RESOLUTION NO. 440 -2025
A RESOLUTION OF THE MONROE COUNTY BOARD OF
COUNTY COMMISSIONERS EXTENDING A TEMPORARY
CONSTRUCTION STAGING AREA SPECIAL USE PERMIT
GRANTED THROUGH BOCC RESOLUTION NO. 147-2025
THROUGH DECEMBER 31, 2025, AT 92501 OVERSEAS HWY,
TAVERNIER, DESCRIBED AS PARCELS OF LAND IN SECTION
27, TOWNSHIP 62 SOUTH, RANGE 38 EAST, TAVERNIER,
MONROE COUNTY, FLORIDA, CURRENTLY HAVING PARCEL
IDENTIFICATION NUMBERS: 00490250-000000 AND 00089490-
000000.

2 WHEREAS, an application was filed for a special permit pursuant to Monroe County Code
3 Section 6-3, allowing a temporary construction staging area at property located at 92501 Overseas
4 Highway, Tavernier approximate Mile Marker 92.5 (Oceanside of the Overseas Highway); and

6 WHEREAS,the property is legally described as Section 27 Township 62 Range 38 Island
7 of Key Largo Plat Book 1 Page 64 Part of Lot 6 &Plat of Survey of Ellis Property Key Largo Plat
8 Book 2 Page 99 Part of Tract 2, having parcel identification numbers: 00490250-000000 &
9 00089490-000000; and

11 WHEREAS,the Board of County Commissioners of Monroe County,Florida, granted the
12 special permit allowing a temporary construction staging area at a regularly scheduled Board of
13 County Commissioners meeting on February 19, 2025 through Resolution No. 118-2025 and
14 amended the permit on March 25, 2025 through Resolution No. 147-2025; and
15
16 WHEREAS, due notice had been carried out and a public hearing had been held in
17 accordance with MCC Section 6-3 when granting the special permit; and

19 WHEREAS, BOCC Resolution No. 147-2025 included a termination date of October 31,
20 2025; and

22 WHEREAS,the Board makes the following Findings of Fact and Conclusions of Law:

1 1. The extension to the termination date to December 31, 2025 of the special permit for
2 temporary construction staging area is not inconsistent with any of the criterion provided
3 in Monroe County Code §6-3;

5 NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
6 COMMISSIONERS OF MONROE COUNTY,FLORIDA,that the preceding Findings of Fact
7 and Conclusions of Law support its decision to approve the request for an extension of the special
8 permit, subject to the following conditions:

10 1. The temporary construction staging area shall only be used in association with the
11 construction of the Plantation Key Transmission Main Replacement project by the Florida
12 Keys Aqueduct Authority.
13 2. The expected commencement date of the temporary construction staging area is March
14 2025. The termination date of the temporary construction staging area shall be no later than
15 December 31, 2025.
16 3. Other than fencing, no temporary structure associated with the temporary construction
17 staging area shall be located in any required setback.
18 4. This special permit does not authorize the removal of any vegetation or the placement of
19 fill on the property.
20 5. Prior to commencement of the construction staging area use,the owners shall install stakes
21 to delineate the boundary of the wetlands on the site to ensure the required 100-foot setback
22 from the wetland is maintained, as shown on the attached site plan.
23 6. Upon termination of the temporary construction staging area,the property shall be restored
24 to its prior condition.
25 7. The hours of operation for use of the Staging Area will be no earlier than 7:00 A.M. to no
26 later than 6:00 P.M.
27 8. The property owners agree to allow the County access to the property for the purpose of
28 inspection to monitor and ensure compliance with the terms and/or provisions of this
29 special permit.
30 9. Use of covered conveyors and enclosed storage areas to minimize dust emissions shall be
31 required.
32 10. The Mobile Crusher("Mobile Processor") shall be located towards the center of the staging
33 area(as shown on the subject site plan)to minimize noise audible to the adjacent residential
34 areas.
35 11. The contractor shall at all times utilize/implement spray systems and misting technology
36 to suppress dust at all processing, loading, and unloading locations/points.
37 12. Concrete, sand, and aggregates shall at all times be delivered in a dampened state using
38 covered trucks. If such materials have dried out, for example during transit, they shall be
39 promptly dampened again before being dumped.

41 PASSED AND ADOPTED by the Board of County Commissioners of Monroe County,
42 Florida, at a regular meeting of the Board held on the 151h day of October, 2025.
