Item H2 LAND AUTHORITY GOVERNING BOARD AGENDA ITEM SUMMARY Meeting Date: November 19, 2003 Bulk Item: Yes No X Department: Land Authority Agenda Item Wording: Approval to purchase Block 3, Lot 11, Breezeswept Beach Estates. Item Background: This item is proposed at the request of the property owner to protect property rights. Breezeswept Beach Estates is a filled subdivision on Ramrod Key that is over 50% built out with houses. The subject lot is one of 3 lots in this subdivision initially identified by a County biologist as a "red flag" wetland for which the owners requested and signed Land Authority purchase agreements. Subsequently Growth Management staff determined the lots may not qualify as red flag wetlands after all and is now in the process of consulting with DCA, DEP, EPA, and ACOE to confirm the lots' wetland status. Based on the Board's 8/20/03 action, it is staffs understanding that the Board wishes to proceed with purchasing the 3 referenced lots out of fairness to the owners. The Board has already purchased the first lot and today's action would approve purchasing the second lot. The owner of the third lot is awaiting a Beneficial Use determination and no longer wishes to sell at this time. The Land Authority's standard purchase agreement will be used in this transaction. The agenda packet spreadsheet lists the legal description, purchase price, and estimated closing costs. Due to the developed state of the surrounding land and the accessibility of this lot, land stewardship needs are anticipated to be moderate. Advisory Committee Action: On February 26, 2003 the Advisory Committee voted 4/0 to approve purchasing the property (based on the initial characterization as a red flag wetland). Previous Governing Board Action: On August 20, 2003 the Board approved purchasing the first of the three referenced wetland lots in this subdivision.
