RESOLUTION NO. 559 -2025 A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA, TO CONVEY PROPERTIES LOCATED ON 33P-D STREET IN MARATHON AND KNOWN AS A PORTION OF PARCEL IDENTIFICATION NUMBER 00102310-0000001 MARATHON, FLORIDA 33050 AND FURTHER DEPICTED IN THE ATTACHED EXHIBITS TO THE CITY OF MARATHON AND THE MONROE COUNTY SCHOOL DISTRICT, RETROSPECTIVELY, PURSUANT TO FLORIDA STATUTES § 125.38; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, Section 125.38, Florida Statutes,provides that the COUNTY may convey or lease real property to the state, any political subdivision thereof, or any municipality of the state, upon request, when property is not needed for county purposes and is to be used for a public purpose by the requesting municipality or political subdivision of the state, for a value that may be nominal; and WHEREAS, the COUNTY owns property known as parcel identification number 00102310-000000, which includes property on 33rd Street in Marathon, Florida 33050; and WHEREAS, City of Marathon has requested a portion of the property including the old fire station and a portion of the former congregate meals site known as the senior center as described in Exhibit A, and a portion of land known as parcel K as described in Exhibit B, for the long-term goal of developing a community center; and WHEREAS, Monroe County School District has requested a portion of the property that is currently used and will continue to be used as a portion of the Stanley Switlik Elementary School parking lot, as described in Exhibit C; and WHEREAS, the properties as described within the exhibits are not needed for any COUNTY purpose; and 1 WHEREAS, the COUNTY will receive consideration in the sum of Ten and 00/100 ($10.00) Dollars per property deed and will no longer maintain the properties; and WHEREAS, it is in the COUNTY's best interest to convey the properties on 33rd Street, Marathon, FL 33050 to the City of Marathon, Florida and the Monroe County School District as above described and shown within the attached exhibits. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA: Section 1: That the foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this resolution. Section 2: That the County Commission has approved the resolution to convey the property on 33rd Street; Marathon, Florida 33050. Section 3• That the Mayor, or designee, is hereby authorized to execute quitclaim deeds and any other documents required to transfer these properties to the City of Marathon, FL and the Monroe County School District. Section 4• That all resolutions or parts of resolutions in conflict with this resolution are hereby rescinded to the extent of such conflict. Section 5: That if any clause, section, other part or application of this resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or in application, it shall not affect the validity of the remaining portion or applications of this resolution. Section 6: That this resolution shall be in full force and effect immediately upon its adoption.
