Monroe County Case No. 24-CA-000332-K. Plaintiffs are seeking declaratory judgment regarding a parcel of land abutting their properties. The County's motion to dismiss that was granted in part. Plaintiff amended their complaint. The Court denied the County's second motion to dismiss on 1/16/25. A closed session was held on 4/16/25 and continued to 5/21/25 in the event the mediation scheduled for 5/15/25 results in anything that the Board needs to be brief on. Pretrial conference is set for 6/6/25. A bench trial is set for 6/17/25. Trial Court Cases of Interest 2. Monroe County v. William Soileau, 22-CA-399-K, Lien foreclosure case stemming from Code case CE19080017 for construction of a dock without a permit. The case became compliant on 8/7/24. Fines accrued to $134,500 plus $2,515.42 in costs. The parties entered into a settlement agreement in the amount of$36,140.42 (25% of fines $33,625 + 100% costs $2,515.42 = $36,140.42). This report is made pursuant to § 2-184(d). Case was voluntarily dismissed on 5/2/25. 3. In re: Silver Airways LLC, US Bankruptcy Court, S.D.Fla., 24-23623, Chapter 11 petition for reorganization filed by Silver. 5/7/25 hearing held and parties agreed to hearing next week on resolution of administrative claims and possible sale of Silver to another airline. 4. Monroe County v. Leonardo Rodriguez and Pilar Franco, 22-CA-349-P. Foreclosure action stemming from Code Compliance Case CE19030156. The property is compliant. Settlement being finalized. 4578 5. Monroe County v. Marck Schofield, 18-CA-217-P. Foreclosure action stemming from Code Compliance Case CE10040067. Monroe County has a Judgment of Foreclosure. The property remains non-compliant. Board declined to give direction regarding Schofield's latest settlement offer at 4/16/25 BOCC meeting. 6. Roy's Trailer Park, Inc. et al. v. Monroe County, 19-CA-175-K. Declaratory Judgment suit filed by Roy's against County as part of its eviction suit against its tenants. County counterclaim against the trailer park and the park residents, seeking an injunction prohibiting occupancy at the park until serious fire and life safety issues have been addressed, appointment of a receiver, and declaratory relief to determine whether the owner or tenants are responsible for the code violations. The Court granted Plaintiff/Counter-Defendant Roy's and defendant Tenants' Motion to Dismiss for lack of subject matter jurisdiction. County's Motion for Rehearing filed 2/26/25. 7. F.E.B. Corp. v. Monroe County & FDEP, DEP OGC Case No.: 24-1615 (DEP Permit No. 44-0137939-029-EG). Petitioner F.E.B. Corp., challenges FDEP's permit to the County that establishes a public mooring field at Man of War Harbor in Key West. FDEP has yet to refer the matter to the Division of Administrative Hearings (DOAH). 8. Massacci, et al. v. Monroe County, et al., Case No. 24-CA-566-K. Personal injury lawsuit by the personal representative of the estate of Kirk Weidericht against the County, FDOT, Big Pine Academy and Rubi Metass for the injuries and subsequent death of Mr. Weidericht who was riding his motorcycle on or near Dear Run Trail when he was struck by the driver (Metass). The Plaintiff has added Webber Infrastructure Management, Inc as an additional defendant in the case. The County has answered. Plaintiff filed an amended Reply and General Denial of Affirmative Defenses in light of the Amended Complaint. Discovery is ongoing. 9. Mitchell Kukulski v. Biltmore Construction and Monroe County, 24-CA-302-P. Plaintiffs alleges that he was injured when he tripped and fell in one of the medians in the parking lot outside the Plantation Key courthouse. The courthouse was under construction at the time. The County filed an answer and a cross-complaint for indemnification against the contractor Biltmore Construction. Discovery is ongoing. A pretrial conference was held on 4/1/25. Mediation is being rescheduled. Biltmore has agreed to provide coverage without reservation of rights. 10.John Behmke et al. v. Monroe County, 24-CA-94-K. Plaintiffs are/were property owners in the Coral Hammock and allege inverse condemnation based on their inability to conduct vacation rentals beginning in in 2016, when code compliance cited them for renting in a land use district that prohibited vacation rentals (the Third DCA affirmed a decision of the Circuit Court finding the Mixed-Use District does not prohibit vacation rentals of attached units and reversing orders of the code compliance special magistrate finding the properties in violation). Plaintiffs seek takings compensation as well as lost rental income and other financial damages. The County's motion to dismiss is set for hearing on 6/30/25. 11.Stacey Mitchell v. Monroe County et al, 24-CA-890-K._Plaintiff sued the County, BOCC, TDC, and 3406 N. Roosevelt Bvld. Corp. (3406) alleging Whistleblower violations. Council. The County has filed a partial motion to dismiss and an Answer to the complaint. Counsel for 3406 filed a motion to dismiss. On 3/21/25, Judge Morgan was assigned to handle the case after Judge Koenig disqualified himself. 3406's Motion to Dismiss will be heard on 7/28/25. 4579 12.Peter & Olivia Poto v. Monroe County/Monroe County v. Jane Gilbert Trust, 22-CA- 709-K, quiet title and specific performance action by buyers of a property where seller had sold development rights to one lot and entered into a unity of title as part of the County's Less than Fee program. Settlement Agreement was approved at the 12/11/24 BOCC Meeting. A stipulation for voluntary dismissal filed 4/7/25. Case closed. 13.Jay Archbell PA v. Buirley, Monroe County, et al., 23-CA-108-K. The County previously settled its claim against Jay Archbell, PA (the property owner) for a reduced amount of code liens. The property (3 El Monte Lane, Big Coppitt) appears to have some owners outside the chain of title. Archbell then sued prior owners Kenneth and Anita Lynn Buirley, the County, and others, to quiet title. 14.Maschal et al. v. Monroe County and FKAA, 19-CA-186-K/3D2025-0574. Suit by 12 individuals seeking similar relief to the Delaney lawsuit, which the County and FKAA won. The County and FKAA filed answers and a joint Counterclaim for injunctive relief, compelling the property owner plaintiffs to connect to the wastewater system. On 1/28/25, the Court granted the County & FKAA's motion for summary judgment and denied the properties motion for summary judgment. On 3/28/25, the plaintiffs prematurely appealed to the Third DCA despite no final judgment being entered. On 5/6/25, the Third DCA issued an order remanding the case for 45 days (6/20/25) so the Trial Court can enter an appealable final judgment. 15.Kearns Construction Company v. Monroe County, 24-CA-1134-M. This action is a Petition for Writ of Certiorari seeking to quash the BOCC's award of the contract for RFP-568 Artificial Reef Materials Deployment to Gulfside 10-Mile Reef. On 1/31/25, the Court denied the County's Motion to Dismiss. The County filed a 45-page Response to the Petition, County Appendix, and Motion to Strike the Petitioner's Appendix on 2/20/25. The Court heard argument on 4/28/25 and took matter under advised. 16.Dalk Land, L.P. v. Monroe County Building Department, 24-CA-989-K. Dalk Land obtained a writ of Mandamus relating to an appeal from a building permit decision. The Court granted Dalk Land's motion for costs of $884.00 on 4/26/25. Case closed. 17.Monroe County BOCC v. SGC Land Trust 2/12/2000, Sunset Gardens Farm, LLC, Jonathan Simpson, et al, 25-CA-151-P. On 2/7/25, the County sued for declaratory and injunctive relief against the defendants which operate an alleged farm on cleared property. The County is seeking a declaration that the farm is in violation of over a dozen ordinances, comp plan policies, and statutes and seeks to enjoin those violations and demand corrective action. On 4/14/25, the Court granted the Us until 5/13/25 to file their answer but denied their motion regarding service. Appellate Cases of Interest 18.Dalk Land, L.P. v. Monroe County Building Department, DOAH 25-1345. Dalk Land has appealed a certificate of occupancy issued to its neighbor (Peter Giampaoli) on basis of alleged floodplain regulation violations to the Division of Administrative Hearings. The case is being briefed. Final hearing needs to be scheduled. 4580 19.Cayo Hueso Investments, Inc. v. Monroe County, DOAH Case 24-2250-GM/3D2025- 0643. Cayo Hueso, an adjacent property owner, filed a petition challenging the County's amendments of the Land Development Code (zoning) and Comprehensive Plan (Future Land Use Map/FLUM) in order to allow a shoreside facility for the proposed mooring field in Boca Chica Harbor. On 12/13/24, the ALJ entered a Recommended Order affirming the correctness of the County's actions. On 3/17/25, FloridaCommerce issued a final order findings the amendments consistent with statutes and the comprehensive plan. On 4/11/25, Cayo Hueso appealed the final order to the Third DCA. Cayo Hueso's initial brief is due by the end of June. 20.John Kuluz, Fred Laemmerhirt, and Alberto Lazaro v. Monroe County and 17RM Investments, LLC, 21-CA-357-P/3D25-500. Plaintiffs (neighbors) are the owners of property near 17RM's Key Largo property. The Neighbors sought a declaratory judgment against the County's determination that a 20-foot front-yard setback does not apply, under the Land Development Code, to 17RM's property on the basis that it is fronted by a private access easement. The Court granted the County's and 17RM's motion for summary judgment then entered final judgment in favor of the County and 17RM on 11/27/24. On 3/14/25, the neighbors appealed to the Third DCA. The Neighbors initial brief is due by the end of May. 21.Seven Eight Investments, LLC v. Monroe County, 24-AP-009-K, 24-AP-010- K. Property owners appealed from the Code Compliance Special Magistrate's final orders finding them in violation of the Code for failure to obtain a conditional use permit and for illegal accessory use of the property (storage and pool) without a principal use following demolition of the residence. Briefing is complete. The Court denied the County's a motion for appointment of a three judge panel. Oral argument was held 02/20/25, awaiting a ruling. 22.601 Cuda Properties, LLC v. Monroe County & SFWMD, Case No. 3D24-118 (L.T. Case No. 2023-066-DAO-ERP) and 3D24-2101 (L.T. Case No.2024-086-DAO-ERP). 601 Cuda Properties, LLC, has filed a second appeal from a SFWMD Order dismissing 601 Cuda's petition for a formal administrative proceeding on the grounds that the petition was untimely. 601 Cuda's petition opposed the Environmental Resource Permit that was issued to the County on 11/17/23, authorizing the use of sovereign submerged lands to repair the Rock Harbor Breakwater and install an air bubble curtain and seaweed gate. On 10/16/24, the property owner filed an amended petition, which was denied by the District on 10/29/24. On 11/21/24, the property owner instituted an appeal of the District determination to the 3rd District Court of Appeal. The property owner's Initial Brief was due on 01/30/25. On 01/22/25, the property owner filed a Notice of Agreed Extension of Time to File Initial Brief. The deadline for the Appellant's Initial Brief has been extended to 05/13/25. 23.Tavernier Community Association, Inc., James Bell, and Chris Hoguet v. Monroe County, Florida (State of Florida Department of Commerce). DOAH 25-1381 GM. On 12/16/24 neighboring property owners filed a petition with the Florida Department of Commerce challenging Ordinance No. 004-2024 as inconsistent with the Comprehensive Plan. An amended petition was filed on 3/10/25. A final hearing was held on 5/7/25. Estimated deadline for submitting proposed recommended orders is late June. 4581 24.Shands v. City of Marathon, 3D21-1987. This is a long running takings case involving an offshore island located within the City of Marathon. On 2/5/25, the Third DCA issued an en banc decision that created a new species of taking and vitiated the use of TDRs to forestall a taking. On 3/3/25, the City filed a motion for certification. The County is currently assisting the City in securing amicus support for when the City seeks review in the Florida Supreme Court. 25.Denise Joy Snyder Living Trust v. Monroe County, 24-AP-003-K. Owner filed an appeal of the Code Compliance Special Magistrate's final order finding them in violation of the code for RV storage and unpermitted land clearing and imposing fines and restoration requirements. On 4/20/25, the Court affirmed the Special Magistrate's order for the RV storage violation and reversed for 3 related land clearing violations because the property owner submitted an affidavit from an arborist that the trees on the vacant residential lot created a hazard to a residence even though there was no house on the lot. The County has until 5/20/25 to decide whether to appeal. Class Action Lawsuits where Monroe County is a Party 26.Monroe County v. 3M, et al., 22-CA-618-K/2:22-cv-03680-RMG, consolidated into 2:18-mn-02873-RMG: On 9/9/2022, Monroe County filed suit against manufacturers of aqueous film-forming foam (AFFF) containing per- and polyfluoroalkyl substances (PFAS) to recover damages for investigation, remediation, removal, disposal, treatment and monitoring of water and soil created by defendants' products. PFAS had been detected at the Monroe County Fire Training Academy on Grassy Key. On 10/7/22, defendants removed the case to the U.S. District Court for the Southern District of Florida. On 10/26/22, the County's case was transferred and consolidated with other similar cases in the Multi District Litigation (MDL) case pending in the District of South Carolina before Hon. Richard M. Gergel. Constitutional Officer Cases 27.The Supervisor of Elections is currently involved in several litigation matters. The cases challenge various Florida Statutes regarding election legislation and voter registration. Supervisor Hodies and other SOEs retained outside counsel, but the County Attorney's office is assisting in the defense of each case. Foreclosure Actions 28.The County Attorney's Office is currently prosecuting 25 cases to foreclose or otherwise enforce on County code compliance liens. The Office is also currently defending 7 mortgage foreclosure cases, where the County holds an interest in the property, usually as a result of an inferior code compliance lien. Other Matters of Interest 29.Code Collections. In April, Code Compliance and the County Attorney's office collected $196,046.45 in fines and costs. For the first seven months of the 2025 fiscal year, $780,963.81 was collected for fines and costs. See attached report. See attached report. 4582 3O.Vacation Rental Prosecutions. At the 4/17/25 Code Compliance hearing, seven vacation rental cases were heard. All cases were compliant prior to the hearing and the Special Magistrate ordered one-time fines as follows: VR-JAN25-0002, $5,000 per stipulated agreement; VR-FEB25-0013, $13,000; VR-FEB25-0014, $5,000; VR- FEB25-00157 $9,500 per stipulated agreement; VR-FEB25-0018, *repeat violation, maximum allowed fine of$15,000.
