RESOLUTION NO. -2025 A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA, AUTHORIZING THE WRITE-OFF OF TRAUMA STAR AMBULANCE ACCOUNTS RECEIVABLE FOR ACCOUNTS EXPRESSLY ATTACHED HERETO AND MADE APART HEREOF AS EXHIBITS A, B, AND C; PROVIDING FOR SEVERABILITY; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, Monroe County Fire Rescue, in conjunction with Monroe County Sheriff's Office,provides air ambulance service known as"Trauma Star"or"Trauma Star Air Ambulance"; and WHEREAS, patients transported by air ambulance are billed by Monroe County Fire Rescue's EMS billing department for the transport and medical services rendered; and WHEREAS,the EMS billing department makes any and all efforts to collect all collectible debt and payments from the service recipients (patients) or their insurance, including sending applicable accounts to outside collections agencies; and WHEREAS, after sending three (3) invoices and one (1) dunning letter, accounts are placed with a collections agency to further attempt collections; and WHEREAS, additionally, on May 20, 2009, the Board of County Commissioners approved Resolution No. 152-2009 adopting a policy and process for Trauma Star Air Ambulance billing for trauma scene and critical care inter-facility flights wherein qualifying Monroe County residents could obtain a fee waiver for flights that occurred after November 4, 2008; and WHEREAS,for the accounts attached to this resolution,it has been determined that further collection efforts are fruitless, and would only incur additional costs to continue to bill the recipients, as the insurance has paid the maximum allowable on these claims, and the service recipients are now either deceased with no available funds in the estate, in bankruptcy, a minor with no guardian or parent found, have uncollectible balances of Medicaid/Medicare, have 1 197 uncollectible balances of workers compensation accounts which cannot be billed to the service recipient, have small exceptions balances, or are otherwise uncollectible after diligent and extensive efforts made by the billing department and, where applicable, collections agencies who further attempted collection; and WHEREAS, after a period of four (4) years from the date of the billable incident has elapsed, and all efforts of collecting the collectible debt have been exhausted, Monroe County Office of Management and Budget directs the write-off of these debts; and WHEREAS, additionally, the EMS billing department recently became aware of air ambulance billing balances that dated from approximately 2008 through 2014 that were processed and managed by the County's former billing company, Advanced Data Processing, Inc. (ADPI); and WHEREAS, due to the age of ADPI's records and the County's inability to collect on such accounts, it is appropriate to similarly write-off those accounts as part of this effort; and WHEREAS, based on accepted industry standards and best accounting practices, it is desired that these uncollectible air ambulance service accounts receivable be written-off at this time; and WHEREAS, the Board of County Commissioners hereby finds and determines that the actions described herein will serve the best interests of the residents,visitors, and business owners in Monroe County, Florida. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA: Section 1: That the foregoing "WHEREAS"clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this resolution. All exhibits described hereunder and attached hereto are incorporated and made a specific part of this resolution; specifically: 1. Receivables for air ambulance service accounts listed on"Exhibit A,"in the amount of$4,805,472.41, shall be deleted from the Fine and Forfeiture Fund(101). 2. Receivables for air ambulance resident fee waiver accounts listed on "Exhibit B," 2 198 in the amount of$510,112.11, shall be deleted from the Fine and Forfeiture Fund (101). 3. Receivables for air ambulance service accounts from ADPI listed on "Exhibit C," in the amount of$3,590,667.14, shall be deleted from the Fine and Forfeiture Fund (101). Section 2: That the County Commission has considered the facts and circumstances described herein and authorized the write-offs detailed on Exhibits A, B, and C. Section 3: That the County Administrator, or designee, is hereby authorized to direct such action to effectuate the goals of the County Commission as stated herein. Section 4: That if any clause, section, other part or application of this resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or in application, it shall not affect the validity of the remaining portion or applications of this resolution. Section 5: That this resolution shall be in full force and effect immediately upon its adoption.
