HomeMy WebLinkAboutResolution 224-2025 RESOLUTIONNO. 224 -2025 A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, TO AUTHORIZE THE CLERK OF COURT AND COMPTROLLER TO WRITE OFF A RECEIVABLE DEBT OF $5,872.62. THE DEBT IS A RESULT OF AN UNPAID EDUCATIONAL REIMBURSEMENT REGARDING FORMER EMPLOYEE MARY NAPOLI. WHEREAS, Monroe County Board of County Commissioners (`Board') has an Educational Assistance Program and Policy (`Policy') that provides for reimbursement to employees of qualifying higher education costs and tuition expenses to employees; and WHEREAS, the Policy stipulates that if an employee leaves employment before two (2) years have passed, the employee owes back all funds paid to the employee by Monroe County for tuition and other qualifying higher education expenses; and WHEREAS, an employee in the Emergency Management Department, Mary Napoli, participated in in this program, received educational reimbursements totaling $10,411.89, and left Monroe County employment prior to the minimum two (2) year employment period required under the Policy; and WHEREAS,Napoli's end of employment accrued leave balance payout in the amount of$4,539.27 was applied to her balance of tuition expenses to partially reimburse Monroe County, leaving an outstanding balance of$5,872.62 that the County has thus far been unable to collect from Napoli; and WHEREAS,the Employee Services Department has consulted with the County Attorney's Office and determined that due to factors such as Napoli having relocated outside the State of Florida and discrepancies with Napoli's reimbursement forms, the expense of pursuing legal action against Napoli to collect the outstanding balance of her tuition expenses would likely outweigh any sums recovered; and WHEREAS,the outstanding balance of$5,872.62 remains on Monroe County's financial ledger as a pending receivable, which must be disposed of via action of the Board; and WHEREAS,the Board now wishes to write off the amount of$5,872.62 as an uncollectable debt. NOW,THEREFORE,BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, THAT: The Board authorizes the Clerk of the Court and Comptroller to write off the receivable debt of $5,872.62. PASSED AND ADOPTED by the Board of County Commissioners of Monroe County, Florida, at a regular meeting held on the 18th of June 2025. Mayor James K.
