Semoran Blvd. Suite 2-1021B Winter Park, FL 32792 (hereinafter referred to as "Grantor")and Harold P_ Ware, a mairied persona with an address of 361 Jacobson-Cookstown Rd, North Hanover, NJF 08562 (hereinafter referred to as"Grantee"). WITNESSETH: WHEREAS,by Mineral Deed dated April 24, 1990 and recorded in Official Records Book 1129, Page 967,Public Records of Monroe County,Florida, Grantor is the holder of certain subsurface oil, gas and mineral rights (the "Mineral Rights") in connection with that certain real property located in Monroe County,Florida described in Exhibit A(the"Property"): WHEREAS, Grantee is the fee simple owner of the Property, except for the above referenced Mineral Rights held by Grantor; and WHEREAS, Grantor has agreed to release its right of entry into the Property for purposes of mining, exploring or developing the subsurface oil, gas and minerals that may exist within said Property. The above referenced recitals are incorporated herein by reference. 2. Grantor hereby forever waives, releases and discharges its right of entry into the Property for the purposes of mining, exploration or development of the oil, gas and minerals that Grantor holds as a result of the Mineral Deed. 3. No Mineral Rights are transferred hereunder to Grantee and nothing contained herein shall grant Grantee any rights under the Mineral Deed. Grantee hereby acknowledges that it does not hold the Mineral Rights and agrees for itself, its successors and assigns that it shall not contract, prospect for, drill or enter or disturb the surface of said property for purposes of removing any minerals,the same being expressly prohibited. 4. The terms,covenants and conditions of this Release shall continue in perpetuity. 5. This Release shall be binding upon and inure to the benefit of the parties hereto, their respective successors, assigns and legal representatives and shall be deemed to run with the land described herein. 6.
