ITEM BACKGROUND: As a result of changes in County organizational structure and advisory processes, Monroe County no longer utilizes the Florida Keys Council for People with Disabilities to support its essential duties. Therefore, it is necessary to amend and repeal outdated language within the Monroe County Code of Ordinances to be consistent with the current needs of the County. Existing resources currently serving residents with special needs or disabilities includes: • Monroe County Community Services (Social Services and Veterans Affairs) • Local Coordinating Board for the Transportation Disadvantaged (Community Services is a voting member) • Department of Health— Quality of Life Committee(Community Services attends quarterly) • Guidance Care Center • Monroe Association for ReMARCable Citizens (MARC) • Center for Independent Living of the Keys (CIL of the Keys)—providing advocacy and support for individuals with blindness/low vision, hearing loss, cognitive, mental health, or physical disabilities • Continuum of Care— focused on homelessness (Community Services attends meetings) • Advocate Program—legal, veterans, homelessness, and behavioral health services If adopted, the proposed ordinance would amend the Monroe County Code of Ordinances by amending Chapter 2, "Administration," Article VIII, "Boards, Committees, Commissions and Authorities," by specifically repealing in its entirety Division 2, "Florida Keys Council for People with Disabilities." 1487 Prior to BOCC consideration of this ordinance, County Staff seeks approval to advertise a Notice of Intent to Consider Adoption of County Ordinance consistent with the requirements set forth in Section 125.66, Fla. Stat. A Business Impact Estimate has been prepared in accordance with F.S. 125.66(3). Summary of Proposed Ordinance and Statement of Public Purpose to be Served: The proposed ordinance repeals in its entirety Division 2,"Florida Keys Council for People with Disabilities," within Article VIII,Chapter 2,of the Monroe County Code of Ordinances.Division 2,"Florida Keys Council for People with Disabilities,"is no longer necessary due to changes in the County's organizational structure and the manner in which services and advisory functions related to persons with disabilities are currently provided. The public purpose served by this ordinance is to remove outdated and non-operational provisions,ensure the Code accurately reflects existing County practices, and promote clarity, transparency, and administrative efficiency.Repealing Division 2 does not diminish services for persons with disabilities,which continue to be addressed through established County departments and partner agencies. Estimate of Direct Economic Impact on Private/For Profit Businesses: a. Estimate of Direct Business Compliance Costs: Indeterminate.The repeal of Division 2 imposes no new compliance requirements on private or for-profit businesses.Any potential indirect effects are minimal and cannot be quantified. b. New Charges/Fees on Businesses Impacted: Indeterminate.The ordinance establishes no new fees,charges,or assessments applicable to private or for- profit businesses.No direct financial obligations are created. C. Estimate of Regulatory Costs: Indeterminate. The repeal of Division 2 does not create new regulatory requirements for private or for- profit entities.Any incidental impacts resulting from updated County advisory structures are minimal and cannot be reasonably estimated. That all ordinances or parts of ordinances, all County Code sections or parts of County Code sections, and all resolutions or parts of resolutions in conflict with this ordinance are hereby repealed to the extent of such conflict. Section 4: Severability. That should any section or provision of this ordinance or any portion thereof, any paragraph, sentence, clause or word be declared by a court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remainder hereof as a whole or part hereof other than the part declared invalid. If this ordinance or any provision thereof shall be held to be inapplicable to any person, property or circumstances, such holding shall not affect its applicability to any other person,property or circumstances. Section 5: Codification. That the provisions of this ordinance shall be codified within the Code of Ordinances of Monroe County, Florida, and any paragraph or section may be renumbered to conform with the Code of Ordinances. Section 6: Effective Date. That this Ordinance shall take effect upon filing with the Florida Department of State as provided in Section 125.66, Fla. Stat., as may be amended from time to time.
