Closed Sessions This Month
1. Stacey Mitchell v. Monroe County et al, 24-CA-890-K._Plaintiff sued the County, BOCC,
TDC, and 3406 N. Roosevelt Bvld. Corp. (3406) alleging Whistleblower violations.
Council. The County and 3406's motions to dismiss are set to be heard on 9/8/25.
2. Perla DeMillerv. Monroe County, 25-CA-849-K. Auto Liability case related to a year-
end accident involving a County vehicle from July 2024. Plaintiff filed suit on
7/24/25 and issued discovery requests with their Initial Complaint. Suit has not
yet been served on BOCC. Risk Management has engaged in preliminary
discussions with Plaintiffs' counsel for potential early resolution of this case.
3. Monroe County v. NGM Insurance Company, 25-CA-538-M. On 5/9/25, the County
sued surety contract for breach of performance bond relating to the Seaview Bridge
Project in Duck Key. The County is seeking damages, including but not limited to the
cost of completing the project, additional financing costs, and liquidated damages. The
case is now in the discovery phase, which must be completed by 10/10/25. Both
sides propounded discovery on 8/18/25. The County served Request for
Production, Request for Admissions and Interrogatories on the Defendant.
Responses are due 9/17/25. Projected trial date begins @ 3/16/26.
Trial Court Cases of Interest
4. Monroe County v. Mark Schofield, 18-CA-217-P. Foreclosure action stemming from
Code Compliance Case CE10040067. Monroe County has a Judgment of
Foreclosure. Board declined to give direction regarding Schofield's latest settlement
offer at 4/16/25 BOCC meeting. Schofield filed for bankruptcy on 7/31/25, case
number 25-18841-CLC in the Southern District of Florida. The bankruptcy court
dismissed the petition during a hearing held on 8/26/25 as a bad faith filing.
Foreclosure sale reset for 10/10/25 at 11 am.

5. 2014 Janet Vincent Family Trust, et al., v. Monroe County, 24CA332K. Plaintiffs are
seeking declaratory judgment regarding a parcel of land abutting their properties that
the property should revert to their ownership. A bench trial was held on 6/17/25.
Written closing arguments were submitted on 8/1/25. A ruling is expected by 11/1/25.
6. In re: Silver Airways LLC, US Bankruptcy Court, S.D.Fla., 24-23623, Chapter 11
petition for reorganization filed by Silver. County Attorney's Office is assisting outside
counsel. Auction of Silver's assets took place 5/28/25 On 7/24/25 the court granted
the Chapter 11 Trustee's motion and entered an order converting the case to Chapter
7 proceedings. On 7/31/25 the court granted the Trustee's motion to establish an
administrative claims bar date and set the bar date as 30 days from the entry of
the order for administrative claims. Filing deadline for all non-governmental
creditors to file a proof of claim has been noticed as 10/6/25 and the filing
deadline for government creditors to file a proof of claim has been set as 1/26/26.
7. F.E.B. Corp. v. Monroe County & FDEP, DEP OGC Case No.: 24-1615 (DEP Permit
No. 44-0137939-029-EG). Petitioner F.E.B. Corp., challenges FDEP's permit to the
County that establishes a public mooring field at Man of War Harbor in Key
West. FDEP has yet to refer the matter to the Division of Administrative Hearings
(DOAH). The final hearing is scheduled for 11/17/25 - 11/20/25. The County filed a
Motion to Dismiss and Strike and Notice of Intent to Seek Attorneys' Fees on 8/1/25 to
which F.E.B. responded. On 8/20/25 F.E.B. filed a Motion to Disqualify Counsel.
The County's Response is due 8/27/25.
8. Massacci, et al. v. Monroe County, et al., 24-CA-566-K. Personal injury lawsuit by the
personal representative of the estate of Kirk Weidericht against the County, FDOT, Big
Pine Academy and Rubi Metass for the injuries and subsequent death of Mr.
Weidericht who was riding his motorcycle on or near Dear Run Trail when he was
struck by the driver (Metass). The Plaintiff has added Webber Infrastructure
Management, Inc as an additional defendant in the case. The County has
answered. Plaintiff filed an amended Reply and General Denial of Affirmative
Defenses in light of the Amended Complaint. Discovery is ongoing. Deposition of
Plaintiff Jennifer Massacci was conducted on 06/13/25. Plaintiff's counsel has
agreed to dismiss Monroe County from the lawsuit. A Joint Stipulation for
Dismissal has been circulated for counsels' signature as of 8/25/25
9. Mitchell Kukulski v. Biltmore Construction and Monroe County, 24-CA-302-P. Plaintiffs
alleges that he was injured when he tripped and fell in one of the medians in the parking
lot outside the Plantation Key courthouse. The courthouse was under construction at
the time. The County filed an answer and a cross-complaint for indemnification against
the contractor Biltmore Construction. Discovery is ongoing. A pretrial conference was
held on 4/1/25. Biltmore has agreed to provide coverage without reservation of rights.
Mediation was held on 07/10/25, but was unsuccessful. Biltmore &the County's motion
for summary judgment will be heard on 10/21/25.
10.Jay Archbell PA v. Buirley, Monroe County, et al., 23-CA-108-K. The County
previously settled its claim against Jay Archbell, PA (the property owner) for a
reduced amount of code liens. The property (3 El Monte Lane, Big Coppitt) appears
to have some owners outside the chain of title. Archbell then sued prior owners
Kenneth and Anita Lynn Buirley, the County, and others, to quiet title. The Plaintiff
has filed a Motion for Summary Judgment and is currently conferring with
counsel to set a date for the hearing. 7298
11.John Behmke et al. v. Monroe County, 24-CA-94-K. Plaintiffs are/were property
owners in Coral Hammock and allege inverse condemnation based on their inability to
conduct vacation rentals beginning in 2016, when code compliance cited them for
renting in a land use district that prohibited vacation rentals (the Third DCA affirmed a
decision of the Circuit Court finding the Mixed-Use District does not prohibit vacation
rentals of attached units and reversing orders of the code compliance special
magistrate finding the properties in violation). Plaintiffs seek compensation for takings,
as well as lost rental income and other financial damages. The County's motion to
dismiss will be heard on 9/12/25.
12.BOCC v. SGC Land Trust 2/12/2020, Sunset Gardens Farm, LLC, and FMC
Management, Inc., 25-CA-151-P. On 2/7/25, the County sued for declaratory and
injunctive relief against the defendants which operate an alleged farm on illegally
landcleared property. The County is seeking a declaration that the farm is in violation
of over a dozen ordinances, Comprehensive Plan policies, and statutes and seeks to
enjoin those violations and demand corrective action. On 6/2/25 the County voluntarily
dismissed the three individually named DFs from the lawsuit. The County's motion for
preliminary injunction is set to be heard on 9/3/25.
13. BOCC v. Sunset Garden Estate Land Trust 2/10/2014, et al., 25-CA-738-P. On 7/1/25
the County sued for declaratory and injunctive relief against the defendants, who have
illegally landcleared and engaged in illegal construction and various illegal uses on the
property. The County is seeking a declaration that the owners are in violation of over
a dozen ordinances, Comprehensive Plan policies, and statutes and seeks to enjoin
those violations and demand corrective action. On 7/7/25 Summonses were issued for
all of the Defendants and the County is in the process of obtaining service upon each
of the Defendants. On 8/16/25 the County served the Defendants.
14.Garcia Jr., Pablo v. Monroe County BOCC, American Sports Federation, LLC, 24-CA-
32-P. On 06/01/2023, Plaintiff was injured during a softball game hosted by Defendant
American Sports Federation, LLC ('ASF') when he allegedly struck his wrist on a
sprinkler head while diving for a ball in the outfield. ASF was operating under an
approved Use of Property with hold harmless agreement but failed to maintain
appropriate insurance coverage for the event so Risk's demand for defense and
indemnity was denied by both ASF and their insurance carrier. Discovery Requests
were issued to Monroe County by Co-Defendant American Sports Federation on
8/13/25 and are due 9/12/25. Plaintiff filed Notice Ready for Trial on 8/22/25.
15.Roy's Trailer Park, Inc. et al. v. Monroe County, 19-CA-175-K. Declaratory Judgment
suit filed by Roy's against County as part of its eviction suit against its
tenants. County counterclaim against the park and the park residents, seeking an
injunction prohibiting occupancy at the park until serious fire and life safety issues
have been addressed, appointment of a receiver, and declaratory relief to determine
whether the owner or tenants are responsible for the code violations. The Court
granted Roy's and Tenants' Motion to Dismiss for lack of subject matter jurisdiction.
County's Motion for Rehearing filed 2/26/25.

16.Monroe County v. Winifred Shosie, 22-CA-432-K. Injunctive action stemming from
Code Compliance Case CE19060049. At the pre-trial conference on 5/23/25, the
Court entered a Default Judgment in favor of the County. Final Judgment was issued
5/27/25. Defendant has filed a Notice of Appeal to the Third DCA.
17.Galleon Bay v. Monroe County, 02-CA-595-K. On 7/21/25, Galleon Bay filed a motion
for summary judgment alleging the Clerk miscalculated the interest on the judgment
paid by the County and State and seeking to collect the additional amount. A response
to the motion is due on 9/2/25.
18.Farzan Home Designs v. Monroe County, 25-CA-883-K. Suit stemming from code
compliance case. Owner has demanded monetary damages related to the
demolition and rebuild of a home subjected to Hurricane Irma substantial
damage letter. Suit was filed on 8/1/25, but has not yet been served on BOCC.
19.Billy Sunday Jones v. Monroe County, 25-CA-785-P. Suit stemming from code
compliance case about unpermitted structures. Owner sued for declaratory
judgment regarding his rights over the affected property. Suit was filed on
7/16/25 and on 8/11/25. County's answer due 9/10/25.
20.Joshua Dreschel v. Monroe County, 25-CA-849-K. Suit stemming from code
compliance case. Owner seeks declaratory judgment quashing Final Order
Imposing Lien, alleging improper service of hearing notices. Owner has also
initiated appeal of this order in 25-AP-11-K. Suit was served on BOCC on
8/12/25. County's response to Initial Complaint is due 9/11/25
Appellate Cases
21.Maschal et al. v. Monroe County and FKAA, 19-CA-186-K/3D2025-0574. Suit by 12
individuals seeking similar relief to the Delaney lawsuit, which the County and FKAA
won. The County and FKAA answered and counter sued for injunctive relief,
compelling the property owner plaintiffs to connect to the system. On 1/28/25, the
Court granted the County & FKAA's motion for summary judgment and entered a final
judgment on 6/6/25. The property owners brief is due 9/22/25.
22. Kearns Construction Company v. Monroe County, 24-CA-1134-M/3D2025-1586. This
action is a Petition for Writ of Certiorari seeking to quash the BOCC's award of the
contract for RFP-568 Artificial Reef Materials Deployment to Gulfside 10-Mile Reef. On
6/27/25, the Court ruled the BOCC should award the contract to Kearns. The Court
denied the County's motion for rehearing and clarification. The County filed a
Petition for Writ of Certiorari on 8/18/25. Kearns must answer the Writ by 9/18/25.

23.Dalk Land, L.P. v. Monroe County Building Department, DOAH 25-1345. Dalk Land
has appealed a certificate of occupancy issued to its neighbor (Peter Giampaoli) on
basis of alleged floodplain regulation violations to the Division of Administrative
Hearings. Briefing was completed 6/13/25. Both Monroe County and Giampaoli have
filed motions to dismiss the appeal. Oral argument is scheduled for 9/26/25.
24.Cayo Hueso Investments, Inc. v. Monroe County, DOAH Case 24-2250-GM/3D2025-
0643. Cayo Hueso, an adjacent property owner, filed a petition challenging the
County's amendments of the Land Development Code (zoning) and Comprehensive
Plan (Future Land Use Map/FLUM) in order to allow a shoreside facility for the
proposed mooring field in Boca Chica Harbor. On 12/13/24, the ALJ entered a
Recommended Order affirming the correctness of the County's actions. On 3/17/25,
FloridaCommerce issued a final order findings the amendments consistent with
statutes and the comprehensive plan. On 4/11/25, Cayo Hueso appealed the final
order to the Third DCA. Cayo Hueso initial brief is due on 9/17/25.
25.John Kuluz, etal v. Monroe County & 17RM Investments, LLC, 21 CA357P/3D25-500.
Plaintiffs (neighbors) are the owners of property near 17RM's Key Largo property. The
Neighbors sought a declaratory judgment against the County's determination that a
20-foot front-yard setback does not apply, under the Land Development Code, to
17RM's property on the basis that it is fronted by a private access easement. The Court
granted the County's and 17RM's motion for summary judgment then entered final
judgment in favor of the County and 17RM on 11/27/24. On 3/14/25, the neighbors
appealed to the Third DCA. The Neighbors filed their initial brief on 6/12/25. The
County Answer Brief is due by 9/10/25.
26.Robert W. Leaver v. Monroe County, 25-AP-004-K. Owner appealed an Order
Authorizing Foreclosure and/or Money Judgment. Owner argues that the final order is
erroneous because the code investigation & prosecution was based on an anonymous
complaint, despite not having appealed the underlying Order finding violations of MCC
6-100(a) for unpermitted work. The County filed an answer brief on 8/1/25.
27.601 Cuda Properties, LLC v. Monroe County & SFWMD, Case No. 3D24-118 (L.T.
Case No. 2023-066-DAO-ERP) and 3D24-2101 (L.T. Case No.2024-086-DAO-
ERP). 601 Cuda Properties, LLC, has filed an appeal from a SFWMD Order
dismissing 601 Cuda's petition for a formal administrative proceeding on the grounds
that the petition was untimely. 601 Cuda's petition opposed the Environmental
Resource Permit that was issued to the County on 11/17/23, authorizing the use of
sovereign submerged lands to repair the Rock Harbor Breakwater and install an air
bubble curtain and seaweed gate. On 10/16/24, the property owner filed an amended
petition, which was denied by the District on 10/29/24. On 11/21/24, the property
owner appealed the denial to the 3rd DCA. SFWMD & County's briefs are due
9/10/25.
28.Key Largo Beautification, Inc. v. Monroe County, 24-CA-1077-P/3D24-2193. Owner
appealed dismissal of their petition for a writ of mandamus requesting the Circuit Court
to force the County to replat property in Key Largo (MM 98.7). The Owner filed its
initial brief on 8/14/25. The County's Answer Brief is due 9/15/25.

29.Shands v. City of Marathon, 3D21-1987. This is a long running takings case involving
an offshore island located within the City of Marathon. On 2/5/25, the Third DCA
issued a decision that created a new category of taking (an
"as-applied categorical taking") and vitiated the use of TDRs to avoid takings,
suggesting an owner must be provided a utilitarian physical use of their property. On
6/12/25, the City filed a notice to invoke discretionary jurisdiction in the Florida
Supreme Court. On 6/16/25, the County filed its notice of intent to file an amicus brief
in support of the City should the court accept jurisdiction. Additional amicus include
the Florida Association of County Attorneys and 1,000 Friends of Florida The City
filed its brief on jurisdiction on 6/20/25. Reply brief of respondents filed 7/29/25.
30.Monroe County v. Denise Joy Snyder Living Trust, 3D25-0979. Owner filed an appeal
of the Code Compliance Special Magistrate's final order finding them in violation of the
code for RV storage and u nperm itted/u n restored land clearing and imposing fines and
restoration requirements. On 4/20/25, the Court affirmed the Special Magistrate's
order for the RV storage violation but reversed the land clearing violations because the
property owner relied on the "pruning, trimming, or removal of a tree" permit exception
of FS 163.045 and submitted an affidavit from an arborist that the trees on the vacant
residential lot created a hazard to life and property. The Court rejected the Special
Magistrate's finding that the pre-amended version of FS 163.045 that applied at the
time of clearing did not apply to vacant undeveloped property. The County sought
certiorari review in the Third DCA. The owner's response is due 9/11/25.
31.Pirates Saving Paradise Inc. v. Monroe County, Planning & Environmental Resources
Department File No. 2025-110. On 5/28/25 PSP appealed to the Planning Commission
the Planning & Environmental Resources Department Senior Director's 5/6/25
approval of an application for a Minor Deviation to a Major Conditional Use Permit
regarding a parcel on Little Torch Key. This appeal is set to be heard on 8/27/25.
32.Swift Eddy Corp. v. Monroe County, Planning & Environmental Resources Department
File No. 2025-113. On 5/23/25 owner appealed a 4/23/25-issued Letter of
Understanding regarding its property on Big Coppitt to the Planning Commission. The
appeal will be heard a future Planning Commission meeting.
33.Raymond Vazquez v. Monroe County, Planning & Environmental Resources
Department File No. 2025-108. On 5/21/25, a Sugarloaf property owner filed an
application to appeal a determination requiring removal of an invasive exotic melaleuca
tree. The Owners' appeal application remains pending and incomplete due to their
failure to state a basis for the appeal.
34.Lazaro & Beatriz Miguez Arango v. Monroe County, Planning & Environmental
Resources Department File No. 2025-109. On 5/28/25 owners of a parcel near MM
104 appealed a decision to fail a dock permit application based on the determination
that it fails comply with the Land Development Code Section 118-12 ("Shoreline
Setback— Docking Facilities"). The Owners' appeal application remains pending and
incomplete due to their failure to file an initial brief.

35.Key Haven v. Florida DOT & DEO, 1 D2025-0660. The property owner sued the State
alleging a regulatory taking of its five (5) mostly submerged lots in the Key Haven
subdivision based on the State's denial of resource permits to fill the lots. Although
the County was previously dismissed as a party below, it is seeking amicus status.
Key Haven has appealed in the 1st DCA the trial court's 2/16/25 Final Summary
Judgment in favor of the State. Its initial brief was filed on 8/19/25. The State has
requested an extension until 12/17/25 to file its answer brief. The County will be
filing an amicus brief in support of the State.
Class Action Lawsuits where Monroe County is a Party
36.Monroe County v. 3M, et al., 22-CA-618-K/2:22-cv-03680-RMG, consolidated into
2:18-mn-02873-RMG: On 9/9/2022, Monroe County filed suit against manufacturers
of aqueous film-forming foam (AFFF) containing per- and polyfluoroalkyl substances
(PFAS) to recover damages for investigation, remediation, removal, disposal,
treatment and monitoring of water and soil created by defendants' products. PFAS
had been detected at the Monroe County Fire Training Academy on Grassy Key. On
10/7/22, defendants removed the case to the U.S. District Court for the Southern
District of Florida. On 10/26/22, the County's case was transferred and consolidated
with other similar cases in the Multi District Litigation (MDL) case pending in the District
of South Carolina before Hon. Richard M. Gergel.
Constitutional Officer Cases
37.Lissette Carey v. Sherrie Hodies, Supervisor of Elections, et al, 25-CA-843-K. KW City
Commissioner Lissette Carey filed suit on 7/30/25 challenging the effort to initiate a
recall election against her. The County Attorney's Office is defending the Supervisor
of Elections, who is a necessary party. Also named are the City, City Clerk Keri
O'Brien, and James Strebek, the chair of the recall committee. Carey has filed an
Emergency Motion for Permanent Injunction and Declaratory Relief and requested that
the matter be handled on an expedited basis. On 8/5/25, the Supervisor filed a
response to Carey's Emergency Motion for Permanent Injunction and Declaratory
Relief. On 8/8/25, the Supervisor found that the recall committee failed to timely
submit the required number of signatures to proceed with the recall process
then filed a suggestion of mootness on 8/11/25. The case was reassigned to
Judge Helms on 8/11/25. Carey dismissed the Supervisor and Clerk on 8/12/25;
the file remains open in case the recall petitioners file new petitions.
38.The Supervisor of Elections is currently involved in several additional litigation matters
that have been brought against all 67 SOE's. The cases challenge various Florida
Statutes regarding election legislation and voter registration. Supervisor Hodies and
other SOEs retained outside counsel, but the County Attorney's office is assisting in
the defense of each case. Three older cases remain pending awaiting final resolutions
by the Courts. A new case was filed on 5/4/25, which challenges the constitutionality
of HB 1205 passed by the Legislature this year to regulate the initiative-petition
process:

A) Florida Decides Healthcare, Inc., et al v. Sec'y of State Cord, Sherri Hodies,
et al, 4:25cv211-MW/MAF, USDC/NDFL. Three additional groups and one
individual have filed to intervene as Plaintiffs and the Republican Party of
Florida filed to intervene as a Defendant. The Court held a hearing on
5/22/25 on Plaintiff's Motion for an Injunction and denied all claims except
one of Plaintiff Jordan Simmons's vagueness claim challenging the
expanded definition of "racketeering activity." The original Plaintiff filed a
second Motion for Preliminary Injunction on 5/30/25, and other Plaintiffs
followed with similar additional Motions, which do seek relief from the
SOEs, and a hearing was held on 6/30/25. The Court denied the injunctions
in part and granted in part. The Court entered another Order on Motions
for Preliminary Injunction on 8/21/25, which applied only to certain
counties, but Monroe County is not affected by the Order.
Foreclosure Actions
39.The County Attorney's Office is currently prosecuting 24 cases to foreclose or
otherwise enforce on County code compliance liens. The Office is also currently
defending 7 mortgage foreclosure cases, where the County holds an interest in the
property, usually as a result of an inferior code compliance lien.
Other Matters of Interest
40.Code Collections. Due to the early agenda deadline, the monthly report for August is
not yet available. Fines and costs for August and September will be provided in the
next report.
41.Vacation Rental Prosecutions. Due to the early agenda deadline, the August Code
Compliance hearing has not yet taken place. Information for the August hearing will
be provided in the next report.
