Colina AGENDA ITEM WORDING: A Public Hearing to consider adoption of an Ordinance that amends the Monroe County Code of Ordinances by enacting a new section numbered as Section 13-1 entitled, "Adoption of minimum fire prevention and life safety codes," to incorporate the state-mandated minimum firesafety code as further described therein; and by amending Section 13-27, "Appointment, job description,"by retitling it as "Local Fire Official,"to update terminology within the Monroe County Code. ITEM BACKGROUND: Section 125.01(1)(d), Fla. Stat., states that counties have the power to "[p]rovide fire protection, including the enforcement of the Florida Fire Prevention Code, as provided in ss. 633.206 and 633.208, and adopt and enforce local technical amendments to the Florida Fire Prevention Code as provided in those sections and pursuant to s. 633.202." Within Chapter 13, "Fire Prevention and Protection," Article I, "In General," of the Monroe County Code, Section 13-1 was scheduled to be a reserved section pursuant to County Ordinance No. 026-2007. However, now it has been deemed advisable to utilize the available section to expressly state that the Florida Fire Prevention Code, and such rules and regulations issued by the State Fire Marshal, is the minimum fire and life safety standards applicable within the unincorporated areas of Monroe County, Florida. Additionally, pursuant to Section 633.118, Fla. Stat., "[t]he chiefs of county, municipal, and special- district fire service providers; other fire service provider personnel designated by their respective chiefs... are authorized to enforce this chapter [633] and all rules prescribed by the State Fire Marshal within their respective jurisdictions." Currently, the County's Code requires the Board of County Commissioners to appoint the County Fire Marshal, however such designation is not necessary because the County Fire Chief, and other fire service personnel as designated by the County Fire Chief, possess the inherent authority to enforce said laws and rules. As such, Monroe County Fire Rescue (MCFR) requests these updates to the Monroe County Code to avoid potential confusion between local and state laws. The clarification and proposed updates provided in this Ordinance will facilitate effective administration, enforcement, and oversight of fire prevention activities. The subject Ordinance was advertised consistent with the requirements set forth in Section 125.66, Fla. Stat. PREVIOUS RELEVANT BOCC ACTION: The BOCC has approved various revisions to Chapter 13 of the Monroe County Code since 1979, including but not limited to: Ord No. 20-1984; Ord. No. 3 8-1987; Ord.
