Trial Court Cases of Interest
1. 2014 Janet Vincent Family Trust, et al., v. Monroe County, 24CA332K. Plaintiffs are
seeking declaratory judgment regarding a parcel of land abutting their properties that
the property should revert to their ownership. A bench trial was held on 6/17/25. The
parties were directed to file written closing briefs within 30 days of transcript
creation. A ruling is expected within the next 90 days.
2. In re: Silver Airways LLC, US Bankruptcy Court, S.D.Fla., 24-23623, Chapter 11
petition for reorganization filed by Silver. County Attorney's Office is asssisting outside
counsel. Auction of Silver's assets took place 5/28/25; Court will hear objections
to sale on 6/4/25. A hearing was held on 6/24/25 to compel the closing of the
sale of Silver's assets. At the hearing the purchaser announced that the sale had
in fact closed. The judge also directed the appointment of a trustee in the case
removing the current management team. The next phase involves the auction of
"Seaborne", a Silver affiliate. After the auction, a hearing will be held on 7/1/25
to approve the sale (at which time all objections will be heard, including one from
the purchaser of Silver's assets pursuing its own claim to Seaborne). 7/3/25 is
the deadline to close the sale of Seaborne, and another hearing will be held on
that date on Silver's motion to reject all contracts, including those with airports.
3. Monroe County v. Mark Schofield, 18-CA-217-P. Foreclosure action stemming from
Code Compliance Case CE10040067. Monroe County has a Judgment of
Foreclosure. Board declined to give direction regarding Schofield's latest settlement
offer at 4/16/25 BOCC meeting. Foreclosure sale is scheduled for 7/31/25.

4. Roy's Trailer Park, Inc. et al. v. Monroe County, 19-CA-175-K. Declaratory Judgment
suit filed by Roy's against County as part of its eviction suit against its
tenants. County counterclaim against the park and the park residents, seeking an
injunction prohibiting occupancy at the park until serious fire and life safety issues
have been addressed, appointment of a receiver, and declaratory relief to determine
whether the owner or tenants are responsible for the code violations. The Court
granted Roy's and Tenants' Motion to Dismiss for lack of subject matter jurisdiction.
County's Motion for Rehearing filed 2/26/25.
5. F.E.B. Corp. v. Monroe County & FDEP, DEP OGC Case No.: 24-1615 (DEP Permit
No. 44-0137939-029-EG). Petitioner F.E.B. Corp., challenges FDEP's permit to the
County that establishes a public mooring field at Man of War Harbor in Key West.
FDEP has yet to refer the matter to the Division of Administrative Hearings (DOAH).
6. Massacci, et al. v. Monroe County, et al., Case No. 24-CA-566-K. Personal injury
lawsuit by the personal representative of the estate of Kirk Weidericht against the
County, FDOT, Big Pine Academy and Rubi Metass for the injuries and subsequent
death of Mr. Weidericht who was riding his motorcycle on or near Dear Run Trail when
he was struck by the driver (Metass). The Plaintiff has added Webber Infrastructure
Management, Inc as an additional defendant in the case. The County has answered.
Plaintiff filed an amended Reply and General Denial of Affirmative Defenses in light of
the Amended Complaint. Discovery is ongoing. Deposition of Plaintiff Jennifer
Massacci has been scheduled for 06/13/25.
7. Mitchell Kukulski v. Biltmore Construction and Monroe County, 24-CA-302-P. Plaintiffs
alleges that he was injured when he tripped and fell in one of the medians in the parking
lot outside the Plantation Key courthouse. The courthouse was under construction at
the time. The County filed an answer and a cross-complaint for indemnification against
the contractor Biltmore Construction. Discovery is ongoing. A pretrial conference was
held on 4/1/25. Mediation is being rescheduled. Biltmore has agreed to provide
coverage without reservation of rights. Mediation has been scheduled for
07/10/25.
8. John Behmke et al. v. Monroe County, 24-CA-94-K. Plaintiffs are/were property
owners in Coral Hammock and allege inverse condemnation based on their inability to
conduct vacation rentals beginning in 2016, when code compliance cited them for
renting in a land use district that prohibited vacation rentals (the Third DCA affirmed a
decision of the Circuit Court finding the Mixed-Use District does not prohibit vacation
rentals of attached units and reversing orders of the code compliance special
magistrate finding the properties in violation). Plaintiffs seek compensation for takings,
as well as lost rental income and other financial damages. The County's motion to
dismiss is set for hearing on 9/12/25.
9. Stacey Mitchell v. Monroe County et al, 24-CA-890-K._Plaintiff sued the County, BOCC,
TDC, and 3406 N. Roosevelt Bvld. Corp. (3406) alleging Whistleblower violations.
Council. The County has filed a motion to dismiss and an answer. Counsel for 3406
filed a motion to dismiss. Both 3406 and the County's motions to dismiss will be
heard on 7/28/25.

10.Jay Archbell PA v. Buirley, Monroe County, et al., 23-CA-108-K. The County
previously settled its claim against Jay Archbell, PA (the property owner)for a reduced
amount of code liens. The property (3 El Monte Lane, Big Coppitt) appears to have
some owners outside the chain of title. Archbell then sued prior owners Kenneth and
Anita Lynn Buirley, the County, and others, to quiet title.
11.Kearns Construction Company v. Monroe County, 24-CA-1134-M. This action is a
Petition for Writ of Certiorari seeking to quash the BOCC's award of the contract for
RFP-568 Artificial Reef Materials Deployment to Gulfside 10-Mile Reef. The County
filed a 45-page Response to the Petition, County Appendix, and Motion to Strike the
Petitioner's Appendix on 2/20/25. The Court heard argument on 4/28/25. The Court
issued a final order on 6/27/25 finding that the BOCC conducted a quasi-judicial
hearing to award the contract and did not follow its Code when it allowed a bidder to
submit a bid bond after the bid opening but before contract award. The Court did not
address binding precedent that recognizes an award of a contract is an executive, not
quasi-judicial function. Nor did it analyze the County Code sections that authorize a
waiver of slight or immaterial variations where such deviation does not destroy the
competitive character of the bidding process, causes or confers a material change
more favorable to one bidder than the others, or furnishes one bidder an advantage or
benefit. The County Attorney's Office is currently assessing options for appellate
review.
12.Maschal et al. v. Monroe County and FKAA, 19-CA-186-K/3D2025-0574. Suit by 12
individuals seeking similar relief to the Delaney lawsuit, which the County and FKAA
won. The County and FKAA answered and counter sued for injunctive relief,
compelling the property owner plaintiffs to connect to the system. On 1/28/25, the
Court granted the County & FKAA's motion for summary judgment and denied the
property owners motion for summary judgment. On 3/28/25, the plaintiffs prematurely
appealed to the Third DCA despite no final judgment being entered. On 5/6/25, the
Third DCA remanded the case for 45 days (6/20/25) so the Trial Court can enter an
appealable final judgment. A final judgment was entered on 6/6/25.
13.BOCC v. SGC Land Trust 2/12/2020, Sunset Gardens Farm, LLC, and FMC
Management, Inc., 25-CA-151-P. On 2/7/25, the County sued for declaratory and
injunctive relief against the defendants which operate an alleged farm on cleared
property. The County is seeking a declaration that the farm is in violation of over a
dozen ordinances, comp plan policies, and statutes and seeks to enjoin those
violations and demand corrective action. On 6/2/25 the County voluntarily dismissed
the three individually named DFs from the lawsuit. The County's motion for
preliminary injunction is set to be heard on 9/3/25.
14. Monroe County v. NGM Insurance Company, 25-CA-538-M. On 5/9/25, the County
sued for breach of performance bond relating to the Seaview Bridge Project in Duck
Key. The County is seeking damages, including but not limited to the cost of completing
the project, additional financing costs, and liquidated damages. On 5/15/25, the
defendant accepted service. The surety filed its answer and affirmative defense
on 6/24/25. The County's Initial Disclosures are due on 7/14/25.

15.Garcia Jr., Pablo v. Monroe County BOCC, American Sports Federation, LLC, 24-CA-
32-P. On 06/01/2023, Plaintiff Pablo Garcia, Jr. was injured during a softball game
hosted by Defendant American Sports Federation, LLC ('ASF') when he allegedly
struck his wrist on a sprinkler head while diving for a ball in the outfield. ASF was
operating under an approved Use of Property with hold harmless agreement but failed
to maintain appropriate insurance coverage for the event. As a result, Risk's demand
for defense and indemnity was denied by both ASF and their insurance carrier. County
was served on 4/24/25. Monroe County filed its Answer and Affirmative Defenses
on 05/27/25.
16.Local 3909, Professional Firefighters of Monroe County v. Monroe County BOCC, CA-
25-018. On 05/12/25, Local 3909 initiated an unfair labor practice charge against
Monroe County with the Public Employee Relations Commission (PERC). PERC
appointed a hearing officer to the case on 05/19/25 and directed the parties to
file a joint response. On 05/27/25, Monroe County filed a Motion to Defer ULP
Charge to Arbitration, which was not opposed by Local 3909. PERC is expected
to refer the charge to arbitration for final resolution.
17.Monroe County v. Winifred Shosie, 22-CA-432-K. Injunctive action stemming from
Code Compliance Case CE19060049. At the pre-trial conference on 5/23/25, the
Court entered a Default Judgment in favor of the County. Final Judgment was issued
5/27/25. Defendant has filed a Notice of Appeal to the Third DCA.
18.Monroe County v. Miguel Reyes & Dulce Milagro Morlas, 22-CA-285-P. Foreclosure
action stemming from Code Compliance Case CE19060066. The property is in
compliance and the parties have reached a Settlement Agreement, within the County
Attorney's settlement authority. Defendants will pay $40,047.39, comprised of a
reduced fine and full costs. Settlement agreement executed 6/30/25.
Appellate Cases of Interest
19.Dalk Land, L.P. v. Monroe County Building Department, DOAH 25-1345. Dalk Land
has appealed a certificate of occupancy issued to its neighbor (Peter Giampaoli) on
basis of alleged floodplain regulation violations to the Division of Administrative
Hearings. Briefing was completed 6/13/25. Both Monroe County and Giampaoli have
filed motions to dismiss the appeal. A hearing needs to be scheduled.
20.Cayo Hueso Investments, Inc. v. Monroe County, DOAH Case 24-2250-GM/3D2025-
0643. Cayo Hueso, an adjacent property owner, filed a petition challenging the
County's amendments of the Land Development Code (zoning) and Comprehensive
Plan (Future Land Use Map/FLUM) in order to allow a shoreside facility for the
proposed mooring field in Boca Chica Harbor. On 12/13/24, the ALJ entered a
Recommended Order affirming the correctness of the County's actions. On 3/17/25,
FloridaCommerce issued a final order findings the amendments consistent with
statutes and the comprehensive plan. On 4/11/25, Cayo Hueso appealed the final
order to the Third DCA. On 6/17/25, Cayo Hueso was given a 60-day extension of
time to file its initial brief. Cayo Hueso's initial brief is now due 8/18/25.

21.John Kuluz, etal v. Monroe County & 17RM Investments, LLC, 21 CA357P/3D25-500.
Plaintiffs (neighbors) are the owners of property near 17RM's Key Largo property. The
Neighbors sought a declaratory judgment against the County's determination that a
20-foot front-yard setback does not apply, under the Land Development Code, to
17RM's property on the basis that it is fronted by a private access easement. The Court
granted the County's and 17RM's motion for summary judgment then entered final
judgment in favor of the County and 17RM on 11/27/24. On 3/14/25, the neighbors
appealed to the Third DCA. The Neighbors filed their initial brief on 6/12/25.
Answer Briefs from the County and 17RM are due 7/14/25.
22.Seven Eight Investments, LLC v. Monroe County, 24-AP-009-K, 24-AP-010-
K. Property owners appealed from the Code Compliance Special Magistrate's final
orders finding them in violation of the Code for failure to obtain a conditional use permit
and for illegal accessory use of the property (storage and pool) without a principal use
following demolition of the residence. On 6/12/25, Court affirmed Special
Magistrate's ruling in County's favor. Owner has until 7/13/25 to seek certiorari
review in Third DCA.
23.601 Cuda Properties, LLC v. Monroe County & SFWMD, Case No. 3D24-118 (L.T.
Case No. 2023-066-DAO-ERP) and 3D24-2101 (L.T. Case No.2024-086-DAO-
ERP). 601 Cuda Properties, LLC, has filed a second appeal from a SFWMD Order
dismissing 601 Cuda's petition for a formal administrative proceeding on the grounds
that the petition was untimely. 601 Cuda's petition opposed the Environmental
Resource Permit that was issued to the County on 11/17/23, authorizing the use of
sovereign submerged lands to repair the Rock Harbor Breakwater and install an air
bubble curtain and seaweed gate. On 10/16/24, the property owner filed an amended
petition, which was denied by the District on 10/29/24. On 11/21/24, the property
owner appealed the denial the 3rd DCA. The property owner filed its Brief on
5/13/25. SFWMD and County's briefs are due 9/10/25.
24.Shands v. City of Marathon, 3D21-1987. This is a long running takings case involving
an offshore island located within the City of Marathon. On 2/5/25, the Third DCA
issued an en Banc decision that created a new category of taking (an
"as-applied categorical taking") and vitiated the use of TDRs to avoid takings,
suggesting an owner must be provided a utilitarian physical use of their property. On
5/14/25, the Court denied the City's motion to certify the issue for great public
importance. On 6/12/25, the City filed a notice to invoke discretionary jurisdiction
in the Florida Supreme Court. On 6/16/25, the County filed its notice of intent to
file an amicus brief in support of the City should the court accept jurisdiction.
The County is also assisting the City in securing additional amicus support,
including from the Florida Association of County Attorneys, University of Florida
Levin College of Law, and the Everglades Law Center.
25.Robert W. Leaver v. Monroe County, 25-AP-004-K. Owner appealed an Order
Authorizing Foreclosure and/or Money Judgment. Owner argues that the Order is
erroneous because the code investigation and prosecution was based on an
anonymous complaint, despite not having appealed the underlying Order finding
violations of MCC 6-100(a) for unpermitted work. Owner filed its initial brief on
5/29/25. The County's answer brief is due on 7/21/25.

26.Monroe County v. Denise Joy Snyder Living Trust, 3D25-0975. Owner filed an appeal
of the Code Compliance Special Magistrate's final order finding them in violation of the
code for RV storage and un perm itted/unrestored land clearing and imposing fines and
restoration requirements. On 4/20/25, the Court affirmed the Special Magistrate's
order for the RV storage violation and reversed the related land clearing violations
because the property owner relied on the "pruning, trimming, or removal of a tree"
permit exception of FS 163.045 and submitted an affidavit from an arborist that the
trees on the vacant residential lot created a hazard to life and property. The Court
rejected the Special Magistrate's finding that the pre-amended version of FS 163.045
that applied at the time of clearing did not apply to vacant undeveloped property. On
5/20/25, the County filed its Petition for Writ of Certiorari in the Third District.
The owner was subsequently ordered to file a response.
27. Key Largo Beautification, Inc. v. Monroe County, 24-CA-1077-P/3D24-2193.
Owner appealed dismissal of their petition for a writ of mandamus requesting
the Circuit Court to force the County to replat property in Key Largo (MM 98.7).
The owner's initial brief is due 7/7/25.
28.Pirates Saving Paradise Inc. v. Monroe County, Planning & Environmental Resources
Department File No. 2025-110. On 5/28/25 PSP appealed to the Planning Commission
the Planning & Environmental Resources Department Senior Director's 5/6/25
approval of an application for a Minor Deviation to a Major Conditional Use Permit
regarding a parcel on Little Torch Key (MM 28.5). This appeal is set to b heard on
8/27/25.
29.Swift Eddy Corp. v. Monroe County, Planning & Environmental Resources Department
File No. 2025-113. On 5/23/25 owner appealed a 4/23/25-issued Letter of
Understanding regarding its property on Big Coppitt to the Planning
Commission. The appeal application is being processed to set it for a
forthcoming Planning Commission public hearing.
30.Raymond Vazquez v. Monroe County, Planning & Environmental Resources
Department File No. 2025-108. On 5/21/25, a Sugarloaf property owner filed an
application to appeal a determination requiring removal of an invasive exotic
melaleuca tree.The Owners' appeal application remains pending and incomplete
due to their failure to state a basis for the appeal..
31.Key Largo Family Trust LLC, My Family Trust Under Trust Agreement Dated
December 4th 2012, 97625 OSHWY LLC, and 97645 OSHWY LLC, 97655 LLC v.
Monroe County, Planning & Environmental Resources Department File No. 2025-042.
On 2/25/25 several closed held entities by Sam & Alana Stoia appealed LOUs issued
on 1/24/25 and 2/21/25 regarding their Key Largo properties. The appeal remains
pending and incomplete due to the Owners' failure to file an initial brief. On 6/13/25,
the Appellants withdrew their appeal. This case is now closed.
32.Lazaro Arango and Beatriz Miguez Arango v. Monroe County, Planning &
Environmental Resources Department File No. 2025-109. On 5/28/25 owners of a
parcel in Key Largo (MM 104) filed an application to appeal to the Planning
Commission a decision to fail a dock permit application based on the determination
that it fails comply with the Land Development Code Section 118-12 ("Shoreline
Setback— Docking Facilities"). The Owners' appeal application remains pending and
incomplete due to their failure to file an initial brief.

Class Action Lawsuits where Monroe County is a Party
33.Monroe County v. 3M, et al., 22-CA-618-K/2:22-cv-03680-RMG, consolidated into
2:18-mn-02873-RMG: On 9/9/2022, Monroe County filed suit against manufacturers
of aqueous film-forming foam (AFFF) containing per- and polyfluoroalkyl substances
(PFAS) to recover damages for investigation, remediation, removal, disposal,
treatment and monitoring of water and soil created by defendants' products. PFAS
had been detected at the Monroe County Fire Training Academy on Grassy Key. On
10/7/22, defendants removed the case to the U.S. District Court for the Southern
District of Florida. On 10/26/22, the County's case was transferred and consolidated
with other similar cases in the Multi District Litigation (MDL) case pending in the District
of South Carolina before Hon. Richard M. Gergel.
Constitutional Officer Cases
34.The Supervisor of Elections is currently involved in several litigation matters. The
cases challenge various Florida Statutes regarding election legislation and voter
registration. Supervisor Hodies and other SOEs retained outside counsel, but the
County Attorney's office is assisting in the defense of each case. Three older cases
remain pending awaiting final resolutions by the Courts. A new case was filed on
5/4/25, which challenges the constitutionality of HB 1205 passed by the Legislature
this year to regulate the initiative-petition process:
A) Florida Decides Healthcare, Inc., et al v. Sec'y of State Cord, Sherri Hodies,
et al, 4:25cv211-MW/MAF, USDC/NDFL. Three additional groups and one
individual have filed to intervene as Plaintiffs and the Republican Party of
Florida filed to intervene as a Defendant. The Court held a hearing on
5/22/25 on Plaintiff's Motion for an Injunction a denied all claims except one
of Plaintiff Jordan Simmons's vagueness claim challenging the expanded
definition of "racketeering activity." The original Plaintiff filed a second
Motion for Preliminary Injunction on 5/30/25, which does seek relief from
the SOEs, and a hearing was held on 6/30/25, but no ruling has been
issued.
Foreclosure Actions
35.The County Attorney's Office is currently prosecuting 25 cases to foreclose or
otherwise enforce on County code compliance liens. The Office is also currently
defending 7 mortgage foreclosure cases, where the County holds an interest in the
property, usually as a result of an inferior code compliance lien.
Other Matters of Interest
36.Code Collections. In June, Code Compliance and the County Attorney's office
collected $236,673.15 in fines and costs. For the first nine months of the 2025 fiscal
year, $1,170,579.32 has been collected for fines and costs. See attached report.

37.Vacation Rental Prosecutions. At the 6/12/25 Code Compliance hearing, five
vacation rental cases were heard. All cases were compliant prior to the hearing and
the Special Magistrate ordered one-time fines as follows: VR-APR25-0031, $6500;VR-
APR25-0032, $10,000; VR-APR25-0033, $630 (obtained VR permit); VR-APR25-
0034, $527 (obtained VR permit); VR-APR25-0036, $5000.
