'"" l.i r" '95 DEe 15 fin:3 7 . ,)'i'" Planning Department ORDINANCE NO. 051-1995 AN ORDINANCE ADOPTING A LAND USE DISTRICT MAP AMENDMENT CHANGING THE LAND USE DESIGNATION FOR THE PROPERTIES, LEGALLY DESCRIBED AS ALL OF LOTS 1 TO 15, BLOCK 2, ALL OF LOTS 2 TO 15, BLOCK 1, AND AN UNNUMBERED LOT, PART OF BLOCK 1, PARADISE POINT SUBDIVISION, KEY LARGO, SECTION 1, TOWNSHIP 61 SOUTH, RANGE 39 EAST, MONROE COUNTY, FLORIDA, MILE MARKER 105, FROM URBAN RESIDENTIAL MOBILE HOME (URM) TO IMPROVED SUBDIVISION (IS) TRANSMITTING THIS AMENDMENT TO THE STATE LAND PLANNING AGENCY FOR APPROVAL; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Section 9.5-511(c), Monroe County Code of Ordinanc- es (Code), provides that the land development regulations (Chap- ter 9.5 of the Code), including the land use district maps, may be amended or changed at any time; and WHEREAS, the Board of County Commissioners on February 28, 1986, designated the subj ect property, legally described as all of Lots 1 to 15 , Block 2, all of Lots 2 to 15, Block 1, and an unnumbered lot, part of Block 1, Paradise Point Subdivision, Key Largo, Section 1, Township 61 South, Range 39 East, Tallahassee Meridian, Key Largo, Monroe County, Florida, as shown on the PARADISE. 12A/TXTAMAP Page 1 Initials shaded portion of Exhibit 1 (attached) as Urban Residential Mo- bile Home (URM) . The Real Estate Numbers are 00513200-000000, 00513210-000000, 00513220-000000, 00513230-000000, 00513240-000000, 00513250-000000, 00513260-000000, 00513270-000000, 00513280-000000, 00513290-000000, 00513300-000000, 00513310-000000, 00513320-000000, 00513330-000000, 00513340-000000, 00513350-000000, 00513360-000000, 00513370-000000, 00513380-000000, 00513390-000000, 00513400-000000, 00513410-000000, 00513420-000000, 00513430-000000, 00513440-000000, 00513450-000000, 00513460-000000, 00513470-000000, 00513480-000000, 00513490-000000; and WHEREAS, the Planning Department has sponsored a map amend- ment for the above described properties to change their land use district designation from Urban Residential Mobile Home (URM) (as shown in Exhibit 1) to Improved Subdivision (IS); and WHEREAS, the Planning Department has reviewed the land use district map change request and recommended approval; and WHEREAS, during the amendment process, the Development Review Committee, after due notice and public participation in the hear- ing process, has reviewed the proposed land use district map change and found the map change to be consistent with the Florida PARADISE. 12A/TXTAMAP Page 2 Initials Keys Comprehensive Plan and therefore has recommended approval; and WHEREAS, during the amendment process, the Monroe County Planning Commission, sitting as the local planning agency, after due notice and public participation in the hearing process, has reviewed the proposed land use district map changes, and the recommendations of the Planning Department and the Development Review Committee; and WHEREAS, the Planning Commission has found the map change to be consistent with the Florida Keys Comprehensive Plan and has made a recommendation that the Monroe County Board of Commission- ers rezone the properties from Urban Residential Mobile Home (URM) to Improved Subdivision (IS); and WHEREAS, the Monroe County Board of Commissioners, after due notice and public participation in the hearing process, has re- viewed all of the above recommendations and now legislatively acts thereon; and WHEREAS, F.S. 380.0552(9) requires that the state land plan- ning agency must approve all proposed land use district map chang- es before such changes may become effective; NOW THEREFORE PARADISE. 12A/TXTAMAP Page 3 Initials BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF MONROE COUN- TY, FLORIDA: THAT Section 1. This Board specifically adopts the findings of facts and conclusions of law reached by the Planning Commission as our own; and therefore Section 2. The previously described properties, as shown on the attached map, which is hereby incorporated by reference are currently designated as Urban Residential Mobile Home (URM) and which designation is hereby repealed. Section 3. The land use district map shall be amended, by changing the zoning category from Urban Residential Mobile Home (URM) to Improved Subdivision (IS) for the shaded portion of the properties as shown in Exhibit 1. Section 4. If any section, subsection, sentence, clause, item, change, or provision of this ordinance is held invalid, the remainder of this ordinance shall not be affected by such invalid- ity. Section 5. This ordinance is hereby transmitted to the state land planning agency for approval or disapproval pursuant to F.S.380.0552 (9). PARADISE. 12A!TXTAMAP Page 4 Initials Section 6. This ordinance shall be filed in the Office of the Secretary of State of the State of Florida, but shall not be deemed effective until approved by the state land planning agency.
