No. 3D17-1312.
ITEM BACKGROUND:
The County successfully litigated enforcement of multiple Code liens concerning large-scale illegal
unpermitted landclearing and illegal unpermitted uses against the Defendants Magnolia 101, LLC, and
Brian Lindback as Officer of Magnolia 101, LLC, which ultimately resolved through settlement
resulting in payment of$744,900.00 to Monroe County and conveyance of three Key Largo parcels
over to the County, which are more particularly described as Squares 1, 4, and 5, Ocean Acres,
according to the Plat Thereof, as recorded in Plat Book 1, Page 188, of the Official Records of Monroe
County, Florida (the "property").
Due to the timing of the conveyance of the property over to the County, a property tax bill in the
amount of approximately $1,805.19 accrued just prior to the transfer of title. Therefore, staff requests
approval to pay the subject arrearage in order to ensure free and clear title by clearing any potential tax
deed issue regarding the property in the future, through Board approval and authorization for the
County Attorney to approve and sign all necessary documentation to pay the approximately $1,805.19
necessary to redeem the subject unpaid taxes that accrued at the time of title transfer.
PREVIOUS RELEVANT BOCC ACTION:
6/16/21 -Approval of a Settlement Agreement in Monroe County v. Magnolia 101,LLC, et al., Case
No. 13-CA-945-P, and Authorization for the County Attorney to Execute the Agreement on Behalf of
the County.
