ITEM BACKGROUND: The Ruth Ivins Building was built by Monroe County in 1996 as a location for the Monroe County Health Department. The building is in need of significant repair and the Monroe County Health Department is relocating to other County owned spaces in Marathon and the property will be vacated. The property will be advertised according to F.S. 125.35(1)(c). (c) No sale of any real property shall be made unless notice thereof is published once a week for at least 2 weeks in some newspaper of general circulation published in the county, calling for bids for the purchase of the real estate so advertised to be sold. In the case of a sale, the bid of the highest bidder complying with the terms and conditions set forth in such notice shall be accepted, unless the board of county commissioners rejects all bids because they are too low. The board of county commissioners may require a deposit to be made or a surety bond to be given, in such form or in such amount as the board determines, with each bid submitted. The board of county commissioners may require a deposit to be made or a surety bond to be given, in such form or in such amount as the board determines, with each bid submitted. 461 RESOLUTION NO. -2025 A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA, DECLARING OF PROPERTY KNOWN AS THE RUTH IVINS CENTER LOCATED AT 3333 OVERSEAS HWY., MARATHON, FLORIDA 33050 AS SURPLUS PROPERTY AND THE APPROVAL TO ADVERTISE THE RUTH IVINS CENTER FOR SALE; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, Florida Statute 125.35(1)(c) does not allow for the sale of any real property unless notice is published once a week for at least two weeks in some newspaper of general circulation published within the county,calling for bids for purchase of the real estate so advertised to be sold. In the case of a sale, the bid of the highest bidder complying with the terms and conditions set forth in such notice shall be accepted, unless the board of county commissioners rejects all bids because they are too low. The board of county commissioners may require a deposit to be made or a surety bond to be given, in such form or in such amount as the board determines, with each bid submitted; and WHEREAS, the COUNTY owns an office building known as the Ruth Ivins Center located at 3333 Overseas Highway Marathon, Florida 33050; and WHEREAS, the COUNTY developed and leased the Ruth Ivins Center to the Monroe County Health Department, which is now relocating into another county owned space leaving the Ruth Ivins Center vacated; and WHEREAS, it is in the COUNTY's best interest to declare the property known as the Ruth Ivins Center as surplus property and advertise the property for sale. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA: Section 1: That the foregoing "WHEREAS"clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this resolution. 1 462 Section 2: That the County Commission has approved the resolution to declare the Ruth Ivins building located at 3333 Overseas Highway, Marathon, Florida 33050 as surplus property and . Section 3: That the County Administrator, or designee, is hereby authorized to advertise the sale of the Ruth Ivins Building located at 3333 Overseas Highway,Marathon,Florida 33050. Section 4: That all resolutions or parts of resolutions in conflict with this resolution are hereby rescinded to the extent of such conflict. Section 5: That if any clause, section, other part or application of this resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or in application, it shall not affect the validity of the remaining portion or applications of this resolution. Section 6: That this resolution shall be in full force and effect immediately upon its adoption.
