'- -. ~ 2: Cl LL L_ Community Services ORDINANCE NO 018-1995 AN ORDINANCE ESTABLISHING A $20.00 NONCRIMINAL CIVIL PENALTY FOR VEHICLES PARKED IN VIOLATION OF SEC. 14 OF RESOLUTION NO. 122-1995 AT THE MARATHON AIRPORT (PARKING IN NO PARKING ZONES OR IN AREAS RESERVED FOR OTHER VEHICLES); PROVIDING FOR SEVERABILITY; PROVIDING FOR THE REPEAL OF ALL ORDINANCES INCONSISTENT HEREWITH; PROVIDING FOR INCORPORATION INTO THE MONROE COUNTY CODE OF ORDINANCES: AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA, that: Section 1. The noncriminal civil penalty for a violation of Sec. 14 of Resolution No. 122-1995, parking in a no parking area at the Marathon Airport or parking a vehicle in an area at the Marathon Airport reserved for vehicles of a different type or category or reserved for vehicles leased, licensed or permitted by the County, is $20.00. A law enforcement officer or parking enforcement specialist who discovers a vehicle parked in violation of this section may issue a ticket, in the form used by the County for parking violations, to the driver or, if the vehicle is unattended, attach the ticket to the vehicle in a conspicuous place. The liability for the payment of the parking ticket is as provided in Sec. 316.1967, Florida Statutes. All parking ticket penalties collected under this section must be remitted to the Marathon Airport account and may be used for any lawful purpose at that Airport. Section 2. If any section, subsection, sentence, clause or provision of this ordinance is held invalid, the remainder of this ordinance shall not be affected by such invalidity. Section 3. All ordinances or parts of ordinances in conflict with this ordinance are hereby repealed to the extent of said conflict. Section 4. The provisions of this ordinance shall be included and incorporated in the Code of Ordinances of the County of Monroe, Florida, as an addition or amendment thereto, and shall be appropriately renumbered to conform to the uniform numbering system of the Code. Section 5. This ordinance shall take effect immediately upon receipt of official notice from the Office of the Secretary of State of the State of Florida that this ordinance has been filed with said Office. BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA, that: Section 1. The noncriminal civil penalty for a violation of Sec. 14 of Resolution No. 122-1995, parking in a no parking area at the Marathon Airport or parking a vehicle in an area at the Marathon Airport reseryed for vehicles of a different type or category or reserved for vehicles leased, licensed or permitted by the County, is $20.00. A law enforcement officer or parking enforcement specialist who discovers a vehicle parked in violation of this section may issue a ticket, in the form used by the County for parking violations, to the driver or, if the vehicle is unattended, attach the ticket to the vehicle in a conspicuous place. The liability for the payment of the parking ticket is as provided in Sec. 316.1967, Florida Statutes. All parking ticket penalties collected under this section must be remitted to the Marathon Airport account and may be used for any lawful purpose at that Airport. Section 2. If any section, subsection, sentence, clause or provision of this ordinance is held invalid, the remainder of this ordinance shall not be affected by such invalidity. Section 3. All ordinances or parts of ordinances in conflict with this ordinance are hereby repealed to the extentof said conflict. Section 4. The provisions of this ordinance shall be included and / incorporated in the Code of Ordinances of the Cdunty of Monroe, Florida, as an addition or amendment thereto, and shall be appropriately renumbered to conform to the uniform numbering system of the Code. Section 5. This ordinance shall take effect immediately upon receipt of official notice from the Office of the Secretary of State of the State of Florida that this ordinance has been filed with said Office.
