HomeMy WebLinkAboutResolution 160-2025 F 11 1 rw w„yd ri 2 RESOLUTION NO. 160 -2025 3 4 A RESOLUTION OF THE MONROE COUNTY BOARD OF COUNTY 5 COMMISSIONERS APPROVING THE EXTENSION OF THE 6 RESERVATION OF TEN (10) MODERATE INCOME CATEGORY 7 AFFORDABLE ROGO ALLOCATIONS FOR PROPOSED 8 AFFORDABLE HOUSING DWELLING UNITS ON PROPERTY 9 LOCATED AT 103925, 103935, 103945, 103955, 103965 OVERSEAS 10 HIGHWAY, KEY LARGO, MONROE COUNTY, FLORIDA, ON LOTS 11 9-13, BLOCK 7, LARGO SOUND VILLAGE, KEY LARGO, 12 APPROXIMATE MILE MARKER 104, CURRENTLY HAVING 13 PROPERTY IDENTIFICATION NUMBERS 00475240-000000, 14 00475250-000000, 00475260-000000, 00475270-000000, AND 00475280- 15 000000,AS REQUESTED BY ABIT HOLDINGS, LLC.,AS PROPERTY 16 OWNER, UNTIL FEBRUARY 13, 2026, FOR BUILDING PERMIT 17 ISSUANCE. 18 19 WHEREAS,the State of Florida and all local governments in the Florida Keys (each subject 20 to Area of Critical State Concern mandates relating to housing affordability) recognize the need for 21 affordable housing throughout the state and particularly in the Florida Keys where developable land 22 for housing is extremely limited and expensive; and 23 24 WHEREAS,the challenge of providing affordable housing opportunities in the Florida Keys 25 is one requiring sensible and responsive use of residential unit allocations, including implementation 26 of long-term preservation mechanisms; and 27 28 WHEREAS, due consideration should be given to relevant factors such as the capacity for 29 allocation recipients to promptly transform allocation awards/reservations into finished and occupied 30 affordable/workforce housing units; and 31 32 WHEREAS,Monroe County Land Development Code("LDC") Section 138-24(b)(2)allows 33 the BOCC to authorize reservations for "specific affordable or employee housing projects 34 participating in a federal/state housing financial assistance or tax creditprogram or receiving some 35 form of direct financial assistance from the county upon written request from the project sponsor 36 and approved by resolution of the Board of County Commissioners"; and 37 38 WHEREAS, on December 13, 2023, the Monroe County Board of County Commissioners 39 ("BOCC","Board","Monroe County",or the"County")approved BOCC Resolution No.644-2023, 40 reserving ten affordable housing allocations on the subject property through December 13, 2024; 41 and 42 1 of 3 I WHEREAS, on October 16, 2024, the Monroe County BOCC approved BOCC Resolution 2 No. 431-2024,reserving ten affordable housing allocations on the subject property through May 13, 3 2025; and 4 5 WHEREAS, Abit Holdings, LLC., is requesting additional time to obtain development 6 approvals for the development of the property with ten (10) affordable housing units; and 7 8 WHEREAS,the reservation of affordable housing allocations for the anticipated project does 9 not exempt the project from applicable requirements for the Monroe County Comprehensive Plan, 10 Land Development Code,Florida Building Code, floodplain management regulations,and/or all other 11 regulatory requirements; and 12 13 WHEREAS, Abit Holdings, LLC, shall obtain all required approvals from the Monroe 14 County Planning & Environmental Resources Department for the project; and 15 16 WHEREAS, Abit Holdings, LLC, shall obtain building permits for the affordable housing 17 dwelling units by February 13,2026; if the permit for a reserved ROGO allocation housing unit is not 18 issued by that time, the allocation shall revert to the County; 19 20 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY 21 COMMISSIONERS OF MONROE COUNTY, FLORIDA: 22 23 Section 1. Recitals and Legislative Intent. The foregoing recitals, findings, and determinations 24 are true and correct and are hereby incorporated as if fully set forth herein. 25 26 Section 2. Construction and Interpretation. The interpretation of this Resolution, and all 27 provisions of the Monroe County Codes, Comprehensive Plan, floodplain 28 management regulations, and Florida Building Code whose interpretation arises out 29 of,relates to,or is interpreted in connection with this Resolution,these being necessary 30 for the health, safety, and welfare of the residents of and visitors to unincorporated 31 Monroe County, shall be liberally construed in favor of Monroe County and such 32 interpretations shall be entitled to great weight in adversarial administrative 33 proceedings, at trial, and on appeal. 34 35 Section 3. The Monroe County Planning & Environmental Resources Department 36 ("Department") shall extend the reservation of ten (10) moderate income category 37 affordable ROGO allocations, for the project on Lots 9-13, Block 7, Largo Sound 38 Village, Key Largo, currently having property identification numbers 00475240- 39 000000, 00475250-000000, 00475260-000000, 00475270-000000, and 00475280- 40 000000, until February 13, 2026. 41 42 Section 4. The developer must obtain the building permits for the ten (10) affordable housing 43 units on or before February 13, 2026. 44 45 Section 5. The developer shall comply with the Monroe County Codes, Comprehensive Plan, 46 Florida Building Code, floodplain management regulations, and any and all other 47 requirements of Monroe County and/or State and/or Federal oversight agencies. 2of3 1 2 Section 6. The Department and Monroe County Building Department and Floodplain 3 Management Office professional staff are hereby authorized to process expeditiously 4 permit related applications for the above referenced project when received. 5 6 Section 7. Inconsistency, Partial Invalidity, Severability, and Survival of Provisions. If any 7 portion of this'Resolution, or any part:or portion thereof, is held to be invalid or 8 unenforceable by any administrative hearing officer or court of competent jurisdiction; 9 the invalidity or unenforceability of such.provision,or any part or portion thereof,shall 10 neither limit nor impair the operation,enforceability,or validity of any other provision 11 of this Resolution,or any remaining part(s)or portion(s)thereof. All other provisions 12 of this Resolution, and remaining part(s) or portion(s)s thereof, shall continue. 13 unimpaired in full force.and effect. 14 15 PASSED AND ADOPTED by the Board of County, Commissioners of Monroe County, 16 :Florida, at a regular meeting held on the 16th day of April,2025. 17 18 Mayor James K.
