ITEM BACKGROUND: The County's four Franchise Agreements sets forth commercial rates and allows for annual Consumer Price Index (CPI) adjustment to the commercial collection rates which is now based upon the Water, Sewer& Trash Index. The commercial rates for Fiscal Year 2025-2026 (October 1, 2025 to September 30, 2026) are being set in accordance with the commercial collection rates, as adjusted by 5.2% in accordance with the CPI for Water, Sewer& Trash per the Franchise Agreements, the Haul-out Agreement and Recycling Agreement. The Commercial Collection, Disposal and Recycling Rates were initially established in the Amended and Restated Solid Waste and Recycling Collection Franchise Agreement between Monroe County and Waste Management of Florida, Inc. (WM), Marathon Garbage Services, Inc. (MGS), Keys Sanitary Services (KSS) and Ocean Reef Club, Inc. (Ocean Reef). The BOCC directed to implement uniform commercial rates at their April 21, 2021 meeting. The BOCC at its May 19, 2021 meeting approved an Amendment to the agreements with WM, MGS, KSS, and Ocean Reef to implement uniform commercial rates. Each year, as per the Agreement, the commercial and recycling rates are adjusted by the Consumer Price Index and beginning October 1, 2025 will be adjusted based upon the CPI for Water, Sewer& Trash ending December 31. The County will publish notice of the proposed commercial rates and notice of the upcoming August public meeting to adopt the final 2025-2026 Commercial and Recycling rates. 36 PREVIOUS RELEVANT BOCC ACTION: The BOCC approved the Amended and Restated Solid Waste and Recycling Collection Franchise Agreements between WM, MGS, KSS on May 21, 2014 and Ocean Reef on August 20, 2014. The BOCC at its April 21, 2021 meeting directed for the commercial rates to be uniform and for staff to implement uniform commercial rates among the Franchisee. The BOCC at its May 19, 2021 meeting approved an Amendment to the agreements with WM, MGS, KSS, and Ocean Reef to implement uniform commercial rates. The BOCC at its August 21, 2024 meeting approved an Extension and Amendment to the Amended and Restated Solid Waste and Recycling Collection Franchise Agreements. The BOCC at its September 11, 2024 meeting approved an Extension and Amendment to the Amended and Restated Haul Out, Transfer Station Operations and Maintenance Agreement with WM. The County receives a percentage of the revenues which is placed in the Solid Waste Enterprise Fund to support Solid Waste services. 37 RESOLUTION NO. -2025 A RESOLUTION ADOPTING THE TENTATIVE PER MONTH SOLID WASTE COLLECTION, DISPOSAL, AND RECYCLING SERVICE RATES FOR COMMERCIAL PROPERTY IN THE VARIOUS SOLID WASTE COLLECTION FRANCHISE AREAS FOR FISCAL YEAR 2025/26. BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA as follows: Section 1.
