ITEM BACKGROUND:
Monroe County Code Section 6-108(e) allows BOCC approval of waivers of building permit fees for
affordable housing which has/have a Development Order in effect. This request is for building permit
fee waivers to construct the project site including 56 affordable housing units, currently proposed as 48
units with two bedrooms and two bathrooms, four with three bedrooms and two bathrooms, and four
with one bedroom and one bathroom, at approximately Mile Marker 16.5 having parcel ID numbers
0166976-11300 and 00166976-11400 on Sugarloaf Key. Building permit fees requested for waiver are
approximately $475,700. Each of the 56 units has a pro rata construction value, based on the multi-unit
buildings and associated site work, of approximately $354,200.
PREVIOUS RELEVANT BOCC ACTION:
On February 19, 2025, the BOCC approved a related resolution granting 56 ROGO reservations for this
project.

19 WHEREAS,on November 18,2009,the Monroe County Board of County Commissioners
20 ("Board") passed and adopted Ordinance 036-2009, allowing building permit fee waivers for
21 entities building low-income housing leveraging state or federal funds, or affordable housing as
22 defined by state statutes; and
23 WHEREAS, on February 10, 2010, the Board passed and adopted Ordinance 004-2010,
24 allowing waivers for housing for households up to 120% of median income in Monroe County.
25 Housing exceeding 120% may also apply for a waiver if the specific project for development is
26 being subsidized with or is leveraging state or federal funding; and
27 WHEREAS, on February 26, 2025, Lower Keys Community Center Corporation
28 (Applicant) in partnership with Rural Neighborhoods, Inc. and Landings at Sugarloaf, LLC,
29 submitted the Application for Building Permit Fee Waiver. The legislative intent of this Resolution
30 is that the instant waiver shall apply to the building permit applicant of record; and
31 WHEREAS, Monroe County Code Section 6-108(e) allows the Board approval for
32 waivers of building permit fees for affordable housing which have a Development Order in effect.
33 The Applicant of Record is requesting building permit fee waivers totaling approximately
34 $475,700 to construct the project site including 56 (55 low income and one (1) moderate income,
35 or below) affordable housing units, currently proposed as 48 two bedrooms and two bathrooms;
36 four three bedrooms and two bathrooms, and four one bedroom and one bathroom, at
37 approximately Mile Marker 16.5 having parcel ID numbers 0166976-011300 and 00166976-
38 11400 on Sugarloaf Key.

40 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
41 COMMISSIONERS OF MONROE COUNTY, FLORIDA, THAT:
42 The foregoing recitals are true and correct and are hereby incorporated as if fully stated
43 herein; and
44 Building permit fees are waived pursuant to Monroe County Code Section 6-108(e) for
45 each of the 56 affordable housing units described herein with the condition that evidence of an
46 Affordable Housing Deed Restriction accepted and/or approved by both the Senior Director of
47 Planning & Environmental Services and the Office of the County Attorney and recorded in the
48 Public Records of Monroe County, Florida shall be provided to the Building Department.
49 PASSED AND ADOPTED by the Board of County Commissioners of Monroe County,
50 Florida, at a regular meeting held on the 25th day of March, 2025.

ITEM BACKGROUND:
Monroe County Code Section 6-108(e) allows BOCC approval of waivers of building permit fees for
affordable housing which has/have a Development Order in effect. This request is for building permit
fee waivers to construct the project site including 56 affordable housing units, currently proposed as 48
units with two bedrooms and two bathrooms, four with three bedrooms and two bathrooms, and four
with one bedroom and one bathroom, at approximately Mile Marker 16.5 having parcel ID numbers
0166976-11300 and 00166976-11400 on Sugarloaf Key. Building permit fees requested for waiver are
approximately $475,700. Each of the 56 units has a pro rata construction value, based on the multi-unit
buildings and associated site work, of approximately $354,200.
PREVIOUS RELEVANT BOCC ACTION:
On February 19, 2025, the BOCC approved a related resolution granting 56 ROGO reservations for this
project.

19 WHEREAS,on November 18,2009,the Monroe County Board of County Commissioners
20 ("Board") passed and adopted Ordinance 036-2009, allowing building permit fee waivers for
21 entities building low-income housing leveraging state or federal funds, or affordable housing as
22 defined by state statutes; and
23 WHEREAS, on February 10, 2010, the Board passed and adopted Ordinance 004-2010,
24 allowing waivers for housing for households up to 120% of median income in Monroe County.
25 Housing exceeding 120% may also apply for a waiver if the specific project for development is
26 being subsidized with or is leveraging state or federal funding; and
27 WHEREAS, on February 26, 2025, Lower Keys Community Center Corporation
28 (Applicant) in partnership with Rural Neighborhoods, Inc. and Landings at Sugarloaf, LLC,
29 submitted the Application for Building Permit Fee Waiver. The legislative intent of this Resolution
30 is that the instant waiver shall apply to the building permit applicant of record; and
31 WHEREAS, Monroe County Code Section 6-108(e) allows the Board approval for
32 waivers of building permit fees for affordable housing which have a Development Order in effect.
33 The Applicant of Record is requesting building permit fee waivers totaling approximately
34 $475,700 to construct the project site including 56 (55 low income and one (1) moderate income,
35 or below) affordable housing units, currently proposed as 48 two bedrooms and two bathrooms;
36 four three bedrooms and two bathrooms, and four one bedroom and one bathroom, at
37 approximately Mile Marker 16.5 having parcel ID numbers 0166976-011300 and 00166976-
38 011400 on Sugarloaf Key.

40 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
41 COMMISSIONERS OF MONROE COUNTY, FLORIDA, THAT:
42 The foregoing recitals are true and correct and are hereby incorporated as if fully stated
43 herein; and
44 Building permit fees are waived pursuant to Monroe County Code Section 6-108(e) for
45 each of the 56 affordable housing units described herein with the condition that evidence of an
46 Affordable Housing Deed Restriction accepted and/or approved by both the Senior Director of
47 Planning & Environmental Services and the Office of the County Attorney and recorded in the
48 Public Records of Monroe County, Florida shall be provided to the Building Department.
49 PASSED AND ADOPTED by the Board of County Commissioners of Monroe County,
50 Florida, at a regular meeting held on the 25th day of March, 2025.
