, PA (the property owner) for a reduced amount of
code liens. The property (3 El Monte Lane, Big Coppitt) appears to have some owners
outside the chain of title. Archbell then sued prior owners Kenneth and Anita Lynn
Buirley, the County, and others, to quiet title.
14. Maschal et al. v. Monroe County and FKAA, 19-CA-186-K. Suit by 12 individuals seeking
similar relief to the Delaney lawsuit, which the County and FKAA won. The Court
dismissed the case on 4/4/22, but the Third DCA remanded the case with instructions to
allow Plaintiffs to file one single amended complaint. Plaintiffs filed their Amended
Complaint on 8/17/23. The County and FKAA filed answers on 9/1/23 and a joint
Counterclaim for injunctive relief, compelling the property owner plaintiffs to connect to
the wastewater system. On 10/29/24, the Court took the parties' motions for summary
judgment under advisement.
15. Martin v. Monroe County Florida, 24-CA-517-P. Plaintiff sought declaratory judgement
regarding the applicability of hurricane emergency declarations. The parties have
reached settlement and the case has been stayed to allow the parties to fulfill their
obligations under the settlement agreement.
16. Kearns Construction Company v. Monroe County, 24-CA-001134-M. This action is a
Petition for Writ of Certiorari. Petitioner seeks to quash the BOCC's award of the contract
for RFP-568 Artificial Reef Materials Deployment to Gulfside 10-Mile Reef. The County
filed a Motion to Dismiss on 12/18/24.
17. Dalk Land, L.P. v. Monroe County Building Department, 24-CA-989-K. Dalk Land seeks
a writ of Mandamus relating to an appeal from a DOAH decision. The County filed a
written response and opposition on or about 11/04/2024.

Appellate Cases of Interest
18. Navarro v. FKSCPA, 23-CO-1531-A-K, 3D23-2026. On 12/18/24, the Third DCA
affirmed the underlying Animal Control violation case finding that owner permitted
her dog to run at large, resulting in citation and fine. Case can now be closed.
19. Seven Eight Investments, LLC v. Monroe County, 24-AP-009-K, 24-AP-010-K. Property
owners appealed from the Code Compliance Special Magistrate's final orders finding
them in violation of the Code for failure to obtain a conditional use permit and for illegal
accessory use of the property (storage and pool) without a principal use following
demolition of the residence. Briefing is complete. The County has filed a motion for
appointment of a three-judge panel.
21.601 Cuda Properties, LLC v. Monroe County & SFWMD, Case No. 3D24-118 (L.T. Case
No. 2023-066-DAO-ERP) and 3D24-2101 (L.T. Case No.2024-086-DAO-ERP). 601
Cuda Properties, LLC, has filed a second appeal from a SFWMD Order dismissing 601
Cuda's petition for a formal administrative proceeding on the grounds that the petition
was untimely. 601 Cuda's petition opposed the Environmental Resource Permit that was
issued to the County on 11/17/23, authorizing the use of sovereign submerged lands to
repair the Rock Harbor Breakwater and install an air bubble curtain and seaweed
gate. On 10/16/24, the property owner filed an amended petition, which was denied by
the District on 10/29/24. The property owner's Initial Brief is due on 1/30/25.
23. Pirates Saving Paradise, Inc. v. Little Palm Dolphin Resort Development, LLC, Case No.
24-CA-1074-K. On 10/25/24 property owners filed a petition for a writ of certiorari from
Planning Commission Resolution No. P01-24, which approved Little Palm Dolphin Resort
Development, LLC's (Little Palm's) request for a non-use variance eliminating the
requirement to have six boat trailer parking spaces on the property (a reduction of 114
parking spaces to 108 parking spaces) in order to render the property's Planning
Commission-approved major conditional use site plan in compliance with the Code's
standard parking requirements. On 12/4/24 the County and Little Palm submitted a
joint Response in Opposition to Petition, after which the property owners
submitted a Motion to Stay this case pending a final order in their duplicative DOAH
appeal (DOAH Case No. 24-004225). On 12/18/24 the property owners submitted an
Amended Motion to Stay, which is still pending.
24. Pirates Saving Paradise, Inc. v. Little Palm Dolphin Resort Development, LLC, and
Monroe County Planning Commission (DOAH Case 24-004225). On 10/25/24 property
owners improperly filed a duplicate appeal to DOAH of Planning Commission Resolution
No. P01-24, which approved Little Palm Dolphin Resort Development's request for a
non-use variance eliminating the requirement to have six boat trailer parking spaces on
the property (a reduction of 114 parking spaces to 108 parking spaces) in order to render
the property's Planning Commission-approved major conditional use site plan in
compliance with the Code's standard parking requirements. The DOAH hearing judge
granted the County's Motion to Dismiss and entered a final order in favor of the
County on 12/12/24. The property owners have 30 days (until 1/13/25) to seek
review of the DOAH hearing judge's decision in favor of the County.

25.Tavernier Community Association, Inc., James Bell, and Chris Hoguet v. Monroe County,
Florida (State of Florida Department of Commerce). On 12/16/24 property owners filed a
petition with the Florida Department of Commerce challenging Ordinance No. 004-2024
(land development regulation/LDR) as inconsistent with the Comprehensive Plan. On
12/17/24 Florida Commerce notified the County of its receipt of the petition. On
12/30/24, Florida Commerce notified the petitioners and the County that they must
file written submissions by 1/17/25.
26.Shands v. City of Marathon, 3D21-1987. This is a long running takings case involving an
offshore island located within the City of Marathon. On 5/3/23, the Third DCA reversed
a trial court decision in favor of the City and, in doing so, created a new hybrid species of
inverse condemnation claim that, if left unchecked, could have dire consequences for the
growth management policies governing the Florida Keys Areas of Critical State
Concern. On 6/2/23, the County and the Village of Islamorada filed an amicus brief in
support of Marathon's Motion for Rehearing, Rehearing en banc, and for Certification to
the Florida Supreme Court. The City's motion for rehearing remains pending.
27. Sunset Gardens Estate Land Trust v. Monroe County, 19-CA-460-P, 3D23-1368.
Property owner sued claiming that various state laws including the Right to Farm Act,
preempt the County's land development regulations. The County filed a
counterclaim. On 7/11/23, the Court entered judgment for the Plaintiffs. The County
appealed to the Third DCA. Oral argument was held on 10/1/24 at 9:30 A.M.
28.Denise Joy Snyder Living Trust v. Monroe County, 24-AP-003-K. Owner filed an appeal
of the Code Compliance Special Magistrate's final order finding them in violation of the
code for unpermitted land clearing and imposing fines and restoration
requirements. Briefing is complete. The Court denied the County's motion for
assignment of a three judge panel.
29.Swanson v. Rick Griffin and Monroe County, 24-CA-503-K, 3D24-1727. Property owners
sued seeking to extend their building permits deadline or to provide an administrative
appeal pursuant to Fla. Stat. 252.363 or LDC 6-56. On 8/29/24, the court entered its
order granting complaint for writ of mandamus and ordering the building official to deem
owners' notice of appeal complete and schedule a hearing before the CBA. The County
appealed on 9/27/24.
Class Action Lawsuits where Monroe County is a Party
30.Monroe County v. 3M, et al., 22-CA-618-K/2:22-cv-03680-RMG, consolidated into 2:18-
mn-02873-RMG: On 9/9/2022, Monroe County filed suit against manufacturers of
aqueous film-forming foam (AFFF) containing per- and polyfluoroalkyl substances
(PFAS) to recover damages for investigation, remediation, removal, disposal, treatment
and monitoring of water and soil created by defendants' products. PFAS had been
detected at the Monroe County Fire Training Academy on Grassy Key. On 10/7/22,
defendants removed the case to the U.S. District Court for the Southern District of
Florida. On 10/26/22, the County's case was transferred and consolidated with other
similar cases in the Multi District Litigation (MDL) case pending in the District of South
Carolina before Hon. Richard M. Gergel.

Constitutional Officer Cases
31.The Supervisor of Elections is currently involved in several litigation matters. The cases
challenge various Florida Statutes regarding election legislation and voter
registration. Griffin and other SOEs retained outside counsel, but the County Attorney's
office is assisting in the defense of each case. Current pending matters are as follows
with the cases being at various stages of litigation:
A) League of Women Voters of FL v. Sec'y of State Lee, Joyce Griffin, et al, 4:21-
cv-00186; USDC/NDFL, 11th Cir. Ct. App. Case No. 22-11143. Above case
consolidated with NAACP of FL v. Sec'y of State Lee, Joyce Griffin, et al, 4:21-
cv-00187, USDC/NDFL, 11th Cir. Ct. App. Case No. 22-1114; Florida Rising
Together, v. Sec'y of State Lee, Joyce Griffin, et al, 4:21-cv-201, USDC/NDFL,
11th Cir. Ct. App. Case No. 22-11143; and Harriet Tubman Freedom Fighters, et
al v. Laurel M. Lee, et al, No. 4:21-cv-00-242-MW-MAF, 11th Cir. Ct. App. 22-
11133. Following an appeal to the Eleventh Circuit, these cases were remanded
to the District Court (Chief Judge Walker), who issued a Final Order on Remand
(on 2/8/24) that the drop-box restrictions and registration-delivery requirements in
SB 90 were not unconstitutional, because they did not unduly burden the right to
vote. The case is essentially finished, other than motions for attorneys' fees and
costs which are still pending_
B) Vote.org v. Byrd, Joyce Griffin, et al, No. 4:23-cv-00111 (N.D. Fla.); 111h Cir. Ct.
App. Case No. 23-13727.
C) NAACP v. Byrd, Joyce Griffin, et al, No. 23-cv-215 (N. D. Fla.)/11th Cir. Ct. App.
Case No. 23-12308. A two-week bench trial began 4/1/24. Seven (7) days were
held, but then the trial court granted leave for Plaintiffs to file their Fourth
Amended Complaint. All defendants answered by 4/29/24. The case is
essentially finished, other than a determination of the amount of attorney's fees
that plaintiff may recover from the State defendants, but not the Supervisors.
Foreclosure Actions
32.The County Attorney's Office is currently prosecuting 27 cases to foreclose or otherwise
enforce on County code compliance liens. The Office is also currently defending 7
mortgage foreclosure cases, where the County holds an interest in the property, usually
as a result of an inferior code compliance lien.
Other Matters of Interest
33.Code Collections. In December, Code Compliance and the County Attorney's office
collected $126,366.17 in fines and costs. For the first three months of the 2025 fiscal
year, $353,183.23 was collected for fines and costs. See attached report.
34.Vacation Rental Prosecutions. No Code Compliance hearing was held in
December.
35.Staff changes. Risk and Public Records Manager Brian Bradley resigned effective
12/31/24 to become the Assistant City Manager for the City of Marathon. Senior Assistant
County Attorney Cynthia Hall retired 1/2/25. Attorney Gaelan Jones joined the County
Attorney's Office on 1/2/25. The Office is still hiring.
