ITEM BACKGROUND: It was originally anticipated that it would take three (3) Requests for Additional Information (RAIs) and twelve (12) months to obtain the USACE permit for the Taxiway A Extension and Mitigation project. The USACE permitting process made no progress for several years due to staffing issues at the agency and it took 58 months and 20 RAIs. The USACE permit was issued on July 25, 2025. One of the permits that was required to be obtained was from the U.S.Army Corps of Engineers (USACE). The anticipated schedule to obtain this permit was estimated to take twelve months. As stated earlier, it was originally anticipated that obtaining the USACE permit would take approximately twelve months.Acquiring the permit took over 58 months.The timeline below demonstrates the delay in the USACE processing the permit application: Page 1 of 3 1217 • November 2020— Preapplication Meeting was held with the USACE. • June 21, 2021 —USACE Final Application Submitted. • July 23, 2021 — Public Notice Issued by USACE. • February 25, 2022— Notified by a USACE supervisor that our original assigned reviewer had resigned from the USACE. • March 23, 2022— Notified that new reviewer has been assigned to this project. • July 23, 2022—The new USACE reviewer required the Public Notice to be re- published. • Numerous RAI's were issued and responded to starting on November 5, 2021, through April 17, 2025, which included the USACE providing a second public notice to the National Marine Fisheries Service resulting in additional comments and questions that needed to be addressed. • April 22, 2025 —A Teams meeting was held with USACE to resolve one of the last items that needed to be address in the last RAI issued by the USACE. • July 24, 2025—Obtained USACE permit. As outlined above, the delay of an additional 46 months was clearly due to the lack of USACE resources and beyond the control of the design/permitting team. This required additional project management and coordination services. Indigo Snake Protection Additional environmental services were required to be performed for compliance with the issued USACE permit. One of the unanticipated conditions that is now required is to coordinate and notify with the appropriate agencies of construction activities in areas where the Indigo Snake may be present. This permit condition also requires the development of posters, pamphlets, and provide for virtual training to construction personnel to educate them on the Indigo Snake and the proper procedures if an Indigo Snake is discovered on the project site. At the completion of the project, a report must be prepared and submitted to USGWS documenting the implementation of the Standard Protection Measures that was performed during construction. Additional USACE Request for Additional Information (RAI) The original scope of services assumed this project would require a total of three RAI's would be required to be responded to as a matter of course in obtaining the USACE permit. The USACE submitted a total of 20 RAI's for is project.These additional RAI's required additional field surveys, seagrass surveys, bathymetric surveys at Tarpon Belly Key. RAI 12 resulted in follow-up questions and additional information requests on three separate Page 2 of 3 1218 occasions. A detailed list of RAI's and responses are noted in the attached outline of services from Birkitt Environmental Services, Inc., dated August 11, 2025. Mean High Water(MHW)Survey at Tarpon Belly Key The USACE requested additional information regarding the mitigation work scheduled to take place at Tarpon Belly Key. It was now required to survey the MHW line to further demonstration and ensure no work was to take place below the MHW line. Based on the results of the survey, the USACE required the grading plans, cross sections, planting plans, and erosion control plans be revised accordingly. Baseline Report The South Florida Water Management District (SFWMD) required a baseline report to be prepared and submitted for the Taxiway A mitigation sites.This supplemental includes the services to prepare the baseline report. ASSUMPTIONS/DESIGN PARAMETERS 1. This scope of work does not include bid services, construction administration, resident project representative nor quality assurance testing.This scope of work also does not include the development of a construction management plan. EYW TWA Construction Support= Compiled scope and fee—Additional Permitting Tasks August 11, 2025 Revision September 5, 2025 Task 9.0 Baseline Report-New (Originally sent 9/13/2023-resent 4/19/24) Birkitt Environmental Services, Inc. (Birkitt) is requesting a change order to this contract to perform environmental services to prepare the baseline monitoring report required by the above referenced SFWMD specific permit condition 11 for the Taxiway A Project mitigation sites. These baseline reports for the Hawk Missile Site and the Tarpon Belly Keys Mitigation Sites were prepared in June 2023. Charges: Birkitt proposes to conduct the services outlined in the tasks above on a lump sum basis for $2,365. Task 10.0 Indigo Snake Protection-New (Originally sent 9/13/2023-resent 4/19/24) Birkitt Environmental Services, Inc. (Birkitt) is requesting a change order to this contract to perform additional environmental services for compliance with USACE permit conditions regarding Indigo Snake Protection for the Taxiway A Project as required by the USACE and USFWS. Services: Pursuant to the conditions of the EIS Protection Measures, Birkitt will notify USFWS of the intent to utilize Standard Protection Measures. Birkitt will conduct virtual training for construction personnel regarding the EIS pursuant to the Measures. Birkitt will also provide guidance for preparation of posters and pamphlets required. Contractors will prepare posters and pamphlets. Contractors will install posters and distribute pamphlets to construction personnel. Birkitt will coordinate with the contractor and, following the completion of construction, prepare and submit the required report to USFWS documenting the implementation of the Standard Protection Measures during construction. Charges: Birkitt proposes to conduct the services outlined in the tasks above on a lump sum basis for $2,250. Task 11.0 NOT USED (No Scope — No Budget) Task 12.0 Additional USACE RAI's - New (originally sent 9/10/24, resent 1/13/25) The following contract change order request is being provided for additional services required for permitting the TWA project through the USACE as discussed in our meeting of March 27, 2024. 2 1222 Birkitt Environmental Services, Inc. EYW TWA Construction Support= Compiled scope and fee—Additional Permitting Tasks August 11, 2025 Revision September 5, 2025 Our permitting scope specified that we would provide up to three (3) Requests for Additional Information (RAI) responses and associated agency coordination for the USACE permitting. Extensive additional effort is being required due to numerous additional RAIs from the USACE. Additional responses to RAIs beyond the three (3) previously assumed RAIs have been provided for RAIs 4-12 including a response to RAI 12 questions received 6-21-24, 7-2-24, 7-15-24 from the USACE. These requests also required assistance with a bathymetric survey (Birkitt provided boat and support staff due to urgent timing). A Benthic/Seagrass survey at Tarpon Belly Keys (TBK) and report in accordance with USACE requirements were also required and conducted, and shoreline photos taken. Coordination with Toppino and Jacobs re: access approach to TBK to avoid environmental impacts, TBK elevations, agency coordination, and project management with Jacobs re: permitting tasks was required A response and communication with the USACE dated September 3 and follow up on September 4, 2024, to the RAI received from the USACE was provided. Responses to the USACE also required additional coordination with Jacobs and the Monroe County attorney. An additional $56,850 is requested for this Change Order through September 6, 2024. See attached list of RAIs, questions, responses and total hours. Task 13.0 Future USACE RAI's-New (originally sent: a. 11.0 9/10/24, resent a. 1/13/25) a - $30,000 + b - $28,700 = $58,700 Additional coordination with the USACE and project team and additional RAI responses were required to obtain the USACE Permit. Additional RAIs from RAI 13 through 20 and additional questions from the USACE and Revisions to the PRMP were required. The 1st Time Out Letter and 2nd Time Out Letter and Permit were reviewed to confirm accuracy. We are requesting an additional budget of $58,700 (a. $30,000 original request and b. $28,700 for additional request) for RAI/questions/revisions to the PRMP required by the USACE through July 31, 2025. Responses required additional coordination with Jacobs and Monroe County attorney and multiple conference calls with the USACE reviewer and USACE legal office. Review of the draft permit was also conducted and coordination with the County attorney and Jacobs PM was required. Additional efforts beyond our original additional budget request for additional USACE permitting services for this task were incurred to obtain the USACE permit on 7/24/25 and review permit for a total of $58,700 for this task. See attached list of RAIs, questions, responses and total hours. Task 14.0 MHW Survey at TBK— NEW (originally sent 1/17/25) The following contract change order request is provided for additional services required for permitting the TWA project through the USACE as discussed in October 2024. Birkitt agreed to provide support to O'Neal Survey and Jacobs for the MHW line survey required by the USACE along the north side of Tarpon Belly Keys Mitigation Area to demonstrate that no work was proposed below the MHW line. A boat and operator and guidance were provided to O'Neal and Jacobs for conducting the survey in October/November 2024. Currently,Taxiway A serves as the single point of access to Runway 9 for aircraft departures. Given the location of Taxiway A, aircraft using the available full departure length of Runway 9 must back-taxi the final 274 feet to the runway end on itself, which means that aircraft taxi on a segment of the runway in the opposite direction of the departure operations. Back-taxiing results in aircraft taxing in a direction opposite to the flow of departures and landings on that runway. There is a need to extend Taxiway A to the physical end of Runway 9. This would eliminate the need for back-taxi operations, improving the efficiency of aircraft operations on Runway 9-27.
