ITEM BACKGROUND: This grant is for programming, design,permitting and construction. Amendment#6 provides additional funding for the Terminal Concourse A Terminal and Improvements Program. PREVIOUS RELEVANT BOCC ACTION: Approval of original grant contract G2090 on October 20, 2021, Amendment No.l on March 16, 2022, Amendment No. 2 on August 17, 2022, Amendment No. 3 on June 21, 2023, Amendment No. 4 on July 19, 2023, and Amendment No. 5 on August 21, 2024. On September 15, 2021, the BOCC adopted Resolution No. 288-2021 authorizing the Director of Airports to execute FAA and FDOT Airport grants as received to meet deadlines for returning grants to the granting agency and expedite use of grant funds, with grants to be ratified by the BOCC at the next available regularly scheduled commission meeting. WHEREAS, pursuant to the delegation of authority granted under Monroe County Resolution Number 288-2021, the Executive Director of Airports previously executed Florida Department of Transportation (FDOT) Public Transportation Grant Agreement Contract #G2090 and Grant Amendments 1-5, as ratified and approved by the BOCC on 10/20/2021, 03/16/2022, 08/17/2022,06/21/2023,07/19/2023 and 8/21/2024,respectfully; and WHEREAS, pursuant to the delegation of authority granted under Monroe County Resolution Number 288-2021, the Executive Director of Airports has executed Amendment #6 to FDOT Public Transportation Grant Agreement #G2090 to add additional funding for the Concourse A Terminal and Improvements Program; and WHEREAS,under the terms of the grant agreement,FDOT provides 50%of the agreed grant amount and the Key West International Airport enterprise fund provides the matching 50% amount; and WHEREAS, under the terms of Amendment #6 FDOT has offered to increase the amount of its participation in grant agreement contract#G2090 by $10,000,000.00-1 and WHEREAS,the revised total, including the Key West International Airport enterprise fund match, for grant agreement contract#G2090 shall be increased to $78,882,742.00: and WHEREAS,pursuant to Monroe County Resolution Number 288-2021, Grant Agreement Contract#G2090 Amendment #6 is hereby placed on the next available regularly scheduled Board of County Commissioners meeting for ratification. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY,FLORIDA: Section 1. The attached FDOT grant agreement contract #G2090 Amendment #6, as executed by the Executive Director of Airports, increasing FDOT's participation by $10,000,000.00 and bringing the revised total cost of the project to $78,882,742.00 is hereby ratified and approved. Section 2. This Resolution shall become effective immediately upon its adoption. Deliverables for requisition, payment and invoice purposes will be the incremental progress made toward completion of project scope elements. Supporting documentation will be quantifiable, measurable, and verifiable, to allow for a determination of the amount of incremental progress that has been made, and provide evidence that the payment requested is commensurate with the accomplished incremental progress and costs incurred by the Agency. E. Unallowable Costs (including but not limited to): N/A F. Transit Operating Grant Requirements (Transit Only): Transit Operating Grants billed as an operational subsidy will require an expenditure detail report from the Agency that matches the invoice period. The expenditure detail, along with the progress report, will be the required deliverables for Transit Operating Grants. Operating grants may be issued for a term not to exceed three years from execution. The original grant agreement will include funding for year one.
