HomeMy WebLinkAboutResolution 508-2025 1 �-h 2 414 y�� l WW 5 8 MONROE COUNTY, FLORIDA 9 MONROE COUNTY BOARD OF COUNTY COMMISSIONERS 10 RESOLUTION NO. 508 -2025 11 12 A RESOLUTION OF THE MONROE COUNTY BOARD OF 13 COUNTY COMMISSIONERS AMENDING RESOLUTION NO. 148- 14 2025, THE PLANNING & ENVIRONMENTAL RESOURCES 15 DEPARTMENT FEE SCHEDULE, TO PROVIDE FOR INCLUSION 16 OF A TECHNOLOGY FEE IN THE APPLICATION FEE FOR 17 APPLICATIONS SUBMITTED THROUGH THE ONLINE 18 APPLICATION SYSTEM. 19 20 21 WHEREAS, the Monroe County Board of County Commissioners ("Monroe County", the 22 "County", "Board", or"BOCC") wishes to provide the citizens of the County with the best possible 23 service in the most cost effective and reasonable manner; and 24 25 WHEREAS, the Board finds that it would be in the best interests of the general public to 26 charge the true cost for such services, thereby placing the burden of such costs directly upon those 27 parties deriving the benefit from such services; and 28 29 WHEREAS, the updated fee schedule prepared by the Senior Director of the Monroe County 30 Planning&Environmental Resources Department for providing these services includes the estimated 31 direct costs and reasonable indirect costs associated with the review and processing of planning and 32 development approval applications and site plans, on-site biological reviews, appeals,preparation of 33 official documentation verifying existing development rights and other processes and services; and 34 35 WHEREAS, the Board has discussed the need to adjust the fee schedule to compensate 36 the County for resources needed in excess of the fee estimates included in the base fees; and 37 38 WHEREAS,the Planning&Environmental Resources Department is engaged in a transition 39 to a system of online electronic application submittal in order to increase cost effectiveness and 40 reduce the burden of paperwork on applicants, as well as professional staff, and 41 42 WHEREAS, there are ongoing costs associated with licensing and maintenance of online 43 electronic application processing software; and 44 45 WHEREAS,the updated fee schedule includes payment by the applicant of a fraction of the 46 anticipated ongoing costs of online electronic application processing software; and 47 48 WHEREAS, the Board conducted a public hearing on November 12, 2025, to consider 49 approval of this Resolution; and 50 51 WHEREAS, the Board has considered all information, feedback, and/or presentation 52 provided by County professional staff, and any and all evidence and/or testimony received as to the 53 appropriate fee schedule; Reso. No. 508 -2025 1 of 7 1 2 NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY 3 COMMISSIONERS OF MONROE COUNTY FLORIDA: 4 5 Section 1. Recitals and Legislative Intent. The foregoing recitals, findings of fact, 6 conclusions of law, and statements of legislative intent are true and correct and are hereby 7 incorporated as if fully set forth herein. 8 9 Section 2. Pursuant to Land Development Code Section 102-19(g), the following 10 schedule of fees to be charged by the Planning and Environmental Resources Department to 11 persons filing text amendments, map amendments, land development permit applications, land 12 development approval applications, and land development order applications however styled, and 13 any land development order appeal however styled. For any application that requires a public hearing(s) and/or surrounding property owner 6 notification, advertising and/or notice fees; $245.00 for newspaper advertisement and$3.00 7 per property owner notice. 8 9 2. Affordable Housing: There shall be no application or other fees, except advertising and 10 noticing fees, for affordable housing projects, except that all applicable fees shall be charged 11 for applications for all development approvals required for any development under Sec. 139- 12 2 of the Monroe County Code and for applications for variances to setback, landscaping 13 and/or off-street parking regulations associated with an affordable housing development. 14 15 3. There shall be no application or other fees, except advertising and noticing fees, for property 16 owners who apply for a map amendment to the official LUD map and/or the official FLUM, 17 if the property owner can provide satisfactory evidence that a currently, lawfully existing use 18 on the site, also existed lawfully in 1992 and was deemed nonconforming by final adoption 19 of the LUD map and/or a currently, lawfully existing use on the site, also existed lawfully on 20 the site in 1997 and was deemed nonconforming by final adoption of the FLUM. To qualify 21 for the fee exemption, the applicant must apply for a LUD and/or FLUM designation(s) that 22 would eliminate the non-conforming use created with adoption of the existing designation(s) 23 and not create an adverse impact to the community. Prior to submittal of a map amendment 24 application, the applicant must provide the evidence supporting the change and application 25 for a fee exemption with the proposed LUD map/FLUM designations to the Monroe County 26 Planning & Environmental Resources Department as part of an application for a Letter of 27 Understanding. Following a review, the Director of Planning & Environmental Resources 28 shall determine if the information and evidence is sufficient, and whether the proposed LUD 29 map and/or FLUM designations are acceptable for the fee waiver, and approve or deny the 30 fee exemption request. This fee waiver Letter of Understanding shall not obligate the staff to 31 recommend approval or denial of the proposed LUD or FLUM Category. 32 33 4. Hearing fees: applicant shall pay half the cost of the hourly rate, travel and expenses of any 34 hearing officer. 35 ^dfninist- ive 14ea-inns mn n u) If the fee charged to the County is increased, the charge 36 will change proportionately. An estimated amount of one-half of the hearing officer costs as 37 determined by the County Attorney shall be deposited by the applicant along with the 38 application fee, and shall be returned to the applicant if unused. 39 40 5. Base fees listed above include a minimum of(when applicable)two(2)internal staff meetings 41 with applicants; one (I) Development Review Committee meeting, one (1) Planning Reso. No. 508 -2025 4 of 7 I Commission public hearing; and one (I) Board of County Commission public hearing. If this 2 minimum number of meetings/hearings is exceeded, the following fees shall be charged and 3 paid prior to the private development application proceeding through public hearings: 4 5 a. Additional internal staff meeting with applicant ..........................$500.00 6 b. Additional Development Review Committee public hearing ......$600.00 7 c. Additional Planning Commission public hearing ........................$700.00 8 d. Additional Board of County Commissioners public hearing .......$850.00 9 10 The Planning Director or designee shall assure these additional fees are paid prior to hearing 11 scheduling. These fees apply to all applications filed after September 15, 2010. 12 13 6. Applicants for Administrative Appeal, who prevail after all appeals have been decided or 14 where the appeal period(s) has expired, shall have the Administrative Appeal application fee 15 refunded. A full refund does not require approval by the Board of County Commissioners; 16 however, if the appellant only prevails on a portion of their appeal, the Board of County 17 Commissioners shall determine the amount of the refund. 18 19 7. Concerning the application fees to amend the tier maps,the lesser application fee of$1,970.00 20 is only available for applications to amend the tier designation of a single URM or IS platted 21 lot. It may not be used to amend the tier designation of more than one lot. 22 23 8. Applicants for any processes listed above, and reviews and waivers pursuant to Article III. 24 Parking and Loading, that are required to provide transportation studies related to their 25 development impacts shall be required to deposit a fee of $5,000 into an escrow account to 26 cover the cost of experts hired by the Planning and Environmental Resources Department to 27 review the transportation,parking and other related studies submitted by the applicant as part 28 of the development review process or any map or text amendment submitted by a private 29 applicant. Any unused funds deposited by the applicant will be returned upon permit or 30 amendment approval.Monroe County shall obtain an estimate from the consultant they intend 31 to hire to review the transportation, parking and other related studies for accuracy and 32 methodology and if the cost for the review on behalf of Monroe County is higher than the 33 $5,000, applicant shall remit the estimated amount. Any unused funds deposited by the 34 applicant will be returned upon permit approval. 35 36 9. Applicants for any processes listed above that may require a technical review or study by a 37 third-party shall bear the cost of such review. At the request of the Senior Director of Planning 38 and Environmental Resources, Applicants shall be required to deposit a fee of$5,000 into an 39 escrow account to cover the cost of experts hired by the Planning and Environmental 40 Resources Department to review related studies and reports submitted by the applicant, or 41 conduct studies and reports required to be conducted by the County pursuant to Florida 42 Statutes or federal regulation, as part of the development review process or any map or text 43 amendment submitted by a private applicant. Any unused funds deposited by the applicant 44 will be returned upon permit or amendment approval. Monroe County shall obtain an estimate 45 from the consultant they intend to hire to review and/or conduct the required studies for 46 accuracy and methodology and if the cost for the review on behalf of Monroe County is higher 47 than the $5,000, applicant shall remit the estimated amount. Any unused funds deposited by 48 the applicant will be returned upon permit approval. 49 Reso. No. 508 -2025 5 of 7 1 10. Private applicants and/or appellants must and shall pay the fees for the Planning & 2 Environmental Resources Department ("Department") to record associated development 3 approval(s), the fees for the Department to record a decision(s) arising from an application 4 and/or request for development approval, as well as the fees for the Department to record a 5 decision(s) arising from an administrative appeal(s) to the Monroe County Planning 6 Commission and and/or Florida Division of Administrative Hearings("DOAH"). The adopted 7 Monroe County Clerk of Court ("Clerk") Fee Schedule attached as Exhibit A. hereto, more 8 particularly the Clerk's below-referenced operative Recording Fees, is/are hereby 9 incorporated as if fully stated herein. 10 Rewrding Fees 11.$10.00 for the first page.$8.50 for each additional page of the same document. 2. If the document contains more than 4 names to index,there is an additional charge of$1.00 per name. 3. Documentary Stamp Tax on Deeds is$.70 per$100 of the Sale/Transfer amount or the balance of the mortgage,whichever is greater. 4. Intangible Tax on a Mortgage is 2 milIs or.002 x Mortgage amount. Documentary Stamp Tax on a mortgage is$.35 per$100 of the mortgage amount. Technology Fees: For aplication types listed above, a$15 Technology Fee shall be added to 20 the application fee for any application submitted through the online application system. 21 22 Section 3. Any other fees schedules or like provisions authorized under the Monroe 23 County Code(s) inconsistent herewith is/are hereby repealed. 24 25 Section 4. Construction and Interpretation. The interpretation of this Resolution, and 26 all provisions of the Monroe County Codes, Comprehensive Plan, floodplain 27 management regulations, and Florida Building Code whose interpretation 28 arises out of, relates to, or is interpreted in connection with this Resolution, 29 these being necessary for the health, safety, and welfare of the residents of and 30 visitors to unincorporated Monroe County, shall be liberally construed in favor 31 of Monroe County and such interpretations shall be entitled to great weight in 32 adversarial administrative proceedings, at trial, and on appeal. 33 34 Section 5. Severability,Partial Invalidity,and Survival of Provisions.If any provision 35 of this resolution, or any section, subsection, or part or portion thereof, is held 36 to be invalid or unenforceable by any administrative hearing officer or court 37 of competent jurisdiction,the invalidity or unenforceability of such provision, 38 or part or portion thereof, shall neither limit nor impair the operation, 39 enforceability, or validity of any other provisions of this resolution, or any 40 remaining section(s), subsection(s), part(s), or portion(s) thereof. All other 41 provisions, parts, and portions thereof shall continue unimpaired in full force 42 and effect. 43 44 Section 6. The Clerk of the Board is hereby directed to forward one (1) certified copy of 45 this Resolution to the Planning and Environmental Resources Department. Reso.
