C24 Approval of a Third Amendment to the Administrative Agreement with the Florida Keys
Council of the Arts (FKCA) to utilize 10% of the 1% Art in Public Places allocation for capital
projects, to pay for administrative expenses. This Third Amendment utilizes the original
Agreement's option to renew for one additional three-year term and extends the Agreement to
September 30, 2028.

THIRD AMENDMENT TO ADMINISTRATIVE AGREEMENT
MONROE COUNTY ARTS IN PUBLIC PLACES

This THIRD AMENDMENT dated the 15 day of October 2025, is entered into by and between
the BOARD OF COUNTY COMMISSIONERS FOR MONROE COUNTY, (“County”), and
the FLORIDA KEYS COUNCIL OF THE ARTS (“FKCA”).
WHEREAS, the Art in Public Places Ordinance #022-2001, codified inSection 2-233,
Monroe County Code of Ordinances provides for an appropriation of 1% of the construction costs
for new construction exceeding $500,000.00 and renovations exceeding $100,000.00 for the
acquisition, commission, installation, and maintenance of works of art in said buildings; and
WHEREAS, on January 18, 2023, the parties entered into an Administrative Agreement
where the Art in Public Places (AIPP) Committee of the Florida Keys Council of the Arts can
utilize ten percent (10%) of the art funding for each project for certain reimbursement of
administrative expenses incurred by the FKCA (“Agreement”); and
WHEREAS, on March 20, 2024, the parties entered into a First Amendment to the
Agreement which updated the listed personnel, hourly rates, Public Entity Crime Statement
paragraph and Nondiscrimination paragraph; and
WHEREAS, on April 16, 2025, the parties entered into a Second Amendment to the
Agreement which updated the listed personnel and hourly rates; and
WHEREAS, the current Agreement expired on September 30, 2025, and allows for the
option to renew for one additional three-year term.
NOW THEREFORE, in consideration of the mutual covenants and payment contained
herein, the parties have entered into this Agreement on the terms and conditions as set forth below:
1.Paragraph 3 of the Agreement is amended as follows:
a.AGREEMENT PERIOD: This Agreement is for the period of three (3) years
effective retroactively to October 1, 2025, and ending September 30, 2028.
There are no remaining options to renew.
2.In all other respects, the original Agreementdated January 18, 2023, as amended on
March 20, 2024, and April 16, 2025, remains unchanged.
