The positions are be funded by Airport Operating Fund 404. ITEM BACKGROUND: The contract for law enforcement and security services at the Airport is set for a three-year term and is amended annually to set the contract sum each fiscal year. PREVIOUS RELEVANT BOCC ACTION: On September 11, 2024, the BOCC approved a new three-year agreement with MCSO for law enforcement and security services at the Airport. On March 25, 2025, the BOCC adopted Resolution No. 141-2025 which is being rescinded and replaced with a new Resolution setting forth additional terms regarding the transfer of the individuals from MCSO to Monroe County employment. INSURANCE REQUIRED: No CONTRACT/AGREEMENT CHANGES: Creates fourteen(14) FTEs and transfers the individuals employed as Airport Security Technician with MCSO to Monroe County employment effective May 1, 2025. DOCUMENTATION: 1555 I,', IA - Employee transfer resolution- March 2025 FINALv4,pdf FINANCIAL IMPACT: TOTAL COST: $-0- BUDGETED: Yes x No COST TO COUNTY:.- 0 - SOURCE OF FUNDS: The positions are already funded by Airport Operating Fund 404-63200 Effective Date: May 1, 2025 Expiration Date: September 30, 2025 1556 RESOLUTION NO. -2025 A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA, RESCINDING PREVIOUS RESOLUTION 141-2025, REVISING AND APPROVING A RESOLUTION CREATING 14 NEW FULL TIME EQUIVALENT POSITIONS (FTEs) AND AGREEING TO THE TRANSFER OF 14 MONROE COUNTY SHERIFF'S OFFICE EMPLOYEES IN THOSE POSITIONS TO MONROE COUNTY BOCC EMPLOYMENT AT THE KEY WEST INTERNATIONAL AIRPORT. WHEREAS, Monroe County owns and operates the Key West International Airport (Airport); and WHEREAS, Monroe County, as the owner of the airport, maintains an Interlocal Agreement (ILA) with the Monroe County Sheriffs Office (MCSO) to provide for law enforcement and security services at the Airport; and WHEREAS, the Key West International Airport Security Plan (ASP) requires that the MCSO provide for, and staff,the law enforcement services with certified law enforcement officers and the security services with 14 non-sworn Airport Security Technicians (AST); and WHEREAS,pursuant to discussions held by Airport and MCSO, staff is recommending that 14 new FTEs be created and the AST's employed in those positions be transferred from MCSO to the Monroe County BOCC at the Key West International Airport in order for continuity of health benefits and Florida State Retirement(FRS), and to allow for greater flexibility in scheduling and assignment of the AST personnel at the airport; and WHEREAS,the funding for the 14 AST positions will transfer, along with the employees from MCSO to Monroe County at the Key West International Airport; and WHEREAS, the MCSO Law Enforcement and Security Services budget is funded by the Key West International Airport's annual budget process and the 14 AST positions will be removed from the MCSO budget and added to the Monroe County Airport budget resulting in no impact to the airport's budget; and WHEREAS, since the transfer of the employees is being done pursuant to an operational decision undertaken by Key West International Airport and MCSO, the parties desire to also transfer each employee's accrued sick leave, compensatory time, and accrued vacation time; and 1557 WHEREAS, the transfer is being initiated by the Key West International Airport and MCSO, Monroe County finds that the transfer of accrued sick leave and accrued vacation time does not violate Monroe County Personnel Policy 7.08. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA THAT: 1. Recitals. The foregoing recitals are true and correct and are hereby incorporated by reference. 2. The following AST's shall be transferred from employment under MCSO to employment under Monroe County BOCC with the following Job Titles and in the following positions. Kendra Albury, Airport Operations Officer - Security Murray Cox, Airport Operations Officer - Security Jeremy Jarvis, Airport Operations Officer - Security Niebes Lockwood, Airport Operations Officer - Security Robert Patterson, Airport Operations Officer- Security (night shift) Randel Phillips, Airport Operations Officer- Security Dominick Rojas, Airport Operations Officer- Security (night shift) Kevin Welday, Airport Operations Officer - Security Gabrielle Berger, Airport Operations Officer- Badging Tyler Nguyen, Airport Operations Officer - Landside Densflore Saul, Airport Operations Officer- Landside Medjine Saul, Airport Operations Officer - Landside Kurt Stephens, Airport Operations Officer- Landside Trista Winegarden, Airport Operations Officer - Landside 3. Each of the individuals named above shall become employees of the BOCC effective May 1, 2025. Each employee shall be required to complete new hire paperwork, background screening, and other related administrative actions in order to create a complete employee file with the BOCC. Additionally, each employee shall be required to complete a twelve (12) month probationary period beginning on their BOCC date of hire, as prescribed by Section 2.04 Monroe County Personnel Policies & Procedures. 1558 4. Upon commencement of their employment with BOCC, each employee shall receive compensation in an amount not less than the annual salary assigned to them by MCSO as of April 30, 2025. 5. Notwithstanding the standards for creditable service set forth by Monroe County Personnel Policies & Procedures, the continuous service date for each employee shall be established as their most recent date of hire with MCSO with respect only to policies and procedures governing fringe benefits, including but not limited to the following policies: A) Leave Accrual - for purposes of determining the total hours of annual and sick leave earned during each pay period, the years of continuous service for each employee shall be established using their most recent date of hire with MCSO. B) Payment of Unused Sick Leave - for purposes of determining the amount of terminal pay for unused sick leave upon separation from BOCC employment, the years of continuous service for each employee shall be established using their most recent date of hire with MCSO. C) Transfer of Leave - BOCC shall credit each employee for sick, annual, and compensatory leave accrued by the employee under their employment with MCSO. Each employee shall receive credit in the amount of their remaining balance of such leave, as reported by MCSO on April 30, 2025. D) Years of Service Program - for purposes of determining each employee's eligibility for incentives awarded under BOCC's `Years of Service Program,' the employee's years of continuous service shall be established using their most recent date of hire with MCSO. E) Promotional Opportunities — for purposes of determining eligibility for promotional opportunities and position transfers, the employee's length of continuous service shall be established using their most recent date of hire with MCSO. F) Employee Benefits - each employee shall be considered immediately eligible for employee insurance benefits effective May 1, 2025, with no waiting period. 6.
