Ordinance 053-1995Public Works Dept. ORDINANCE NO. 053 -1995 AN ORDINANCE AMENDING SECTION 16-26, MONROE COUNTY CODE, IN ORDER TO ADOPT THE 1995 EDITION OF THE MONROE COUNTY PUBLIC WORKS MANUAL z FOR WORK WITHIN THE COUNTY RIGHT-OF-WAYS AND' , 1 TO PROVIDE THAT FUTURE REVISIONS OF THE MANUAL--) MAY BE ADOPTED BY RESOLUTION; PROVIDING c r _, FOR SEVERABILITY; PROVIDING FOR INCORPORATION Z INTO THE MONROE COUNTY CODE OF ORDINANCES;: -- PROVIDING FOR THE REPEAL OF ALL ORDINANCES INCONSISTENT HEREWITH; ANDPROVIDING AN EFFECTIVE -- DATE. BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA: Section 1. Section 16-26, MCC, is hereby amended to read as follows: Sec.16-26 Construction Standards and Specifications All construction, repairs and/or restorations within county public rights -of - way and easements shall conform to the technical standards and specifications as contained in the euFrent 1995 edition of the "Monroe County Public Works Manual," which manual is hereby adopted pursuant hereto and, by reference, incorporated herein. Revisions to the 1995 "Monroe Countv Public Works Manual" may be adopted by the County Commission by resolution. C) z N GS CD N -D Section 2. If any section, subsection, sentence, clause or provision of this ordinance is held invalid, the remainder of this ordinance shall not be affected by such invalidity. Section 3. All ordinances or parts of ordinances in conflict with this ordinance are hereby repealed to the extent of said conflict. Section 4. The provisions of this ordinance shall be included and incorporated in the Code of Ordinances of the County of Monroe, Florida, as an addition or amendment thereto, and shall be appropriately renumbered to conform to the uniform numbering system of the Code. Section 5. This ordinance shall take effect immediately upon receipt of official notice from the Office of the Secretary of State of the State of Florida that this ordinance has been filed with said Office. BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA: Section 1. Section 16-26, MCC, is hereby amended to read as follows: Sec.16-26 Construction Standards and Speciticotions. All construction, repairs and/or restorations within county public rights -of - way and easements shall conform to the technical standards and specifications as contained in the etwent 1�9 5 edition of the "Monroe County Public Works Manual," which manual is hereby adopted pursuant hereto and, by reference, incorporated herein. Revisions to the 1995 "Monroe County Public Works Manual" may be adopted by the County Commission by resolution. Section 2. If any section, subsection, sentence, clause or provision of this ordinance is held invalid, the remainder of this ordinance shall not be affected by such invalidity. Section 3. All ordinances or parts of ordinances in conflict with this ordinance are hereby repealed to the extent of said conflict. Section 4. The provisions of this ordinance shall be included and incorporated in the Code of Ordinances of the County of Monroe, Florida, as an addition or amendment thereto, and shall be appropriately renumbered to conform to the uniform numbering system of the Code. Section 5. This ordinance shall take effect immediately upon receipt of official notice from the Office of the Secretary of State of the State of Florida that this ordinance has been filed with said Office.
