Trial Court Cases of Interest
1. Stacey Mitchell v. Monroe County et al, 24-CA-890-K._Plaintiff sued the County, BOCC,
TDC, and 3406 N. Roosevelt Blvd. Corp. (3406) alleging Whistleblower violations.
After the Court dismissed the Plaintiff's original complaint, the Plaintiff filed her
amended Complaint on 10/13/25, adding 2 additional defendants to the claim.
Discovery is ongoing. A hearing is scheduled for 12/11/25 on the County's
objections to a non-party subpoena issued to Commissioner Cates. Hearings
on the pending Motions to Dismiss the Amended Complaint are being scheduled
for January 2026.
2. Perla DeMiller v. Monroe County, 25-CA-849-K. Auto Liability case related to a year-
end accident involving a County vehicle from July 2024. Plaintiff filed suit on 7/24/25
and issued discovery requests with their Initial Complaint. The County was served with
a copy of the complaint on 9/23/25 and answered on 10/10/25. Discovery is ongoing.
3. 2014 Janet Vincent Family Trust, et al., v. Monroe County, 24CA332K. Plaintiffs are
seeking declaratory judgment regarding a parcel of land abutting their properties that
the property should revert to their ownership. A bench trial was held on 6/17/25. The
court ruled in the County's favor. Plaintiff's Motion for Rehearing was denied on
10/31/25. Plaintiffs filed a notice of appeal on 12/1/25.
4. Monroe County v. Mark Schofield, 18-CA-217-P. Foreclosure action stemming from
Code Compliance Case CE10040067. Monroe County has a Judgment of
Foreclosure. Schofield filed for bankruptcy on 7/31/25, case number 25-18841-CLC
in the Southern District of Florida, which the court dismissed as a bad faith filing on
8/26/25. County obtained the property at a foreclosure sale held on 11/21/25. 3194
5. In re: Silver Airways LLC, US Bankruptcy Court, S.D.Fla., 24-23623, Chapter 11
petition for reorganization filed by Silver. County Attorney's Office is assisting outside
counsel. Auction of Silver's assets took place 5/28/25. On 7/24/25, the court granted
the Chapter 11 Trustee's motion and entered an order converting the case to Chapter
7 proceedings. On 7/31/25, the court granted the Trustee's motion to establish an
administrative claims bar date and set the bar date as 30 days from the entry of the
order for administrative claims. Filing deadline for all non-governmental creditors to file
a proof of claim has been noticed as 10/6/25 and the filing deadline for government
creditors to file a proof of claim has been set as 1/26/26.
6. F.E.B. Corp. v. Monroe County & FDEP, DEP OGC Case No.: 24-1615 (DEP Permit
No. 44-0137939-029-EG). Petitioner F.E.B. Corp., challenges FDEP's permit to the
County that establishes a public mooring field at Man of War Harbor in Key West. On
10/29/25 DOAH dismissed F.E.B.'s petition with leave to amend. On 11/17/25
F.E.B. filed an Amended Petition. On 11/18/25 F.E.B. filed a Renewed Motion to
Stay Proceedings. On 11/19/25 three new for-profit companies (Parcel L
Development Corp., Sunset Key Transportation Corp., and Sunset Key
Restaurant Corp.) filed a Motion requesting to intervene in the case. On 11/25/25
the County filed its Response in Opposition to F.E.B.'s Renewed Motion to Stay.
On 12/1/25 the County filed its Response in Opposition to the three new
companies' Motion to Intervene. On 12/2/25 FDEP filed its Response in
Opposition to the three new companies' Motion to Intervene.
7. Roy's Trailer Park, Inc. et al. v. Monroe County, 19-CA-175-K. Declaratory Judgment
suit filed by Roy's against County as part of its eviction suit against its tenants. County
counterclaim against the park and the park residents, seeking an injunction prohibiting
occupancy at the park until serious fire and life safety issues have been addressed,
appointment of a receiver, and declaratory relief to determine whether the owner or
tenants are responsible for the code violations. The Court granted Roy's and Tenants'
Motion to Dismiss for lack of subject matter jurisdiction. County's Motion for Rehearing
filed 2/26/25. Defendants filed their joint response to the Motion for Rehearing on
9/29/25. The court denied the Defendants Motion for Rehearing on 11/18/25. The
County is considering appeal of the final judgment. A Notice of Appeal must be
filed on or before 12/3/25.
8. John Behmke et al. v. Monroe County, 24-CA-94-K. Plaintiffs are/were property
owners in Coral Hammock and allege inverse condemnation based on their inability to
conduct vacation rentals beginning in 2016, when code compliance cited them for
renting in a land use district that prohibited vacation rentals (the Third DCA affirmed a
decision of the Circuit Court finding the Mixed-Use District does not prohibit vacation
rentals of attached units and reversing orders of the code compliance special
magistrate finding the properties in violation). Plaintiffs seek compensation for takings,
as well as lost rental income and other financial damages. The Court denied the
County's motion to dismiss after a hearing on 9/12/25 and the County's answered on
10/14/25. Parties are proceeding with discovery and the County anticipates filing an
early motion for summary judgment.
9. Monroe County v. NGM Insurance Company, 25-CA-538-M. On 5/9/25, the County
sued for breach of performance bond relating to the Seaview Bridge Project in Duck
Key. The County is seeking damages for the cost of completing the project, additional
financing costs, and liquidated damages. Defendant filed a Motion for Leave to file
Amended Affirmative Defense, which was granted by the Court on 12/1/25. The
County's response to the Defendant's affirmative defenses is due 12/21/25. 3195
10.BOCC v. SGC Land Trust 2/12/2020, Sunset Gardens Farm, LLC, and FMC
Management, Inc., 25-CA-151-P. On 2/7/25, the County sued for declaratory and
injunctive relief against the defendants which operate an alleged farm on illegally
landcleared property. The County is seeking a declaration that the farm is in violation
of over a dozen ordinances, Comprehensive Plan policies, and statutes and seeks to
enjoin those violations and demand corrective action. On 6/2/25, the County
voluntarily dismissed the three individually named DFs from the lawsuit. The Court
heard the County's motion for preliminary injunction on 9/3/25 and reserved ruling on
it until it has an opportunity to decide on motions in the DFs separate lawsuit (Case
No. 2023-CA-000347) against the Monroe County Property Appraiser's Office. On
11/4/25 the Court heard the Property Appraiser's Motion to Dismiss and SGC
Land Trust et al.'s Motion for Leave to Amend. At the 11/4/25 hearing the Court
stated its intent to grant the Property Appraiser's Motion to Dismiss and to grant
SGC Land Trust et al.'s Motion for Leave to Amend. The Court has yet to hear
the motion for summary judgment that remains pending in the Property
Appraiser's case. The Court issued its Order granting SGC Land Trust et al.'s
Motion for Leave to Amend on 11/24/25. The Court has not yet issued its Order
granting the Property Appraiser's Motion to Dismiss.
11. BOCC v. Sunset Garden Estate Land Trust 2/10/2014, et al., 25-CA-738-P. On 7/1/25
the County sued for declaratory and injunctive relief against the defendants, who have
illegally cleared land and engaged in illegal construction and various illegal uses on
the property. The County is seeking a declaration that the owners are in violation of
over a dozen ordinances, Comprehensive Plan policies, and statutes and seeks to
enjoin those violations and demand corrective action. On 11/4/25, the Defendants
filed a motion to dismiss.
12.Garcia Jr., Pablo v. Monroe County BOCC, American Sports Federation, LLC, 24-CA-
32-P. On 06/01/2023, Plaintiff was allegedly injured during a softball game hosted by
Defendant American Sports Federation, LLC (`ASF'). ASF was operating under an
approved Use of Property with hold harmless agreement but failed to maintain
appropriate insurance coverage for the event so Risk's demand for defense and
indemnity was denied by both ASF and their insurance carrier. The parties mutually
sought extension of the case management discovery deadlines, which was
granted on 11/24/25
13.Galleon Bay v. Monroe County, 02-CA-595-K. On 7/21/25, Galleon Bay filed a motion
for summary judgment alleging the Clerk miscalculated the interest on the judgment
paid by the County and State and seeking to collect the additional amount. The County
filed its response on 8/26/25.
14.Farzan Home Designs v. Monroe County, 25-CA-883-K. Suit stemming from code
compliance case. Owner has demanded monetary damages related to the demolition
and rebuild of a home subjected to Hurricane Irma substantial damage letter. Suit was
filed on 8/1/25, but has not yet been served on BOCC.
15.Billy Sunday Jones v. Monroe County, 25-CA-785-P. Complaint filed 7/16/25 arises
from code compliance case finding owner in violation for unpermitted work on
residential property. about unpermitted structures. Owner's action is for declaratory
relief and inverse condemnation over the affected property. The court granted the
County's motion on 12/1/25. No appeal is anticipated.

16.Joshua Dreschel v. Monroe County, 25-CA-849-K. Suit stemming from code
compliance case. Owner seeks declaratory judgment quashing Final Order Imposing
Lien, alleging improper service of hearing notices. Owner has also initiated appeal of
this order in 25-AP-11-K. Suit was served on BOCC on 8/12/25. County's answer was
filed 8/29/25. A closed session was held on 11/12/25. A global settlement agreement
is being drafted.
17.Monroe County v. Phoenix Holdings, 22-CA-324-P. Suit stemming from code
compliance case, which Monroe County has filed to enforce its lien and compliance.
On 11/6/25, the Court granted the County's summary judgment motion; final
judgment is pending.
Appellate Cases
18.Maschal et al. v. Monroe County and FKAA, 19-CA-186-K/3D2025-0574. Suit by 12
individuals seeking similar relief to the Delaney lawsuit, which the County and FKAA
won. The County and FKAA answered and counter sued for injunctive relief,
compelling the property owner plaintiffs to connect to the system. On 1/28/25, the
Court granted the County & FKAA's motion for summary judgment and entered a final
judgment on 6/6/25. The County & FKAA's joint answer brief was filed 11/20/25.
19.Kearns Construction Company v. Monroe County, 24-CA-1134-M/3D2025-1586. This
action is a Petition for Writ of Certiorari seeking to quash the BOCC's award of the
contract for RFP-568 Artificial Reef Materials Deployment to Gulfside 10-Mile Reef. On
7/18/25, the Court ordered the quashing of BOCC's award of the contract to Biscayne
Towing and Salvage. The County filed a Petition for Writ of Certiorari on 8/18/25.
Kearns filed a response on 10/17/25. The County filed a reply on 11/6/25. On 11/24/25,
Kearns' request for Oral Argument was denied. Awaiting for a decision.
20.Monroe County v. Winifred Shosie, 22CA432K/3d25-1684. Injunctive action stemming
from Code Compliance Case CE19060049. At the pre-trial conference on 5/23/25, the
Court entered a Default Judgment in favor of the County. Shosie appealed to the Third
DCA; her brief is due 12/15/25.
21.Dalk Land, L.P. v. Monroe County Building Department, DOAH 25-1345. Dalk Land
has appealed a certificate of occupancy issued to its neighbor (Peter Giampaoli) on
basis of alleged floodplain regulation violations to the Division of Administrative
Hearings. Briefing was completed 6/13/25. Both Monroe County and Giampaoli have
filed motions to dismiss the appeal. Oral argument was held 9/26/25. Proposed
orders were submitted 11/3/25.
22.Cayo Hueso Investments, Inc. v. Monroe County, DOAH Case 24-2250-GM/3D2025-
0643. Cayo Hueso, an adjacent property owner, filed a petition challenging the
County's amendments of the Land Development Code (zoning) and Comprehensive
Plan (Future Land Use Map/FLUM) in order to allow a shoreside facility for the
proposed mooring field in Boca Chica Harbor. On 12/13/24, the ALJ entered a
Recommended Order affirming the correctness of the County's actions. On 3/17/25,
FloridaCommerce issued a final order finding the amendments consistent with statutes
and the comprehensive plan. On 4/11/25, Cayo Hueso appealed the final order to the
Third DCA. Cayo Hueso filed its initial brief on 9/26/25. The County's Answer Brief is
due on 12/26/25.

23.John Kuluz, et al. v. Monroe County & 17RM Investments, LLC, 21-CA-357-P/3D25-
500. Plaintiffs (neighbors) are the owners of property near 17RM's Key Largo property.
The Neighbors sought a declaratory judgment against the County's determination that
a 20-foot front-yard setback does not apply, under the Land Development Code, to
17RM's property on the basis that it is fronted by a private access easement. The Court
granted the County's and 17RM's motion for summary judgment then entered final
judgment in favor of the County and 17RM on 11/27/24. On 3/14/25, the neighbors
appealed to the Third DCA. The Neighbors filed their initial brief on 6/12/25. The
County filed its Answer Brief on 9/15/25. The neighbors filed their reply brief on
11/21/25.
24. 601 Cuda Properties, LLC v. Monroe County & SFWMD, Case No. 3D24-118 (L.T.
Case No. 2023-066-DAO-ERP) and 3D24-2101 (L.T. Case No.2024-086-DAO-
ERP). 601 Cuda Properties, LLC, has filed an appeal from a SFWMD Order
dismissing 601 Cuda's petition for a formal administrative proceeding on the grounds
that the petition was untimely. 601 Cuda's petition opposed the Environmental
Resource Permit that was issued to the County on 11/17/23, authorizing the use of
sovereign submerged lands to repair the Rock Harbor Breakwater and install an air
bubble curtain and seaweed gate. On 10/16/24, the property owner filed an amended
petition, which was denied by the District on 10/29/24. On 11/21/24, the property
owner appealed the denial to the 3rd DCA. On 5/13/25, the property owner filed its
Initial Brief. On 5/28/25, Appellee, SFWMD filed a Notice of Agreed Extension of Time
to File its Answer Brief 90 days to 9/10/25. On 9/09/25, Appellee, SFWMD filed its
Answer Brief. On 9/09/25, Appellee, Monroe County filed a Notice of Joinder joining
the Answer Brief of Appellee, SFWMD. On 10/07/25, the property owner filed a Notice
of Agreed Extension of Time to file its Reply Brief 60 days to 12/08/25.
25.Robert W. Leaver v. Monroe County, 25-AP-004-K. Owner appealed an Order
Authorizing Foreclosure and/or Money Judgment. Owner argues that the final order is
erroneous because the code investigation & prosecution was based on an anonymous
complaint, despite not having appealed the underlying Order finding violations of MCC
6-100(a)for unpermitted work. The County filed an answer brief on 8/1/25. On 10/3/25
the Court entered an order in the County's favor affirming order.
26.Key Largo Beautification, Inc. v. Monroe County, 24-CA-1077-P/3D24-2193. Owner
appealed dismissal of their petition for a writ of mandamus requesting the Circuit Court
to force the County to replat property in Key Largo (MM 98.7). The Owner filed its initial
brief on 8/14/25. The County's Answer Brief is due 12/12/25.
27.Shands v. City of Marathon, 3D21-1987. This is a long running takings case involving
an offshore island located within the City of Marathon. On 2/5/25, the Third DCA
issued a decision that created a new category of taking (an
"as-applied categorical taking") and vitiated the use of TDRs to avoid takings,
suggesting an owner must be provided a utilitarian physical use of their property. On
6/12/25, the City filed a notice to invoke discretionary jurisdiction in the Florida
Supreme Court. On 6/16/25, the County filed its notice of intent to file an amicus brief
in support of the City should the court accept jurisdiction. Additional amicus include
the Florida Association of County Attorneys and 1,000 Friends of Florida. The City
filed its brief on jurisdiction on 6/20/25. Reply brief of respondents filed 7/29/25.
Awaiting a decision on whether the FL Supreme Court will agree to hear the case.

28.Monroe County v. Denise Joy Snyder Living Trust, 3D25-0979. Owner filed an appeal
of the Code Compliance Special Magistrate's final order finding them in violation of the
code for RV storage and u nperm itted/u n restored land clearing and imposing fines and
restoration requirements. On 4/20/25, the Court affirmed the Special Magistrate's
order for the RV storage violation but reversed the land clearing violations because the
property owner relied on the "pruning, trimming, or removal of a tree" permit exception
of FS 163.045 and submitted an affidavit from an arborist that the trees on the vacant
residential lot created a hazard to life and property. The Court rejected the Special
Magistrate's finding that the pre-amended version of FS 163.045 that applied at the
time of clearing did not apply to vacant undeveloped property. The County sought
certiorari review in the Third DCA. The owner filed a response on 9/7/25. Awaiting the
appellate court's decision.
29.Swift Eddy Corp. v. Monroe County, Planning & Environmental Resources Department
File No. 2025-113. On 5/23/25, owner appealed a 4/23/25-issued Letter of
Understanding regarding its property on Big Coppitt to the Planning Commission. The
appeal will be heard at a future Planning Commission meeting.
30.Raymond Vazquez v. Monroe County, Planning & Environmental Resources
Department File No. 2025-108. On 5/21/25, a Sugarloaf property owner filed an
application to appeal a determination requiring removal of an invasive exotic melaleuca
tree. The Owners' appeal application remains pending and incomplete due to their
failure to state a basis for the appeal.
31.Lazaro & Beatriz Miguez Arango v. Monroe County, Planning & Environmental
Resources Department File No. 2025-109. On 5/28/25, owners of a parcel near MM
104 appealed a decision to fail a dock permit application based on the determination
that it fails to comply with the Land Development Code Section 118-12 ("Shoreline
Setback— Docking Facilities"). The Owners' appeal application remains pending and
incomplete due to their failure to file an initial brief.
32.Key Haven v. Florida DOT & DEO, 1 D2025-0660. The property owner sued the State
alleging a regulatory taking of its five (5) mostly submerged lots in the Key Haven
subdivision based on the State's denial of resource permits to fill the lots. Although
the County was previously dismissed as a party below, it is seeking amicus status.
Key Haven has appealed in the 1st DCA the trial court's 2/16/25 Final Summary
Judgment in favor of the State. Its initial brief was filed on 8/19/25. The State has
requested an extension until 12/17/25 to file its answer brief. The County will be filing
an amicus brief in support of the State.
Class Action Lawsuits where Monroe County is a Party
33.Monroe County v. 3M, et al., 22-CA-618-K/2:22-cv-03680-RMG, consolidated into
2:18-mn-02873-RMG: On 9/9/2022, Monroe County filed suit against manufacturers
of aqueous film-forming foam (AFFF) containing per- and polyfluoroalkyl substances
(PFAS) to recover damages for investigation, remediation, removal, disposal,
treatment and monitoring of water and soil created by defendants' products. PFAS
had been detected at the Monroe County Fire Training Academy on Grassy Key. On
10/7/22, defendants removed the case to the U.S. District Court for the Southern
District of Florida. On 10/26/22, the County's case was transferred and consolidated
with other similar cases in the Multi District Litigation (MDL) case pending in the District
of South Carolina before Hon. Richard M. Gergel.

Constitutional Officer Cases
34.Lissette Carey v. Sherrie Hodies, Supervisor of Elections, et al, 25-CA-843-K. KW
City Commissioner Lissette Carey filed suit on 7/30/25 challenging the effort to
initiate a recall election against her. The County Attorney's Office is defending the
Supervisor of Elections, who is a necessary party. Also named are the City, Clerk
Keri O'Brien, and James Strebek, the chair of the recall committee. Carey has filed
an Emergency Motion for Permanent Injunction and Declaratory Relief and requested
that the matter be handled on an expedited basis. On 8/5/25, the Supervisor filed a
response to Carey's Emergency Motion for Permanent Injunction and Declaratory
Relief. Carey dismissed the Supervisor of Elections and City Clerk on 8/12/25. The
case remains open against the City of Key West and Stebek should petitioners file
new recall petitions. The SOE might get added back as a party at that time.
35.The Supervisor of Elections is currently involved in several additional litigation matters
that have been brought against all 67 SOE's. The cases challenge various Florida
Statutes regarding election legislation and voter registration. Supervisor Hodies and
other SOEs retained outside counsel, but the County Attorney's office is assisting in
the defense of each case. Three older cases remain pending awaiting final resolutions
by the Courts. A new case was filed on 5/4/25, which challenges the constitutionality
of HB 1205 passed by the Legislature this year to regulate the initiative-petition
process:
A) Florida Decides Healthcare, Inc., et al v. Sec'y of State Cord, Sherri Hodies, et al,
4:25cv211-MW/MAF, USDC/NDFL. Three additional groups and one individual have filed
to intervene as Plaintiffs and the Republican Party of Florida filed to intervene as a
Defendant. The Court held a hearing on 5/22/25 on Plaintiff's Motion for an Injunction and
denied all claims except one of Plaintiff Jordan Simmons's vagueness claim challenging
the expanded definition of "racketeering activity." The original Plaintiff filed a second
Motion for Preliminary Injunction on 5/30/25, and other Plaintiffs followed with similar
additional Motions, which do seek relief from the SOEs, and a hearing was held on 6/30/25.
The Court denied the injunctions in part and granted in part. The Court entered another
Order on Motions for Preliminary Injunction on 8/21/25, which applied only to certain
counties, but Monroe County is not affected by the Order. Plaintiff FDH withdrew its
most recent Motion for Preliminary Injunction regarding signature verification fees
and has also suspended its initiative campaign (Provide Medicaid Coverage to
Eligible Low-Income Adults) for the 2026 election cycle.
Foreclosure Actions
36.The County Attorney's Office is currently prosecuting 23 cases to foreclose or
otherwise enforce on County code compliance liens. The Office is also currently
defending 6 mortgage foreclosure cases, where the County holds an interest in the
property, usually as a result of an inferior code compliance lien.

Other Matters of Interest
37.Code Collections. In October, Code Compliance and County Attorney staff collected
$142,914.82 in fines and costs. In November, $66,086.86 in fines and costs was
collected. For the first two months of FY26, collected fines and costs total $209,001.68.
The fines and costs spreadsheet as of November 2025 is attached to this report.
38.Vacation Rental Prosecutions. At the 11/20/25 Code Compliance hearing, seven
vacation rental cases were heard. In VR-SEP25-0061 the Special Magistrate ordered
a cease and desist with a $100 daily fine as well as a $10,000 one-time fine. All other
cases were compliant prior to the hearing and the Special Magistrate ordered one-time
fines as follows: VR-SEP25-0062, $9,000; VR-SEP25-0063, $6,000 if paid within 30
days, $9,000 if paid outside 30 days; VR-SEP25-0064, $5,000 if paid within 30 days,

39.Personnel Update. Jessica Quiggle has joined the County Attorney's Office to fill the
spot vacated when Anjelica Harden-Ivanoski moved out of Florida. Ms. Quiggle will
be the primary litigator for the office on non-land use matters. She most recently
worked as Assistant Deputy General Counsel for the St. Johns River Water
Management District. Prior to that, she worked in private practice for 2 firms.
