Colina N/A AGENDA ITEM WORDING: Approval of the attached Resolution of the BOCC authorizing the transfer of any ownership interest that Monroe County has in the 2024 Ford F250, and its associated accessories, received by Ocean Reef Volunteer Fire Department, Inc. ITEM BACKGROUND: Approval of a Resolution authorizing the transfer of any ownership interest from Monroe County to Ocean Reef Volunteer Fire Department, Inc. (ORVFD) in the 2024 Ford F250, and its associated accessories, consistent with the County's obligations per the 1 st Amendment to the 2024 Reimbursement Agreement. ORVFD has requested the purchase of an incident command vehicle, namely a 2024 Ford F250, and its associated accessories, under the terms of the 1st Amendment to the 2024 Reimbursement Agreement between Monroe County and ORVFD. Through this Resolution, the BOCC resolves to transfer any of its ownership interest in the said incident command vehicle from Monroe County to ORVFD. PREVIOUS RELEVANT BOCC ACTION: 2024 Reimbursement Agreement: On July 17, 2024, BOCC approved agenda item P3 - 2024 Reimbursement Agreement with Ocean Reef Volunteer Fire Department, Inc. and the companion Resolution transferring any ownership interest held by Monroe County in the reimbursed personal property to ORVFD. 2023 Reimbursement Agreement: On December 13, 2023, BOCC approved agenda item N6 - 2023 Agreement with Ocean Reef 683 Volunteer Fire Department, Inc. On February 19, 2025, BOCC approved agenda item C25 -Amendment No. I to the 2023 Agreement. DOCUMENTATION: BOCC Reso Transferring Ownership Interest of Ford F250 to ORVFD(Lgl Appd5.29.25).pdf FINANCIAL IMPACT: N/A 684 RESOLUTION NO. -2025 A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA, AUTHORIZING THE TRANSFER OF ANY OWNERSHIP INTERESTS THAT MONROE COUNTY HAS IN THE 2024 FORD F250 AND ITS ASSOCIATED ACCESSORIES RECEIVED BY OCEAN REEF VOLUNTEER FIRE DEPARTMENT, INC.; PROVIDING FOR SEVERABILITY; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the Ocean Reef Volunteer Fire Department, Inc. (hereinafter referred to as "Fire Department") is a Florida 501(c)(3) not-for-profit corporation; and WHEREAS,the Fire Department provides emergency medical,rescue, and fire protection services for the community located in unincorporated Monroe County commonly known as Ocean Reef Club in conjunction with Monroe County Fire Rescue; and WHEREAS,the Fire Department was in need of a new incident command vehicle and its associated accessories, to wit: 2024 Ford F250; and WHEREAS, the Fire Department has requested the assistance of Monroe County in paying for the purchase of the above listed personal property to facilitate the delivery of life safety services as described herein; and WHEREAS,Monroe County has entered into various reimbursement agreements with the Fire Department whereby Monroe County has agreed, upon receipt of proper documentation, to reimburse the Fire Department for the purchase of such personal property and equipment in order to meet the needs of Monroe County in that region; and WHEREAS,the Monroe County Board of County Commissioners finds that the purchase of the incident command vehicle and its associated accessories, to wit: 2024 Ford F250, serves a public purpose and is in the best interests of the residents,business owners, and visitors of Monroe County, Florida. 1 685 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA: Section 1: That the foregoing "WHEREAS"clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this resolution. Section 2: That the Monroe County Commission hereby donates all rights, title and interest that it may have in the incident command vehicle and its associated accessories,to wit: the 2024 Ford F250, to the Ocean Reef Volunteer Fire Department, Inc. Section 3: That the County Administrator, or designee, is hereby authorized to take all necessary action(s)to divest Monroe County of any legal interest(s)to the personal property herein described that was purchased by the Ocean Reef Volunteer Fire Department, Inc. and such purchase was reimbursed by Monroe County through a separate reimbursement agreement duly approved and executed on behalf of the Monroe County Board of County Commissioners. Section 4: That if any clause, section, other part or application of this resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or in application, it shall not affect the validity of the remaining portion or applications of this resolution. Section 5: That this resolution shall be in full force and effect immediately upon its adoption.
