Colina N/A AGENDA ITEM WORDING: Approval of a resolution designating members of the Monroe County Commission to represent Monroe County, Florida, on the Board of Governors of Fire and Ambulance District 1 for a one-year term commencing on January 1, 2026 and ending on December 31, 2026. ITEM BACKGROUND: Section 22-129, "Fire and Ambulance District 1 created," of the Monroe County Code of Ordinances, establishes a municipal service taxing unit to provide for essential municipal services, to wit: ambulance service and fire service. Subsection 22-129(c)(2) states, "the governing body of the district shall consist of at least three members of the board of county commissioners and at least one member of the governing body of the City of Layton. The board of governors shall be comprised of a total of five members. In such case, the county and city shall designate their representatives on the district governing body by resolution." PREVIOUS RELEVANT BOCC ACTION: 01/15/25 (C6) BOCC adopted Resolution No. 052-2025 that designated Michelle Lincoln, David Rice, and Holly Merrill Raschein as the(3) members of the County Commission to serve on the BOG for the January 1, 2025 - December 31, 2025 Term. WHEREAS, Section 22-129, "Fire and Ambulance District 1 created," of the Monroe County Code of Ordinances, establishes a municipal service taxing district to provide for essential municipal services, to wit: ambulance service and fire service; and WHEREAS, Subsection 22-129(c)(2) states, "the governing body of the district shall consist of at least three members of the board of county commissioners and at least one member of the governing body of the City of Layton. The board of governors shall be comprised of a total of five members. In such case, the county and city shall designate their representatives on the district governing body by resolution;" and WHEREAS, the Board of County Commissioners annually designates three Commissioners to be members of the Board of Governors of Fire and Ambulance District 1; and WHEREAS, at this time,it has become necessary for the members of the Board of County Commissioners to designate three Commissioners as members of the Board of Governors of Fire and Ambulance District 1 for a one year term commencing on January 1, 2026 and ending on December 31, 2026; and WHEREAS, the Board of Governors of Fire and Ambulance District 1 will present a resolution at its January 2026 meeting to elect a Chairperson and Vice Chairperson for the Board of Governors' 2026 term year. 1 2351 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA: Section 1: That the foregoing "WHEREAS"clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this resolution. Section 2: That the County Commission hereby designates the following members of the County Commission to be members of the Board of Governors of Fire and Ambulance District 1 of Monroe County, Florida for the 2026 term (one year term) starting on January 1, 2026 and ending on December 31, 2026: 1. 2. 3. Section 3: That all resolutions or parts of resolutions in conflict with this resolution are hereby rescinded to the extent of such conflict. Section 4: That if any clause, section, other part or application of this resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or in application, it shall not affect the validity of the remaining portion or applications of this resolution. Section 5: That this resolution shall be in full force and effect immediately upon its adoption.
