12/10/2003 Special12/10/03 2003/300 MINUTES OF THE MONROE COUNTY BOARD OF COUNTY COMMISSIONERS Special Meeting Board of County Commissioners Wednesday, December 10, 2003 Key West, Florida A Special Meeting of the Monroe County Board of County Commissioners convened at 9:00 A.M., on the above date at the Harvey Government Center. Present and answering to roll call were Commissioner Charles "Sonny" McCoy, Commissioner Murray Nelson, Commissioner George Neugent, Commissioner David P. Rice, and Mayor Dixie Spehar. Also present were Danny L. Kolhage, Clerk; Isabel C. DeSantis, Deputy Clerk; James Roberts, County Administrator; Richard Collins, County Attorney; County Staff, members of the press and radio; and the general public. All stood for the Invocation and Pledge of Allegiance. Motion was made by Commissioner Spehar and seconded by Commissioner Neugent to hear agenda item C before agenda item B. Motion carried unanimously. Agenda Item C - Motion was made by Commissioner Rice and seconded by Commissioner McCoy granting approval of an extension to the deadline for an additional 90 days (March 30, 2004) to apply for CDBG grants for Low and Very -Low income property owners and renters on Stock Island wishing assistance to pay for wastewater connection fees. Motion carried unanimously. Agenda Item B - County Administrator James Roberts addressed the Board with background information concerning additional wastewater collection system work on south Stock Island and instructions to staff as appropriate. Mike Condon, representing URS Consulting Engineers made a presentation before the Board and discussed the document entitled Conceptual Roadmap For Central Sewer System Extensions (Phase IV) - South Stock Island, dated December 10, 2003. Ken Williams, representing CH2MHill also addressed the Board concerning the wastewater collection system project on south Stock Island. Attorney Bob Nabors discussed easements. After the presentations, the following individuals addressed the Board: Jeff Weiler, representing Weiler Engineering/KWRU; Al Vercellino, Kim Wigington, Carolee McReynolds, R. L. Blazevic, William Smith, representing KW Resort Utility; Ross Murphy, Fred Skomp, representing Hurricane Hole Marina; Bill Hunter, Gabriela Pozzi, representing Leo's Campground; and Ed Castle, representing Weiler Construction. After discussion, motion was made by Commissioner Rice and seconded by Commissioner Spehar authorizing Staff to proceed with an optimization recommendation and scope to include an analysis of adding additional areas to sewer south Stock Island. Roll call vote was unanimous. 12/10/03 2003/301 Agenda Item D - The Board discussed the response from Monroe County to the proposal by the Secretary of the Florida Department of Community Affairs in reference to the Monroe County Comprehensive Plan and Work Program. Mayor Nelson read aloud the following document: RESULTS OF AN AGREEMENT WITH DCA THIS AGREEMENT WILL: 1. Provide $130 million for wastewater, environmentally sensitive lands, and workforce housing from DCA. 2. Provide $130 million for wastewater, environmentally sensitive lands, and workforce housing from Monroe County. 3. Provide the means for the State of Florida and Monroe County to move forward and still allow either party not to participate should the mutual agreement not be fulfilled. 4. Provide $20 million for land purchases of workforce housing over the next two years. 5. Provide a pledge of $80 million for wastewater over the next 6 years. 6. Return 180 market rate permits each year for Monroe County. 7. Provide 300 out-of-ROGO permits for year 2004 for workforce housing. 8. Provide up front cesspit credits. 9. Rescind the Notice of Violation issued by the State. DCA WILL PROVIDE 1. 300 ROGO allocations for workforce housing. 2. Provide $10 million for purchase of workforce building sites in 2004. 3. Provide $10 million for wastewater as a match for County bonding $20 million in June 2004. 4. Provide $20 million in State/Fed funds as a match for wastewater as a match for County's bonding $20 million in June 2005. 5. Provide 180 market rate permits per year. 6. Provide $93 million for purchase of environmentally sensitive lands. 7. Any changes to ROGO that could be construes as a taking would be initiated by DCA. 8. Provide up front cesspit credits for the building of new homes. 9. DCA will report substantial progress n 28-20 work plan. 10. Rescind the Notice of Violation issues to Monroe County. MONROE COUNTY WILL: 1. Bond $20 million of infrastructure funds for wastewater as a match for a $10 million grant from the State. 12/10/03 1 2003/302 2. Provide a pledge to expend $80 million collected from connection fees to expand wastewater projects using the connection fee funds. 3. Provide a second $20 million bond on infrastructure funds to match a Federal/State match of $20 million in June of 2005. 4. Bond $10 million of Land Authority revenue (1/2 penny of the tourist impact tax) to buy workforce housing lnad in 2004. Murray E. Nelson, Mayor December 10, 2003 Charles Brooks, representing the Key Largo Wastewater District Board; Jim Reynolds, Executive Director of the Florida Keys Aqueduct Authority; and Mr. Roberts addressed the Board. After discussion, motion was made by Commissioner Spehar and seconded by Commissioner McCoy granting approval of the above proposal read by the Mayor. Roll call vote was unanimous. The following individuals addressed the Board: William Knight, representing Bay Point Home Owners; Sandy Walters, Jody Thomas, representing The Nature Conservancy; and George Wilson. Roll call vote was unanimous. Motion was made Commissioner Rice and seconded by Commissioner Neugent that a Special Meeting be held between the Board and appropriate representatives from the State to discuss and negotiate issues before us. Roll call vote was unanimous. Monroe County Land Use Attorney, James T. Hendrick addressed the Board and announced that Monroe County had won the Ambrose case as the 3rd District Court of Appeals reversed Judge Payne's decision. There being no further business, the meeting of the Board of County Commissioners was adjourned. Danny L.
