HomeMy WebLinkAboutResolution 504-2025 1 2 3 4 5 6 ., 'ti 7 8 RESOLUTION NO. 504 -2025 9 10 A RESOLUTION MEMORIALIZING THE MONROE 11 COUNTY BOARD OF COUNTY COMMISSIONERS' 12 DETERMINATION THAT IT IS IN THE BEST INTEREST 13 OF THE COUNTY TO SELL AND/OR CONVEY THAT 14 CERTAIN PARCEL OF SURPLUS REAL PROPERTY 15 REFERRED TO AS "PARCEL B" ON ATTACHED 16 EXHIBIT A. PURSUANT TO FLORIDA STATUTES § 17 125.35, AND APPROVING AND AUTHORIZING 18 ADVERTISEMENT OF SAID PROPERTY FOR SALE AS 19 PROVIDED BY FLORIDA STATUTES § 125.35. 20 21 22 WHEREAS, Section 125.35(1)(a), Florida Statutes, provides that the Board of County 23 Commissioners ("Monroe County", the "County", "BOCC", or the "Board") is expressly 24 authorized to sell and convey real property upon the Board's determination that it to the best 25 interest of the County to do so; and 26 27 WHEREAS, Section 125.35(1)(c), Florida Statutes, states that any such sale and/or 28 conveyance of such real property may only be made if"notice thereof is published once a week 29 for at least two weeks in some newspaper of general circulation published in the county, calling 30 for bids for the purchase of the real estate so advertised" to be sold; and 31 32 WHEREAS, Section 125.35(1)(c), Florida Statutes, provides that "[i]n the case of sale, 33 the bid of the highest bidder complying with the terms and conditions set forth in such notice 34 shall be accepted, unless the board of county commissioners rejects all bids because they are too 35 low."; and 36 37 WHEREAS, Section 125.35(1)(c), Florida Statutes, provides that the County may 38 "require a deposit to be made or a surety bond to be given," in such form or amount as the 39 County determines, "with each bid submitted."; and 40 41 WHEREAS, this Resolution hereby memorializes the Monroe County BOCC's 42 determination that it is in the best interest of the County to sell and/or convey that certain parcel 43 of real property identified as "Parcel B" on attached Exhibit A. a/k/a that certain parcel of land 44 shown on attached Composite Exhibit B.; and 45 46 WHEREAS, the Board hereby approves and authorizes advertising the above-referenced 47 real property for sale as provided by Section 125.35, Florida Statutes; 48 49 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY 50 COMMISSIONERS OF MONROE COUNTY, FLORIDA: 1 of 2 • 1 :- • : :1,• The,:foregoing,•recitals,.findings s:of:fact,:and.conclusions of'law :are true and.correct :•..• . :2 : : . • I.::and are hereby incorporated as if.fully.stated herein.:..• : : :.: : 4'.• • :• •• :.2•.• The•Monroe.
