N UREN13ERG AND KIM D. N URENBERG, 7 AS TRUSTEES OF THE NURENBERG FAMILY TRUST 8 DATED OCTOBER 29, 2024, FOR PROPERTY 9 LOCATED AT 1135 HAKLUYT LANE, CUDJOE KEY, 10 DESCRIBED AS LOT 8, BLOCK 12, CUTTHROAT 11 HARBOR ESTATES FIRST ADDITION, AS RECORDED 12 IN PLAT BOOK 5 AT PAGE 60, OF THE PUBLIC 13 RECORDS OF MONROE COUNTY, HAVING PARCEL 14 ID # 00185580-000000, IN THE FORM OF GRANTING 15 ONE(1)DWELLING UNIT ALLOCATION AWARD. 16 17 18 WHEREAS, Daniel J. Nurenberg and Kim D. Nurenberg, as Trustees of the 19 Nurenberg Family Trust Dated October 29, 2024, submitted an application for 20 administrative relief under Section 138-27 of the Monroe County Land Development Code 21 (LDC); and 22 23 WHEREAS, the Planning and Environmental Resources Department provided a 24 professional staff report dated May 20, 2025, to the Monroe County Board of County 25 Commissioners (BOCC)regarding the application; and 26 27 WHEREAS, the Monroe County Board of County Commissioners makes the 28 following findings of fact and conclusions of law: 29 30 1. The subject property is a waterfront lot located within the Improved Subdivision (IS) 31 Land Use District and is located in the Cutthroat Harbor Estates First Addition 32 Subdivision and is designated as Tier 3 on the County's Tier Overlay Map; and 33 2. The application for administrative relief dated 3/18/2025, regarding Monroe County 34 Building Permit Number 20101747, concerns a request for administrative relief for 35 property described as Lot 8 , Block 12, Cutthroat Harbor Estates First Addition, as 36 recorded in Plat Book 5 at Page 60, of the Public Records of Monroe County, Florida 37 having Parcel Identification # 00185580-000000; AND 38 3. The date the associated ROGO application was submitted to the Planning and 39 Environmental Resources Department is 11/2/2020; and 40 4. The ROGO allocation application has been in the ROGO system for at least four (4) 41 consecutive years; and 42 5. Monroe County Land Development Code Section 138-27 provides a mechanism 43 whereby an applicant who has not received an allocation award in ROGO may apply 44 to the Board of County Commissioners for administrative relief, and ADMINISTRATIVE RELIEF RESOLUTION Pagel of3 RE#00185580-000000 20101747 1 6. The BOCC has the authority to grant administrative relief under Section 138-27 of the 2 Land Development Code and may grant the applicant a building allocation, offer to 3 purchase the property at fair market value consistent with Policy 101.7.1 of the 4 Comprehensive Plan, or provide such other relief as may be necessary and appropriate; 5 and 6 7. Policy 101.7.1, Policy 101.7.3, and Policy 105.2.8 of the Monroe County Year 2030 7 Comprehensive Plan provide criteria to be used for determining lands that are 8 appropriate for acquisition and the criteria includes the environmental sensitivity of 9 the vegetative habitat on the lot and the applicable Tier designation; and 10 8. In accordance with Policy 101.7.1 and Section 138-27, an offer to purchase the 11 property at its fair market value is the preferred form of administrative relief for Tier 12 3, non-waterfront lots; and 13 9. The subject property is a waterfront lot and meets the criteria for granting the applicant 14 an allocation award for the 1 dwelling unit requested in the next succeeding quarterly 15 allocation period or extended pro rata over several succeeding quarterly allocation 16 periods; 17 18 NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY 19 COMMISSIONERS OF MONROE COUNTY, FLORIDA: 20 21 Administrative relief is granted to Daniel J. Nurenberg and Kim D.Nurenberg, as Trustees 22 of the Nurenberg Family Trust Dated October 29, 2024,property described as Lot 8 ,Block 23 12, Cutthroat Harbor Estates First Addition, as recorded in Plat Book 5 at Page 60, of the 24 Public Records of Monroe County, Florida having Parcel Identification # 00185580- 25 000000 in the form of granting one (1) dwelling unit allocation, subject to the following 26 conditions: 27 28 1. The timing of the issuance of the permit shall be in accordance with the 29 annual number of residential allocations defined by Policy 101.3.2 of the 30 Monroe County Year 2010 Comprehensive Plan and as required by 31 Section 138-27 of the Monroe County Land Development Code. 32 33 2.
