schedule) for a Total of 86 Affordable Housing Units Consisting of 37 Low Income and 49 Moderate
Income, or Below; to be Constructed at 92503 Overseas Highway in Tavernier Having Parcel ID
Number 00089490-000000.
ITEM BACKGROUND:
Monroe County Code Section 6-108(e) allows BOCC approval of waivers of building permit fees for
affordable housing subject to certain criteria. This request is for building permit fee waivers to construct
the project site including 86 affordable rental housing units, currently proposed as 37 dwelling units at
the 80% of median income level and 49 dwelling units at the 120 % income level and further classified
as 12 one-bedroom, 58 two-bedroom, and 16 three-bedroom units, at 92503 Overseas Highway in
Tavernier having parcel ID number 00089490-000000. Building permit fees requested for waiver are
approximately $189,058. This project consists of more than 10 units and therefore a fifty percent(50%)
waiver of the valuation-based fee categories of the fee schedule may be considered by the board of
county commissioners. Each of the 86 units has a pro rata construction value, based on the multi-unit
buildings, of approximately $232,600.
Monroe County Code Section 6-108 Fees was recently amended through Ordinance No. 014-2025 and
(e) Waivers is shown below.
(e) Waivers. Any entity may apply to the board of county commissioners for fee waivers from the
building permit and building permit application fees for construction of affordable housing intended for
occupancy for households with income up to 120 percent of the median annual adjusted gross income
as defined by Monroe County. All such waivers apply only to permit fees for the housing units being
constructed and not to permits for site work, accessory structures, or infrastructure. There are no other
waivers of permit fees. Waivers shall be available for consideration by the BOCC as follows:
(1) For projects of 10 units or less, a one hundred percent(100%) waiver of the valuation-based fee
categories of the fee schedule may be considered;
(2) For projects of more than 10 units, a fifty percent (50%)waiver of the valuation-based fee categories

of the fee schedule may be considered;
(3)If successive waiver requests are made for phased projects, regardless of whether aggregated for the
purpose of development or not, they shall be considered cumulatively to determine the percent waiver
for which the project is eligible; and
(4)Affordable housing projects developed by a government agency shall be eligible for a one hundred
percent (100%)waiver regardless of project size.
PREVIOUS RELEVANT BOCC ACTION:
On December 11, 2024, the BOCC passed and adopted Resolution No. 548-2024 approving the
reservation of 86 workforce housing early evacuation affordable ROGO allocations for this project.

Scope of Work
New construction of eighty-six (86) affordable workforce multi-family dwelling units in
six buildings. There is total of 12—one-bedroom units, 58—two-bedroom units, and 16—three-
bedroom units. All eighty-six (86) multi-family units will be deed restricted as affordable
workforce dwelling units.
Affordable Unit Income Category Distribution
Thirty-seven(37) dwelling units whose total household income does not exceed 80%AMI
and forty-nine (49) dwelling units whose total household income does not exceed 120% AMI.

20 WHEREAS,on November 18,2009,the Monroe County Board of County Commissioners
21 ("Board") passed and adopted Ordinance 036-2009, allowing building permit fee waivers for
22 entities building low-income housing leveraging state or federal funds, or affordable housing as
23 defined by state statutes; and
24 WHEREAS, on February 10, 2010, the Board passed and adopted Ordinance 004-2010,
25 allowing waivers for housing for households up to 120% of median income in Monroe County.
26 Housing exceeding 120% may also apply for a waiver if the specific project for development is
27 being subsidized with or is leveraging state or federal funding; and
28 WHEREAS, on June 18, 2025, VC Tavernier, LLC, submitted the Application for
29 Building Permit Fee Waiver. The legislative intent of this Resolution is that the instant waiver
30 shall apply to the building permit applicant of record; and
31 WHEREAS, Monroe County Code Section 6-108(e) allows the Board approval for
32 waivers of certain building permit fees for affordable housing. The Applicant of Record is
33 requesting building permit fee waivers totaling approximately $189,058 to construct the project
34 site including 86 (37 low income / 80% of median income and 49 moderate income / 120% of
35 median income, or below)affordable housing units, currently proposed as 12 one bedroom, 58 two
36 bedroom, and 16 three bedroom, at approximately 92503 Overseas Highway currently having
37 parcel ID number 0089490-000000 in Tavernier on Key Largo.

39 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
40 COMMISSIONERS OF MONROE COUNTY, FLORIDA, THAT:
41 The foregoing recitals are true and correct and are hereby incorporated as if fully stated
42 herein; and
43 Building permit fees are waived pursuant to Monroe County Code Section 6-108(e) for
44 each of the 86 affordable housing units described herein with the condition that evidence of an
45 Affordable Housing Deed Restriction accepted and/or approved by both the Senior Director of
46 Planning & Environmental Services and the Office of the County Attorney and recorded in the
47 Public Records of Monroe County, Florida shall be provided to the Building Department.
48 PASSED AND ADOPTED by the Board of County Commissioners of Monroe County,
49 Florida, at a regular meeting held on the 20th day of August, 2025.
