AGENDA ITEM WORDING: A Resolution of the Monroe County Board of County Commissioners
amending Resolution No. 185 -2024, which waived approximately $90,446 in building permit fees for
eight(8) low income (80% of median) affordable housing units, to change the approved income
category to median income (100% of median) affordable housing units, to be constructed on parcels
located at 31372 Avenue G, 31371 Avenue F, 31142 Avenue F, 31530 Avenue D, 31250 Avenue I, and
30936 Nathalie Street, all on Big Pine Key, and 28269 Julia Avenue and 28249 Julia Avenue on Little
Torch Key.
ITEM BACKGROUND:
Monroe County Code Section 6-108(e) authorizes any entity to apply to the Board of County
Commissioners for fee waivers from the building permit and building permit application fees for
construction of affordable housing units intended for occupancy for households with income up to 120
percent of the median annual adjusted gross income as defined by Monroe County. The Applicant
previously applied for and received the subject waiver for eight(8)units to be in the low income
category. The request was approved by the Board on May 24, 2024, as Resolution No. 185-2024. After
making efforts to maintain the lowest category possible for each property the Applicant is requesting
an Amendment to change the income category from low income to median income.
PREVIOUS RELEVANT BOCC ACTION:
On May 24, 2024, the Board passed and approved Resolution No. 185-2024 which waived
approximately $90,446 in building permit fees for the subject eight(8) affordable housing units, with all
eight(8)units approved in the low income category.

26 WHEREAS, on April 25, 2024, Habitat for Humanity of Key West and Lower Florida
27 Keys, Inc., Agent/Lessee for the Owner/Lessor Monroe County Board of County Commissioners,
28 submitted an Application for Building Permit Fee Waiver for approximately $90,446 to construct
29 eight(8) low income affordable three bedroom, two bathroom housing units at 31372 Avenue G,
30 31371 Avenue F, 31142 Avenue F, 31530 Avenue D, 31250 Avenue I, and 30936 Nathalie Street,
31 all on Big Pine Key, and 28269 Julia Avenue and 28249 Julia Avenue on Little Torch Key; and
32 WHEREAS, the Board passed and adopted the Application through Resolution No. 185-
33 2024 on May 24, 2024; and
34 WHEREAS, on October 24, 2025, Habitat for Humanity of Key West and Lower Florida
35 Keys, Inc., Agent/Lessee for the Owner/Lessor Monroe County Board of County Commissioners,
36 submitted an amended Application for Building Permit Fee Waiver to change the income category
37 to allow for the Median income category to be applied after making efforts to maintain the lowest

38 category possible for each property. The legislative intent of this Resolution is that the instant
39 waiver shall apply to the building permit applicant of record;
40 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
41 COMMISSIONERS OF MONROE COUNTY, FLORIDA, THAT:
42 The foregoing recitals are true and correct and are hereby incorporated as if fully stated
43 herein; and
44 Building permit fees are waived pursuant to Monroe County Code Section 6-108(e) for
45 each of the eight (8) affordable housing units described herein with the condition that the units
46 meet the definition of affordable housing in the median income (100% of median) category as
47 indicated in the list below, pursuant to Section 101-1 of the Monroe County Land Development
48 Code.
