Deady PA for $12,100 for preparation and submittal of a construction grant application for the County's Flagler Avenue Resilience Road adaptation project. ITEM BACKGROUND: Resolution 241-2025 was approved at the July 2025 BOCC meeting to support and authorize the submission of the capital grant application for the Flagler Avenue Resilient Road Adaptation Project that County staff proposes to be submitted under the state Resilient Florida grant program for 2025/26 for construction and CEI services. This Amendment#5 item is to authorize the preparation of the grant application, so it can be submitted by September 1 under the Resilient Florida program. There are $54,165,934 of HMGP funds reserved for this project, which represents a 75% match of the $72,221,112 project cost, leaving a shortfall of$18,055,178. The Resilient Florida program provides up to 50% of the grant funds for capital projects. Staff proposes to submit a grant application to the State for an amount not to exceed $25 Million, which is up to a 35% match. The actual amount of the grant application may vary slightly by the time it is completed, but the request will not exceed $25 Million in Resilient Florida funds.A contract for engineering design and permitting was executed and is underway and scheduled to be completed by June 2026. Flagler Avenue is a main thoroughfare serving the largest population center and tourism hub in the Florida Keys. After a storm, it often becomes the only usable travel route, as the other main avenues, located along the shoreline, are frequently blocked by sand and storm debris. Its central location and reliable access make Flagler Avenue vital to post-storm recovery and everyday mobility. Future elevation of this avenue is critical for public safety and commerce. PREVIOUS RELEVANT BOCC ACTION: July 21, 2021: Discussion and direction in the formulation of a grant application strategy for the "Resilient Florida" grant funds this year. 3715 August 18, 2021: Approval of the proposed grant applications for the "Resilient Florida" grant program. October 19, 2022: Approval of a Federal Emergency Management Agency (FEMA) Hazard Mitigation Grant Program (HMGP) grant award of$120,843.75 passed through as a sub-recipient agreement with the Florida Division of Emergency Management to update the County Watershed Management Plan, plus a $40,281.25 match provided by Resilient Florida Vulnerability Assessment grant 22PLN66, for a total project value of$161,125. January 18, 2023: Authorize planning grant 22PLN66 for $139,350 from the Florida Department of Environmental Protection under the Resilient Florida Grant Program to update the Monroe County Vulnerability Assessment pursuant to Section 380.093, Florida Statutes. April 19, 2023: Approval of a $75,000 Amendment No. 1 to Planning Grant #22PLN66, from the Florida Department of Environmental Protection under the Resilient Florida Grant Program, to conduct neighborhood outreach to obtain feedback while updating the Monroe County Vulnerability Assessment. May 17, 2023: Approval of Modification # 1 to Federal Emergency Management Agency (FEMA) Hazard Mitigation Grant Program (HMGP) Subgrant Agreement #H0856 with Florida Division of Emergency Management to develop Watershed Management Plans for Layton, Key Colony Beach and Marathon, increasing federal funding by $399,506.25 and bringing the total grant amount to $693,800. The 25% match will be provided by Resilient Florida Vulnerability Assessment Grants #22PLN65 (Marathon) and#23PLN97 (Layton/Key Colony Beach). No County funds are expended for this work. May 17, 2023: Approval to enter into a $734,700 contract with Erin L. Deady PA for consulting services to provide Watershed Management Plans for Monroe County, Layton, Key Colony Beach and Marathon as funded by Florida Division of Emergency Management (FDEM) Grants #H0856 and #H0856-Al and a vulnerability assessment update and neighborhood outreach for Monroe County as funded Florida Department of Environmental Protection(FDEP) Grants #22PLN66 and#22PLN66-Al. Payments will be a lump sum. Partial payments of tasks and deliverables shall be allowed for any item over$5,000. The CONSULTANT shall submit to the COUNTY an invoice with supporting documentation in a form acceptable to the Office of Monroe County Clerk & Comptroller (Clerk), Acceptability to the Clerk is based on generally accepted accounting principles and such laws, rules and regulations as may govern the Clerk's disbursal of funds. The Sustainability Director will review the request, note her approval of the request and forward it to the Clerk for payment. Such application shall include detailed cost benefit analysis, a nature-based stormwater solution, construction and CFI oversight. The Flagler Avenue roadway is being reconstructed to provide a roadway system able to withstand the increasing levels of ground and tidal waters, installation of a new drainage :system, the construction of a more stable roadway foundation and the facilitation of necessary utility adjustments. The roadways will be reconstructed to provide a more stable roadway foundation, utility adjustments, and a roadway elevation systern able to withstand the increasing water flooding, including from tidal and rain events.
