ITEM BACKGROUND: In 2013 and again in 2019, City of Marathon manager reviewed the ownership of properties on 33rd Street in Marathon and proposed transfer of the County owned properties to the City for the purpose of creating a City owned and operated community center. The attached Memorandum shows ownership of the various properties on the street. The County owned property includes the old fire station at the NW corner of the intersection of US-1 and 33rd Street; a portion of the former congregate meals site (aka senior center); and a portion of the Stanley Switlik Elementary school parking lot. The latter is a remnant of the transfer of the old SR-4 ROW to the County. The City requests transfer of the old fire station and the senior center to the City in anticipation of their long-term plan to develop a new community center which would include both youth and senior activities. In 2019 the BOCC directed staff to work out a plan for transfer of the County owned properties to the City in support of their plan. The 2013 and 2019 BOCC discussions anticipated development of an ILA for inclusion of a congregate meal site in the community center. Staff is recommending that the parcels be transferred without the originally envisioned ILA requiring a County operated meal site be included in the new community center for the following reasons: 1. The City has used the old fire station for storage with the County's acquiescence since at least 2011. 2. The City plans to include all ages' activities in their community center. 3. The County's meal service has been dormant since 2017. 1010 4. There has been no active use of the "senior center"building by any other organizations since 2017. 5. The County parcel east of 33rd Street has been in use as part of the Switlik parking area since the school has been there. 6. The 33rd Street ROW was transferred to the City when the others streets in the City were transferred at the time of incorporation(although the property records do not appear to recognize that fact). 7. As long as the existing "senior center"building remains in County ownership, it will require some maintenance expenditure from the County budget. Pursuant to Florida Statute 125.38, the County may convey or lease real property to the state, any political subdivision thereof, or any municipality of the state,upon request,when property is not needed for county purposes and is to be used for a public purpose by the requesting municipality or political subdivision of the state, for a value that may be nominal. PREVIOUS RELEVANT BOCC ACTION: 19 JUN 2013 BOCC directed staff to investigate and bring back options for 33rd Street. 21 AUG 2019 BOCC directed staff to collaborate with City of Marathon to effectuate their plan to develop new community center on 33rd Street incorporating a senior center. Wilson SUBJECT: Background on 3311 Street Properties in Marathon This supplements information in the Ageda Item Summary to explain the current and proposed ownership of the various properties on 3311 Street in Marathon. How it is In the aerial below, the blue highlighted properties are owned by the City of Marathon. The green highlighted areas (Switlik School grounds)are owned by the Monroe County School District (MCSD). The red areas are County property. The red area closest to US-1 (circled in yellow) is the parcel on which the old fire station and the old "senior center"are located. The senior center" building encroaches on the City property to the north (about 1/3 d of the building). The areas circled in orange (both solid and dotted) are owned by the County as a result of FDOT deeding the old SR-4 Right of Way to the County long ago. The solid orange circled area is part of the Switlik School parking lot. The dotted orange are is vacant with an access easement for FKAA 1013 to access its property to the west. 33rd Street itself is shown as apart of the various parcels even though it was transferred to the City from the County during(or shortly after)the incorporation of the City. The actions proposed in this agenda item would transfer the yellow encircled parcel and the dotted orange encircled parcels to the City of Marathon. The County Attorney opined in 2013 that any restrictions imposed by the grant that funded building construction of the building known as the"senior center" lapsed in approximately 2003. The other building on the yellow encircled parcel is the old fire station which has been used by the City of Marathon since incorporation as a public works storage building. WHEREAS, Section 125.38, Florida Statutes,provides that the COUNTY may convey or lease real property to the state, any political subdivision thereof, or any municipality of the state, upon request, when property is not needed for county purposes and is to be used for a public purpose by the requesting municipality or political subdivision of the state, for a value that may be nominal; and WHEREAS, the COUNTY owns property known as parcel identification number 00102310-000000, which includes property on 33rd Street in Marathon, Florida 33050; and WHEREAS, City of Marathon has requested a portion of the property including the old fire station and a portion of the former congregate meals site known as the senior center as described in Exhibit A, and a portion of land known as parcel K as described in Exhibit B, for the long-term goal of developing a community center; and WHEREAS, Monroe County School District has requested a portion of the property that is currently used and will continue to be used as a portion of the Stanley Switlik Elementary School parking lot, as described in Exhibit C; and WHEREAS, the properties as described within the exhibits are not needed for any COUNTY purpose; and 1 1031 WHEREAS, the COUNTY will receive consideration in the sum of Ten and 00/100 ($10.00) Dollars per property deed and will no longer maintain the properties; and WHEREAS, it is in the COUNTY's best interest to convey the properties on 33rd Street, Marathon, FL 33050 to the City of Marathon, Florida and the Monroe County School District as above described and shown within the attached exhibits. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA: Section 1: That the foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this resolution. Section 2: That the County Commission has approved the resolution to convey the property on 33rd Street; Marathon, Florida 33050.
