Plaintiff sued the County, BOCC, TDC, and 3406 N. Roosevelt Blvd. Corp. (3406) alleging Whistleblower violations. The were heard on 9/8/25. The Court dismissed 10/13/25. 2. Perla DeMiller v. Monroe County, 25-CA-849-K. Auto Liability case related to a rear- end accident involving a County vehicle from July 2024. Plaintiff filed suit on 7/24/25 and issued discovery requests with their Initial Complaint. The County was served with a copy of the complaint on 9/23/25. 3. 2014 Janet Vincent Family Trust, et al., v. Monroe County, 24CA332K. Plaintiffs are seeking declaratory judgment regarding a parcel of land abutting their properties that the property should revert to their ownership. A bench trial was held on 6/17/25. Written closing arguments were submitted on 8/1/25. favor, the deadline for Plaintiff to file Notice of Rehearing is 10/2/25 and the appeal deadline is 10/17/25. 4. In re: Silver Airways LLC, US Bankruptcy Court, S.D.Fla., 24-23623, Chapter 11 . On 7/24/25, the court granted an order converting the case to Chapter 7 proceedings. On 7/31/25, administrative claims bar date and set the bar date as 30 days from the entry of the order for administrative claims. Filing deadline for all non-governmental creditors to file a proof of claim has been noticed as 10/6/25 and the filing deadline for government creditors to file a proof of claim has been set as 1/26/26. 5222 5. Monroe County v. Mark Schofield, 18-CA-217-P. Foreclosure action stemming from Code Compliance Case CE10040067. Monroe County has a Judgment of offer at 4/16/25 BOCC meeting. Schofield filed for bankruptcy on 7/31/25, case number 25-18841-CLC in the Southern District of Florida. The bankruptcy court dismissed the petition during a hearing held on 8/26/25 as a bad faith filing. Foreclosure sale reset for 10/10/25 at 11 am. 6. F.E.B. Corp. v. Monroe County & FDEP, DEP OGC Case No.: 24-1615 (DEP Permit No. 44-0137939-029-EG). County that establishes a public mooring field at Man of War Harbor in Key West. FDEP has yet to refer the matter to the Division of Administrative Hearings (DOAH). The final hearing is scheduled for 11/17/25 - 11/20/25. The County filed a to which F.E.B. responded. On 8/20/25 F.E.B. filed a Motion to Disqualify Counsel. The County filed its Response on 8/27/25. The hearing on the Motion to Disqualify and Response is set for 11/19/25-11/20/25. 7. Massacci, et al. v. Monroe County, et al., 24-CA-566-K. Personal injury lawsuit by the personal representative of the estate of Kirk Weidericht against the County, FDOT, Big Pine Academy and Rubi Metass for the injuries and subsequent death of Mr. Weidericht who was riding his motorcycle on or near Dear Run Trail when he was struck by the driver (Metass). The Plaintiff has added Webber Infrastructure Management, Inc as an additional defendant in the case. The County has answered. Plaintiff filed an amended Reply and General Denial of Affirmative Defenses in light of the Amended Complaint. Discovery is ongoing. Deposition of Plaintiff Jennifer Massacci was conducted on 06/13/25. The county has been dismissed as a party to the case. 8. Mitchell Kukulski v. Biltmore Construction and Monroe County, 24-CA-302-P. Plaintiffs alleges that he was injured when he tripped and fell in one of the medians in the parking lot outside the Plantation Key courthouse. The courthouse was under construction at the time. The County filed an answer and a cross-complaint for indemnification against the contractor Biltmore Construction. Discovery is ongoing. A pretrial conference was held on 4/1/25. Biltmore has agreed to provide coverage without reservation of rights. Mediation was held on 07/10/25, but was unsuccessf for summary judgment will be heard on 10/21/25. 9. -CA-175-K. Declaratory Judgment suit filed by Roy's against County as part of its eviction suit against its tenants. County counterclaim against the park and the park residents, seeking an injunction prohibiting occupancy at the park until serious fire and life safety issues have been addressed, appointment of a receiver, and declaratory relief to determine whether the owner or tenants are responsible for the code violations. The Court granted Motion to Dismiss for lack of subject matter jurisdiction. CountyMotion for Rehearing filed 2/26/25. to the motion for rehearing are due 9/29/25. 5223 10. John Behmke et al. v. Monroe County, 24-CA-94-K. Plaintiffs are/were property owners in Coral Hammock and allege inverse condemnation based on their inability to conduct vacation rentals beginning in 2016, when code compliance cited them for renting in a land use district that prohibited vacation rentals (the Third DCA affirmed a decision of the Circuit Court finding the Mixed-Use District does not prohibit vacation rentals of attached units and reversing orders of the code compliance special magistrate finding the properties in violation). Plaintiffs seek compensation for takings, as well as lost rental income and other financial damages. The Court denied the after a hearing on 9/12/25. the amended complaint is due on 10/14/25. 11. Monroe County v. NGM Insurance Company, 25-CA-538-M. On 5/9/25, the County sued for breach of performance bond relating to the Seaview Bridge Project in Duck Key. The County is seeking damages, including but not limited to the cost of completing the project, additional financing costs, and liquidated damages. On 5/15/25, the defendant accepted service. The surety filed its answer and affirmative defense on Disclosure was filed on 7/15/25. The case is now in the discovery phase. Both sides propounded discovery on 8/18/25. The County served Request for Production, Request for Admissions and Interrogatories on the Defendant. Responses are due 9/17/25. The Defendant filed their Objections and Responses to Request for Admissions on 9/25/25. Discovery is ongoing. 12. Jay Archbell PA v. Buirley, Monroe County, et al., 23-CA-108- previously settled its claim against Jay Archbell, PA (the property owner) for a reduced ued prior owners Kenneth and Anita Lynn Buirley, the County, and others, to quiet title. Summary Judgment quieting title was entered 9/24/25. 13. BOCC v. SGC Land Trust 2/12/2020, Sunset Gardens Farm, LLC, and FMC Management, Inc., 25-CA-151-P. On 2/7/25, the County sued for declaratory and injunctive relief against the defendants which operate an alleged farm on illegally landcleared property. The County is seeking a declaration that the farm is in violation of over a dozen ordinances, Comprehensive Plan policies, and statutes and seeks to enjoin those violations and demand corrective action. On 6/2/25, the County voluntarily dismissed the three individually named DFs from the lawsuit. The Court liminary injunction on 9/3/25 and reserved ruling on it until it has an opportunity to decide on motions in the DFs separate lawsuit (Case No. 2023-CA-000347) against the Monroe County Property e Court will hear those motions at 9 A.M. on 11/4/25. 14. BOCC v. Sunset Garden Estate Land Trust 2/10/2014, et al., 25-CA-738-P. On 7/1/25 the County sued for declaratory and injunctive relief against the defendants, who have illegally landcleared and engaged in illegal construction and various illegal uses on the property. The County is seeking a declaration that the owners are in violation of over a dozen ordinances, Comprehensive Plan policies, and statutes and seeks to enjoin those violations and demand corrective action. On 7/7/25 Summonses were issued for all of the Defendants and the County is in the process of obtaining service upon each of the Defendants. On 8/16/25 the County served the Defendants. 5224 15. Garcia Jr., Pablo v. Monroe County BOCC, American Sports Federation, LLC, 24-CA- 32-P. On 06/01/2023, Plaintiff was injured during a softball game hosted by Defendant sprinkler head while diving for a ball in the outfield. ASF was operating under an approved Use of Property with hold harmless agreement but failed to maintain appropriate insurance coverage for the event so indemnity was denied by both ASF and their insurance carrier. Discovery Requests were issued to Monroe County by Co-Defendant American Sports Federation on 8/13/25 and are due 9/12/25. Plaintiff filed Notice Ready for Trial on 8/22/25. 16. Monroe County v. Winifred Shosie, 22-CA-432-K. Injunctive action stemming from Code Compliance Case CE19060049. At the pre-trial conference on 5/23/25, the Court entered a Default Judgment in favor of the County. Final Judgment was issued 5/27/25. Defendant has filed a Notice of Appeal to the Third DCA. 17. Galleon Bay v. Monroe County, 02-CA-595-K. On 7/21/25, Galleon Bay filed a motion for summary judgment alleging the Clerk miscalculated the interest on the judgment paid by the County and State and seeking to collect the additional amount. The County filed its response on 8/26/25. 18. Farzan Home Designs v. Monroe County, 25-CA-883-K. Suit stemming from code compliance case. Owner has demanded monetary damages related to the demolition and rebuild of a home subjected to Hurricane Irma substantial damage letter. Suit was filed on 8/1/25, but has not yet been served on BOCC. 19. Billy Sunday Jones v. Monroe County, 25-CA-785-P. Complaint arises from code compliance case finding owner in violation for unpermitted work on residential property. about unpermitted structures. Owner is seeking a sued for declaratory judgment regarding his property rights and seeking compensation for inverse condemnation. over the affected property. Suit was filed on 7/16/25 and on 8/11/25. County filed a motion to dismiss on 9/25/25. 20. Joshua Dreschel v. Monroe County, 25-CA-849-K. Suit stemming from code compliance case. Owner seeks declaratory judgment quashing Final Order Imposing Lien, alleging improper service of hearing notices. Owner has also initiated appeal of this order in 25-AP-11-K. Suit was served on BOCC on 8/12/25. answer was filed 8/29/25. 21. Monroe County v. Phoenix Holdings, 22-CA-324-P. Suit stemming from code compliance case, which Monroe County has filed to enforce its lien and compliance. Dismiss held 9/24/25, motion was denied. Hearing on Motion for Summary Judgment set for 11/6/25. Trial set for week of 11/17/25. Appellate Cases 22. Maschal et al. v. Monroe County and FKAA, 19-CA-186-K/3D2025-0574. Suit by 12 individuals seeking similar relief to the Delaney lawsuit, which the County and FKAA won. The County and FKAA answered and counter sued for injunctive relief, compelling the property owner plaintiffs to connect to the system. On 1/28/25, the 5225 Court judgment on 6/6/25. The property owners brief is due 9/27/25. 23. Kearns Construction Company v. Monroe County, 24-CA-1134-M/3D2025-1586. This action is a Petition for Writ of contract for RFP-568 Artificial Reef Materials Deployment to Gulfside 10-Mile Reef. On 6/27/25, the Court ruled the BOCC should award the contract to Kearns. The Court ring and clarification. The County filed a Petition for Writ of Certiorari on 8/18/25. Kearns must answer the Writ by 10/17/25. 5226 24. Dalk Land, L.P. v. Monroe County Building Department, DOAH 25-1345. Dalk Land has appealed a certificate of occupancy issued to its neighbor (Peter Giampaoli) on basis of alleged floodplain regulation violations to the Division of Administrative Hearings. Briefing was completed 6/13/25. Both Monroe County and Giampaoli have filed motions to dismiss the appeal. Oral argument was held 9/26/25. Proposed orders will be due 30 days from the date of filing of the transcript from oral argument. 25. Cayo Hueso Investments, Inc. v. Monroe County, DOAH Case 24-2250-GM/3D2025- 0643. Cayo Hueso, an adjacent property owner, filed a petition challenging the County's amendments of the Land Development Code (zoning) and Comprehensive Plan (Future Land Use Map/FLUM) in order to allow a shoreside facility for the proposed mooring field in Boca Chica Harbor. On 12/13/24, the ALJ entered a Re On 3/17/25, FloridaCommerce issued a final order finding the amendments consistent with statutes and the comprehensive plan. On 4/11/25, Cayo Hueso appealed the final order to the Third DCA. is due on 10/27/25. 26. John Kuluz, etal v. Monroe County & 17RM Investments, LLC, 21-CA-357-P/3D25- 500. Key Largo property. a 20-foot front-yard setback does not apply, under the Land Development Code, to sement. The Court judgment in favor of the County and 17RM on 11/27/24. On 3/14/25, the neighbors appealed to the Third DCA. The Neighbors filed their initial brief on 6/12/25. The 10/15/25.T 27. Robert W. Leaver v. Monroe County, 25-AP-004-K. Owner appealed an Order Authorizing Foreclosure and/or Money Judgment. Owner argues that the final order is erroneous because the code investigation & prosecution was based on an anonymous complaint, despite not having appealed the underlying Order finding violations of MCC 6-100(a) for unpermitted work. The County filed an answer brief on 8/1/25. 28. 601 Cuda Properties, LLC v. Monroe County & SFWMD, Case No. 3D24-118 (L.T. Case No. 2023-066-DAO-ERP) and 3D24-2101 (L.T. Case No.2024-086-DAO- ERP). 601 Cuda Properties, LLC, has filed an appeal from a SFWMD Order that the petition was untimely. Resource Permit that was issued to the County on 11/17/23, authorizing the use of sovereign submerged lands to repair the Rock Harbor Breakwater and install an air bubble curtain and seaweed gate. On 10/16/24, the property owner filed an amended petition, which was denied by the District on 10/29/24. On 11/21/24, the property rd owner appealed the denial to the 3 DCA. On 1/21/25, the property owner filed a Notice of Agreed Extension of Time to file its Initial Brief 57 days to 3/28/25. On 3/25/25, the property owner filed a Notice of Agreed Extension of Time to file its Initial Brief 31 days to 4/28/25. On 4/25/25, the property owner filed a Notice of Agreed Extension of Time to file its Initial Brief 15 days to 5/13/25. On 5/13/25, the property owner filed its Initial Brief. On 5/28/25, Appellee, SFWMD filed a 5227 Notice of Agreed Extension of Time to File its Answer Brief 90 days to 9/10/25. On 9/09/25, Appellee, SFWMD filed its Answer Brief. On 9/09/25, Appellee, Monroe County filed a Notice of Joinder joining the Answer Brief of Appellee, SFWMD. 29. Key Largo Beautification, Inc. v. Monroe County, 24-CA-1077-P/3D24-2193. Owner appealed dismissal of their petition for a writ of mandamus requesting the Circuit Court to force the County to replat property in Key Largo (MM 98.7). The Owner filed its initial brief on 8/14/25. 10/13/25. 30. Shands v. City of Marathon, 3D21-1987. This is a long running takings case involving an offshore island located within the City of Marathon. On 2/5/25, the Third DCA issued a decision that created a new category of taking (an -nd vitiated the use of TDRs to avoid takings, suggesting an owner must be provided a utilitarian physical use of their property. On 6/12/25, the City filed a notice to invoke discretionary jurisdiction in the Florida Supreme Court. On 6/16/25, the County filed its notice of intent to file an amicus brief in support of the City should the court accept jurisdiction. Additional amicus include the Florida Association of County Attorneys and 1,000 Friends of Florida. The City filed its brief on jurisdiction on 6/20/25. Reply brief of respondents filed 7/29/25. 31. Monroe County v. Denise Joy Snyder Living Trust, 3D25-0979. Owner filed an appeal of the code for RV storage and unpermitted/unrestored land clearing and imposing fines and restoration requirements. order for the RV storage violation but reversed the land clearing violations because the of FS 163.045 and submitted an affidavit from an arborist that the trees on the vacant residential lot created a hazard to life and property. The Court rejected the Special -amended version of FS 163.045 that applied at the time of clearing did not apply to vacant undeveloped property. The County sought certiorari review in the Third DCA. The owner 32. Pirates Saving Paradise Inc. v. Monroe County, Planning & Environmental Resources Department File No. 2025-110. On 5/28/25, PSP appealed to the Planning Commission 5/6/25 approval of an application for a Minor Deviation to a Major Conditional Use Permit regarding a parcel on Little Torch Key. This appeal is set to be heard on 8/27/25. The Planning Commission heard this appeal on 8/27/25, and issued a decision consistent with the professional staff recommendation and for the development applicant, and ruled against PSP. On 9/29/25 the time-frame to seek further appellate review expired. This appeal is complete and the case may be considered closed. 33. Swift Eddy Corp. v. Monroe County, Planning & Environmental Resources Department File No. 2025-113. On 5/23/25, owner appealed a 4/23/25-issued Letter of Understanding regarding its property on Big Coppitt to the Planning Commission. The appeal will be heard at a future Planning Commission meeting. 34. Raymond Vazquez v. Monroe County, Planning & Environmental Resources Department File No. 2025-108. On 5/21/25, a Sugarloaf property owner filed an 5228 application to appeal a determination requiring removal of an invasive exotic melaleuca failure to state a basis for the appeal. 35. Lazaro & Beatriz Miguez Arango v. Monroe County, Planning & Environmental Resources Department File No. 2025-109. On 5/28/25, owners of a parcel near MM 104 appealed a decision to fail a dock permit application based on the determination that it fails to comply with the Land Development Code Section 118-Tipsfmjof! Tfucbdl!!Epdljoh!Gbdjmjujft incomplete due to their failure to file an initial brief. 36. Key Haven v. Florida DOT & DEO, 1D2025-0660. The property owner sued the State alleging a regulatory taking of its five (5) mostly submerged lots in the Key . Although the County was previously dismissed as a party below, it is seeking amicus st status. Key Haven has appealed in the 1 DCA 2/16/25 Final Summary Judgment in favor of the State. Its initial brief was filed on 8/19/25. The State has requested an extension until 12/17/25 to file its answer brief. The County will be filing an amicus brief in support of the State. Class Action Lawsuits where Monroe County is a Party 37. Monroe County v. 3M, et al., 22-CA-618-K/2:22-cv-03680-RMG, consolidated into 2:18-mn-02873-RMG: On 9/9/2022, Monroe County filed suit against manufacturers of aqueous film-forming foam (AFFF) containing per- and polyfluoroalkyl substances (PFAS) to recover damages for investigation, remediation, removal, disposal, treatment and monitoring of water PFAS had been detected at the Monroe County Fire Training Academy on Grassy Key. On 10/7/22, defendants removed the case to the U.S. District Court for the Southern District of Florida. case was transferred and consolidated with other similar cases in the Multi District Litigation (MDL) case pending in the District of South Carolina before Hon. Richard M. Gergel. Constitutional Officer Cases 38. Lissette Carey v. Sherrie Hodies, Supervisor of Elections, fu!bm-!25-CA-843-K. KW City Commissioner Lissette Carey filed suit on 7/30/25 challenging the effort to initiate a of Elections, who is a necessary party. Also named are the City, City Clerk Keri Emergency Motion for Permanent Injunction and Declaratory Relief and requested that the matter be handled on an expedited basis. On 8/5/25, the Supervisor filed a res Relief. On 8/8/25, the Supervisor found that the recall committee failed to timely submit the required number of signatures to proceed with the recall process then filed a suggestion of mootness on 8/11/25. The case was reassigned to Judge Helms on 8/11/25. Carey dismissed the Supervisor and Clerk on 8/12/25; the file remains open in case the recall petitioners file new petitions. 5229 39. The Supervisor of Elections is currently involved in several additional litigation matters The cases challenge various Florida Statutes regarding election legislation and voter registration. Supervisor Hodies and the defense of each case. Three older cases remain pending awaiting final resolutions by the Courts. A new case was filed on 5/4/25, which challenges the constitutionality of HB 1205 passed by the Legislature this year to regulate the initiative-petition process: A) 4:25cv211-MW/MAF, USDC/NDFL. Three additional groups and one individual have filed to intervene as Plaintiffs and the Republican Party of Florida filed to intervene as a nd Motion for Preliminary Injunction on 5/30/25, and other Plaintiffs followed with similar additional Motions, which do seek relief from the SOEs, and a hearing was held on 6/30/25. The Court denied the injunctions in part and granted in part. The Court entered another Order on Motions for Preliminary Injunction on 8/21/25, which applied only to certain counties, but Monroe County is not affected by the Order. Plaintiff FDH withdrew its most recent Motion for Preliminary Injunction regarding signature verification fees and has also suspended its initiative campaign (Provide Medicaid Coverage to Eligible Low-Income Adults) for the 2026 election cycle. Vacation Rental Prosecutions. At the 8/28/25 Code Compliance hearing, seven vacation rental cases were heard. Each case was compliant prior to the hearing and the Special Magistrate ordered one-time fines as follows: VR-JUN25-0044, $6,250; VR-JUN25-0045, $3,000 by agreement of parties; VR-JUN25-0046, $5,700; VR- JUN25-0047, $6,600; VR-JUN25-0049, $8,000; VR-JUN25-0050, $5,300; VR-JUN25- 0051, $5,500. At the 9/25/25 Code Compliance hearing, seven vacation rental cases were heard. Six were compliant prior to the hearing and the Special Magistrate ordered onetime fines as follows: VR-JUN25-0048, $4,000 by agreement of parties; VR-JUL25-0052, $3,850; 522: VR-JUN25-0054, $6,000; VR-AUG25-0056, $10,000 by agreement of parties; VR- AUG25-0059, $5,000 by agreement of parties; VR-AUG25-0057, $4,000. VR-JUL25- 0055 was not compliant; a cease and desist was ordered with a $100 daily fine, plus a $12,500 one-time fine.
