ITEM BACKGROUND: The RFP was issued on October 25, 2025. Proposals were opened on January 13, 2026. Two proposals were received: Earth Tech Enterprises, Inc. for $15,423,452 and LPS Utilities, Inc. dba LPS Contracting for $8,198,689.50. The selection committee met in a publicly advertised meeting on January 21, 2026. After public deliberation and review of the proposals and a public comment period, the committee ranked the proposals as follows: Rank 1 To be pfevided aftef the soloetief mittee meeting of T,,,,,,,.... 2 LPS Utilities, Inc. dba LPS Contracting Rank 2 Earth Tech Enterprises, Inc. The grant budget for this project is $2.6 Million. Staff will negotiate with the top-ranked vendor and if an agreement can be reached will return with a contract to the commission for approval. The RFP issued by the county anticipated a potential phased and/or reduced scope of work and referenced it in the document. It was also discussed at the pre-bid meeting. Background: The existing breakwater structure built along the shoreline decades ago provided much needed protection from storm surge and high winds, protecting the homes from catastrophic damage. However, Hurricane Irma was too much for the structure to bear and many of the boulders on the top toppled into the sea. The damaged structure now provides far less protection to homes from coastal erosion, storm surge and flooding. Repairs to the breakwater structure will once again help provide protection from storm surge and high winds as it increases the resilience of the neighborhood. The Duck Key Living Shoreline project will rebuild and enhance 10,650-linear feet of existing breakwater wall and rehabilitate it as a Living Shoreline which will include natural vegetated aspects from mangrove plantings, seagrass beds, and other living shoreline applications to reduce climate risks while enhancing habitat and benefiting the Florida Keys Natural Marine Sanctuary, designated as among Florida's Outstanding Waters. The County received a$3,327,266 grant from the Florida Department of Environmental Protection under Grant 422-FRP-132 as part of the Resilient Florida program. There is no match required. All work must be completed by June 30, 2026, to qualify for reimbursement from FDEP. Members of the Public: Adam Giles —LPS, Butch McGovern—Earth Tech Enterprises Call to order —Meeting called to order at 2:00 p.m. Roll call—All selection committee members and technical advisors Joe DiNova and Greg Corning were in virtual attendance. Two members of the public attended: Butch McGovern from Earth Tech Enterprises and Adam Giles from LPS Contracting. Review of Proposals: Rhonda Haag introduced the meeting and rules of the selection committee process and introduced the members. She read the Bid Tab and advised that proposal prices were above the budget of$2.6 Million. No additional funds are available, and all work must be completed by June 30, 2026. The RFP specified that a reduced amount of work could be performed if proposals came in above budget. The selection committee reviewed each proposal to provide comments on submittals and rationale based on the criteria in the RFP, as follows: Earth Tech: Price $15,423,452.00. Response met the requirements of the RFP. There was a heavier focus on the commercial built environment rather than the environmental restoration portion of the project. A concern is that the need for an in-water monitor was not included in the proposal, although the requirements were specified in the RFP. The response was a solid response. Pricing was high. Earth Tech has solid and relevant experience, though not a lot of planting references were provided. There were numerous examples of shoreline experience referenced in Monroe County. The construction methodology didn't reference the staging area. Pricing was factor. 1 LPS Utilities Inc. DBA LPS Contracting Price: $8,198,689.50 — This was the lowest priced proposal but still above the budget. It was a solid proposal. LPS has very good relevant experience with similar projects. There wasn't a lot of plantings projects provided but mangrove planting experience with a county project was referenced. References were not provided. The construction methodology was very good and specific to this project. An LPS owned lot was offered for staging. Pricing is over budget. The proposal did not refer to in-water monitoring needed. The source of the plant material was left open. The company has experience in planting but didn't identify who would be performing that portion of the work. A cost saving measure was to use a 1-gallon mangroves instead of a 3-gallon ones, which could be acceptable.. An alternative form of construction option was referenced to meet the budget.The LPS proposal was a strong and technically good response. Public comment: Butch McGovern from Earth Tech said they appreciated the effort.
