AGENDA ITEM WORDING: A public hearing to consider approval of a resolution amending the
fiscal year 2025 budget for Fund 404, Key West International Airport.
ITEM BACKGROUND:
The purpose of the budget amendment is to bring forward accrued fund balance resulting from the
receipt of insurance proceeds relating to the EYW EMAS bed that was damaged during Hurricane
Irma. It is the intention of the Key West Airport Services Department to bring $500,000.00 of accrued
balance forward so that it may be made available for use in the current fiscal year to complete a shortfall
in funding to complete the EYW Apron Overflow project.
PREVIOUS RELEVANT BOCC ACTION:
On March 25, 2025, the BOCC gave approval to advertise a public hearing for a budget amendment to
Fund 404 for FY2025.
On February 19, 2025, the BOCC gave approval to advertise a public hearing for a budget amendment
to Fund 404 for FY2025.
On September 11, 2024, the Board of County Commissioners approved the FY2025 operating and
capital budget.

SUBJECT: Middle Keys (MM17-MM70) Animal Control Contract
Action Recommend;, f8yf purchasing policy and extend the Marathon FKSPCA contract for another
five (5)years and three months while eliminating the annual CPI adjustment in favor of a fixed 3%annual
adjustment.
Basis for Recommendation:
1. FKSPCA has the organizational and financial strength to deliver services in the middle keys.
2. Past solicitations have resulted in two bailouts of failed providers by FKSPCA.
3. Adjusting the end date will correspond with the County's Fiscal year
4. Using a 3% annual escalator is predictable for budgeting and approximates the long-term average
CPI.
5. KDPA suggested changes to the terms appear to add significant cost while not significantly
improving service.
Discussion:
FKSPCA's contract for the middle keys expires in June 2025. FKSPCA is willing to continue providing
services to the service area from MM16—MM70. Past public solicitations have resulted in contracts that
ended in financial difficulties for the providers. In both cases, FKSPCA stepped in, at the County's request,
to replace the failed service providers.
In 2017 a contract was done on an emergency basis to enable FKSPCA to take over the failed operation.
The agreement was written to finish the term of the previous contractor and provided for one (1) five (5)
year extension. That extension expires in June 2025.
The contract expires in the middle of the County's fiscal year and before the CPI for the coming year is
available making budget forecasting for the following year difficult. Using a fixed annual adjustment of 3%
and moving the anniversary date to 1 October, makes sense so that mid-year adjustments in the contract
are not necessary and eliminates the need for annual contract amendments saving staff time.
The County has received one recommendation from the Key Deer Protection Alliance (KDPA)for suggested
changes to the FKSPCA terms. Those requests included expanded hours at the shelter, as addition ACO to
patrol Big Pine Key and some requests for public records. FKSPCA estimates the increased costs for those
changes is$130,000/year. The County evaluated the service increases requested and determined that they
would not significantly improve service. Attached is FKSPCA's response to those requests and the County's
response to KDPA.

Sorry for forgetting to follow up. I have attached Tammy Fox's response to your letter . She prepared it in
January but, I failed to notice she didn't include you. Her responses are included within your letter and
includes sections from their SOP that you requested as attachments. Also attached is a summary from
Tara McFarland, the Director of the FKSPCA Marathon campus, of our meeting earlier this week to
explore the suggestions about changing the terms of the contract which will be on the April BOCC
meeting for approval.
The costs of the changes you suggest do not appear to be justified given the statistics cited by Tammy&
Tara and the fact that shelter hours will have no effect on ACO operations.

Hello everyone,
Thankyou for your time today. I sincerely appreciate everyone's consideration and
willingness to listen, and provide input. The following are the notes requested from the
meeting:
Currently the "open hours" of the FKSPCA Marathon Campus reflect hours that the
facility in Marathon is open to the public to walk in and conduct business such as
viewing adoptable animals, dropping off donations, learning about our programs and
services, or similar types of interactions. Therefore; our on site open hours at our
Campus do not directly impact the issue of free-roaming dogs in any way. Conversely,
our Animal Control Officers are available six days a week from 8am -5pm to conduct
normal business, and respond to after-hour emergencies 24/7.
The Marathon Campus currently has 7 staff members. The Director of Operations,
Shelter Manager, Event/Volunteer Coordinator, Lead Animal Control Officer and 3
Animal Care Technicians. To adequately keep the facility clean, care for the 50 animals
currently housed at our shelter, assist the public via walk in or telephone and respond to
calls it takes a minimum of 3 FT employees per day, five days a week for 8 hour shifts
(outside the Director, Management and Event/Volunteer Coordinator positions). To
accommodate the KDPA request of extending hours until 6:30pm it would mean
changing our five day a week, 8 hour shift work week to four 10 hour days. Doing so
would require hiring two more FT Animal Care staff.

The average annual salary of an Animal Care staff member is $38,000. Hiring the
necessary two additional FT Animal Care staff members would increase our budget by
an estimated $76,000.
There are two staff members trained to perform Animal Control duties that live on Big
Pine Key. A third staff member is completing her training in April, and she too lives in Big
Pine Key, creating a total of 3 Animal Control Officers that live in the area of concern.
Those officers not only live on Big Pine, but do travel through the island to commute to
work, conduct business on the island, come home on lunch breaks, and frequent stores
and restaurants. This is all done on personal time outside of working hours. Between
responding to citizen complaints, and conducting personal life, errands, etc... our
Officers do have a finger on the pulse of what is happening on the island they live on in
regards to Animal Control.
To accommodate the KDPA recommendation of more patrols, while still providing the
same quality of service to the remaining 50 miles of ourjustiction, the FKSPCA would
need to hire an additional Animal Control Officer.
The average Animal Control Officer base salary is $42,000. The average on-call shifts (3
shifts per week x$50) is$7,800. The average training is$1,500. Not factoring in overtime
pay for after-hours calls, the County contract would need to see an estimated $51,300
to absorb the costs suggested by the KDPA.
The total increase in the current contract amount would need to be$127,300.
Furthermore; the FKSPCA does own two of our own Animal Control vehicles. There are
no leased vehicles through the County. Having two vehicles ensures that if one Officer is
responding to a call, or patrolling a certain area, and another call comes in
simultaneously, another Officer is available to take the second vehicle and respond
immediately.
From January 1 st 2025 - March 27th 2025 the Marathon Campus responded to a total of
90 calls. Service calls include the following(but are not limited to); trapped or injured
wildlife, noise complaints (barking dogs/crowing chickens), acts of cruelty or neglect,
animals in distress, animal bites, loose/stray dogs, seizures, welfare checks and
transportation. Of those 90 calls, 17 were on Big Pine Key or 18% of our total call
volume. With our current staffing and current patrol schedule, I am confident that we are
already giving the Big Pine Key area more than 18% of our time and resources.

6 stray dog reports on Big Pine, of our 90 total calls is less than 7% of all total calls.
It is the responsibility of the FKSPCA and Animal Control to provide the same quality
service to all of our community members across our entire jurisdiction. I am comfortable
and confident that my team not only meets, but exceeds the expectations of our
contract and provides exceptional service through prompt response times, effective and
courteous communication, education and resources.

The Key deer Protection Alliance (KDPA) has monitored Animal Control on Big Pine Key
and No Name Key since our involvement with the process of adopting the Monroe County
Comprehensive Plans.
Up until the Big Pine Key Animal Shelter was closed in 2010, there was a noticeable
presence of Animal Control and enforcement on Big Pine and No Name Keys. The public
knew what to do when encountering a free roaming dog and Animal Control followed
through. The system operated smoothly.
Since then, we have become increasingly aware that free-roaming dogs are a serious
problem in our community. We receive calls asking KDPA"who do I call?" and "what do
I do?"when encountering a free-roaming dog. KDPA has been monitoring the frequency
of local social media discussions regarding free-roaming dogs' and was involved in the
case of the Key deer being attacked and killed on July 1, 2023.II, T[fls i� an Unproven

Beth Fennel (a SOKD activist) reported being bitten by an off leash dog but retracted her
statement to Officer Walters claiming "it might have been a scratch on her finger by a
nail", and the owners claim their dog never made any contact with Ms. Fennel at all.
Due to all these factors, KDPA has amassed a wealth of information on the effects of free
roaming dogs on endangered species,walkers,bikers,runners and the general public. We

have concluded the current Animal Control system is not working as it should, and there
is definite room for improvement.
Thanks to you we were able to study the current contract entitled"Operation of Marathon
Animal Control Shelter and Middle Keys Animal Control" (from Mile Marker 16.7 to Mile
Marker 70).
This contract became effective on November 15, 2017, and ended at 12:00 midnight on
June 30, 2020. Per the section on"Renewal"Monroe County had the option to renew the
agreement for one (1) additional five-year period. Hence, the contract is due for renewal
on June 30, 2025.
KDPA would like to provide input during the process of re-negotiating an Animal Control
contract for the Lower Keys, including, but not limited to, Big Pine Key, No Name Key,
Summerland Key, Cudjoe Key and Sugarloaf Key. How can this be accomplished?

We hope our comments and suggestions for the next Animal Control contract will be
viewed as we intend them to be: constructive,with the goals of creating an Animal Control
system which is more likely to make sense to the public, removing the public's fears of
free-roaming dogs and protecting the endangered species in the Lower Keys, including
the Key deer.

assistance you may provide in helping to improve Animal Control services on Big Pine
and No Name Keys and other islands in the Lower Keys.
